   Les dispositions de article 189 de la loi n° 2025-127 du 14 février 2025 de finances pour 2025 ont modifié article L. 822-3 du CGFP, qui prévoit désormais la perception de 90 % du traitement pendant les trois premiers mois de la maladie ordinaire. S'agissant du régime indemnitaire des sapeurs-pompiers professionnels, en l'absence de corps à l'État exerçant des fonctions équivalentes, le principe de parité ne s'applique pas aux sapeurs-pompiers professionnels qui disposent d'un régime indemnitaire spécifique, prévu par le décret n° 90-850 du 25 septembre 1990. Dans une récente publication, la direction générale des collectivités locales confirme que les sapeurs-pompiers professionnels ne sont pas concernés, à la différence des autres fonctionnaires soumis au principe de parité, par l'application de l'paragraph 1 de article 1er du décret 2010-997 du 26 août 2010 qui prévoit que le régime indemnitaire est versé dans les mêmes proportion que le traitement. Elle indique ainsi que "le montant des régimes indemnitaires des […] sapeurs-pompiers professionnels non soumis au principe de parité n'est donc pas impacté par la réduction à 90 % du traitement pendant les trois premiers mois du CMO" et, en conséquence, que les conseils d'administration n'ont pas à délibérer pour ajuster les montants et taux du régime indemnitaire des sapeurs-pompiers professionnels.
