   Le ministère de la culture est très attentif à la situation du cirque en France. C'est à ce titre qu'il est membre, aux côtés de sept autres ministères (l'intérieur, l'économie, les finances, l'emploi et la formation professionnelle, l'éducation nationale, l'environnement et l'agriculture), de la Commission nationale des professions foraines et circassiennes, créée par le décret du 29 octobre 2017. Cette Commission pérennise la mission interministérielle dirigée par le Préfet Lemaire qui avait été mise en place le 30 juin 2016 pour répondre aux difficultés croissantes rencontrées par les cirques itinérants, notamment pour obtenir des autorisations d'installation de la part des mairies. Si le ministère de la culture reste particulièrement vigilant quant au niveau d'inventivité et de création, il reconnaît que les cirques de tradition qui perpétuent le travail avec les animaux contribuent à la diversité de l'offre de spectacles sur le territoire. La détention d'animaux sauvages dans les cirques est autorisée par la loi. Les conditions de détention et d'utilisation des espèces non domestiques dans les établissements de spectacle itinérants sont définies dans une réglementation stricte relevant, pour l'essentiel, du ministère de la transition écologique et solidaire, qui délivre des certificats de capacité permettant cette activité et réalise des contrôles réguliers par le biais de ses services vétérinaires.
