Summary

Ms. Laurence Maillart-Méhaignerie draws the attention of the Minister of Labor, Full Employment and Integration to the subject of taking into account teaching allowances in the constitution and liquidation of teachers' retirement pension rights. Article 14 of Law No. 91-715 of July 26, 1991 relating to various provisions relating to the civil service provides that the periods during which allowances were received of teaching created by Decree No. 89-608 of September 1, 1989 creating teaching allowances, as well as the first year spent in a university teacher training institute as a beneficiary will be taken into account for the constitution and liquidation of the right to a retirement pension, subject to tenure in a body of teachers and under conditions fixed by decree of the Council of State. However, it appears that the implementing decree provided for by this article has, to date, never been published. During the examination of the social security amending financing bill for 2023 in the Senate, the Minister committed to thinking about an effective solution to compensate for this obvious shortcoming by involving parliamentarians wishing to take part in this initiative. Also, she asks him to kindly indicate when this consultation will be carried out with a view to accelerating the publication of this implementing decree.
