Summary

Ms. Ericka Bareigts draws the attention of Ms. the Keeper of the Seals, Minister of Justice, to the recent decision of the Nantes administrative court annulling the granting, by the city of Nantes, of a subsidy of 22,000 euros to the lesbian, gay, bisexual and transexual (LGBT) center of Nantes for the year 2018. The court in fact considered that the LGBT center of Nantes, which had expressed positions favorable to marriage for couples of same sex, the opening of medically assisted procreation (PMA) and had hosted an information meeting on surrogacy (GPA), could not receive a public subsidy since these positions concerned political opinion. This decision of the Nantes administrative court is likely to initiate a regrettable jurisprudential practice because it would limit the public expression of associations on large national causes such as the fight against tobacco, excessive consumption of alcohol or, in general, on the policies implemented by the Government. However, these associations are fully part of the French public debate: this case law, if it were to be followed, would lead to a halt to public subsidies for associations wishing to raise concerns or take positions with citizens. There freedom of expression would thus be reduced. She asks him to what extent this decision of the Nantes administrative court would modify the relations between associations and communities and what solutions are envisaged so that associative expression can continue freely without financial compensation.
