Summary

Mr. Antoine Vermorel-Marques draws the attention of the Minister of State, Keeper of the Seals, Minister of Justice, to the application of the reform resulting from the orientation and programming law of the Ministry of Justice of November 20, 2023 concerning industrial tribunal advisors. The aforementioned reform provides in article L. 1442-3 of the labor code that industrial tribunal advisors exercise a mandate of four years, of which they cannot carry out the functions more than five times. In addition, their mandate expires at the end of the calendar year in which they reach the age of 75. The provisions of the law are about to apply for the general renewal of industrial tribunal advisors scheduled for the end of the year, for the 2026-2029 mandate. Experienced advisors who have already held several mandates and have time to devote to this role are becoming increasingly rare. These new provisions complicate the search for candidates for the position of industrial tribunal advisor and will prevent many available advisors from continuing their mandates. He asks him for the measures envisaged to overcome these difficulties as well as for exemptions to be granted for the new mandates planned from 2026.
