Summary

Mr. Grégoire de Fournas draws the attention of the Minister of the Armed Forces to the sanctions taken since the start of the covid-19 health crisis against unvaccinated military personnel. In the context of the covid-19 health crisis, the ministerial instruction of July 29, 2021 no. 509040/ARM/DCSSA/ESSD relating to vaccination against covid-19 in the armies added vaccination against covid-19 to the vaccination schedule in the armed forces, in accordance with article D. 4122-13 of the Defense Code which provides that the compulsory vaccination schedule for military personnel is set by instruction from the Minister of the Armed Forces. However, since the start of the crisis, it has been proven that many soldiers who have not been vaccinated against covid-19 have consequently been sanctioned in different ways through decisions of temporary incapacity to serve, sanctions disciplinary sanctions, transfers-sanctions, inability to go on external operations, days of forced leave, delays in advancement and were even liable to criminal prosecution within the framework of the application of article L. 323-6 of the code of military justice. Also, he asks the minister to communicate to him: the number of soldiers having refused vaccination against covid-19, the total number of them having been in fact sanctioned by the following respective measures: impossibility of going on an external operation (OPEX), impossibility of serving at sea, impossibility of boarding a vessel of the national navy, impossibility of participating or competing in permanent maritime safeguard or air security postures, in public service missions, as well as in deterrence, as well as the number of them having been transferred following their refusal of vaccination and the number of those who left the armed forces for this reason. Furthermore, while the High Authority for Health (HAS) envisages in its draft opinion of Monday February 20, 2023, the end of compulsory vaccination for caregivers and the epidemic situation in France is marked by a significant drop in the number of contaminations and the incidence rate thus justifying the latest health restrictions, it requests therefore if it considers to cancel and repeal the instruction of July 29, 2021 as soon as possible.
