Summary

Mr. Alain Perea draws the attention of the Minister of Labor to the advisability of a more incentive mechanism for returning to work by reducing the effects induced by the increased compensation deferral in the event of a supra-legal redundancy bonus. Indeed, as provided for in article 21 of the decree of May 4, 2017 approving the agreement of April 14, 2017 relating to unemployment insurance and its associated texts, and although the latter has reduces the ceilings in the deferral period, the deferral mechanism often deprives the employee of receiving the return to work allowance for many months. Annihilating, in most cases, any “boost” effect for the benefit of the person deprived of employment, the mechanism also deprives these additional premiums of any incentive effect, in particular for the initiative of creating a self-enterprise. Living during this deferred period on the benefit of the supralegal bonus, this system deprives the person deprived of employment of the possibility of building up a cash reserve which could be useful, or even essential, for launching an activity. This cash reserve, combined with the ACRE system, would nevertheless and certainly facilitate the success of self-creation job initiatives. Also he asks him if a reform of this system, making it more incentive, is planned as part of future reforms.
