Summary

European Directive 2014/45 provides that a periodic technical inspection of two- or three-wheeled vehicles and motorized quadricycles, with a cylinder capacity greater than 125 cm3, must be put in place from January 1, 2022, unless Member States can demonstrate that they have put in place alternative road safety measures, taking into account in particular the relevant road safety statistics for the last five years. The French Government had favored, as other countries in Europe have done, the implementation of alternative measures, instead of the establishment of technical inspection of two, three wheels and motorized quadricycles. However, following several contentious procedures initiated by environmental associations, the Council of State ruled, in its decision of October 31, that: "such measures (...) can only be regarded as too punctual and clearly insufficient to effectively ensure the safety of users of categories and subcategories L3e, L4e, L5e and L7e, with a cylinder capacity greater than 125 cm3 in view of the relevant road safety statistics which demonstrate that this remains very degraded. They cannot therefore be considered as alternative road safety measures taken in the sense and for the application of Directive 2014/45 of the European Parliament and of the Council of April 3, 2014". As a result, in its decision of October 31, the Council of State (EC) annulled the decree of July 25, 2022 which repealed the decree of August 9, 2021 establishing the technical inspection of two, three-wheeled and motorized quadricycles with the consequence of reviving the decree of August 9, 2021. The Government has taken note of the Council's decision of State, the highest French administrative court. The Government emphasizes that this decision does not lead to the immediate entry into force of the technical inspection, given the need to first publish implementing texts of the decree of August 9, 2021. In order to determine the modalities for implementing the technical inspection, a consultation was launched in November by the Minister responsible for Transport with the motorcycle associations, environmental associations and representatives of technical inspection professionals.
