Summary
Mr. Grégory Labille draws the attention of the Minister of the Economy, Finance and Recovery to the ineffectiveness of current measures to combat unsolicited telephone canvassing. According to a UFC - Que Choisir survey, 100% of French people consider cold calling “annoying” and note that it is increasing. Faced with the demand for consumer protection and in order to put an end to the nuisance caused, law no. 2014-344 of March 17, 2014 relating to consumption established a specific list called “Bloctel” on which citizens who no longer wish to receive unsolicited commercial telephone calls can register. Despite this legislative progress, there are more than 200,500 reports from consumers registered on Bloctel continuing to receive canvassing calls for commercial purposes. Data available as of 30 September 2018 showed that only 1,062 companies had subscribed to Bloctel, of which only 655 still had a current subscription as of September 30, 2018. European Regulation No. 2016/679 known as the General Data Protection Regulation (GDPR) came into force on May 25, 2018 and only requires the consumer's prior consent for automated commercial prospecting, i.e. emails, emails, SMS or faxes, but not cold calling. The proposed law aimed at regulating telephone canvassing and fighting against fraudulent calls was promulgated on July 24, 2020. If this law includes advances such as the ban on canvassing for energy renovation, except under a current contract, or even provisions to better fight against fraudulent calls, it only “regulates” telephone canvassing and remains based on the objective of improving the effectiveness of the Bloctel system, which is largely ineffective.
