Summary
Mr. Antoine Armand draws the attention of the Minister to the Minister of Regional Planning and Decentralization, responsible for housing, to the consequences of the anti-speculative clauses of the rental-ownership social loan system (PSLA) during the resale of acquired housing. Established by Law No. 2004-809 of August 13, 2004, the PSLA is a social home ownership system intended for low-income households. It is based on an agreement between an operator and the State or the authority delegating housing aid, by which the operator undertakes to build, buy or, since 2020, rehabilitate housing to sell it to households under resource conditions, within the framework of a rental-ownership contract. Each operation must be approved by the State or its delegatee. This device is particularly attractive because of the numerous financial and tax advantages it offers. However, alerted by citizens in his constituency, the MP underlines that the anti-speculative clause of the PSLA, which prohibits the resale of housing at a price higher than its purchase price for a period of up to 35 years, strongly slows down the donation of these goods. Indeed, this clause conflicts with notarial practice which, in the event of a donation, retains the value sale of the property at the time of donation. This situation constitutes a major obstacle to the transfer of housing acquired via the PSLA. He therefore asks what measures the Government is considering to remove this barrier to donations and what value will be retained to guarantee that access to housing through this system is fair and appropriate.
