Summary

Ms. Danielle Simonnet draws the attention of the Minister of State, Keeper of the Seals, Minister of Justice, to the alarming situation of judicial agents for the protection of adults practicing in an individual capacity (MJPMi). These professionals, whose case law and doctrine recognize that they contribute permanently to the functioning of the public service of justice and, as such, have the status of auxiliaries of justice, ensure today the legal protection of more than 100,000 vulnerable adults, due to age, illness, disability, isolation or insecurity. The profession is today divided into several statuses. Part of this works as an employee of an agent service for the protection of adults managed by an association or as an employee of a hospital, social or medico-social establishment. THE MJPMi, for their part, exercises a regulated profession in a liberal capacity, within the framework of a judicial mandate, to fulfill a public service mission. But this mission is today on the verge of asphyxiation. Their remuneration has been frozen since 2014, despite a sharp increase in their expenses and an increasing complexity of the situations to be handled. In eleven years, their purchasing power has fallen by 12%. Added to this is the degradation continued public services, on which they depend on a daily basis. The chronic underfunding of administrations and medico-social establishments clogs the circuits, extends deadlines and considerably increases their workload. The MJPMi are direct witnesses and the first victims. The deep sense of their mission of public interest, serving the most vulnerable, is no longer enough to compensate for remuneration insufficient and degraded working conditions, which inevitably weaken the quality of protection provided to adults. In several territories, MJPMi are already no longer replaced. The National Federation of MJPMi (FNMJI) warns of the risk of a collapse of the system. It proposes, as an emergency measure, to restore the indexation of the remuneration of protection measures on the SMIC or on the AAH, as was the case before 2014. She therefore asks him what measures he intends to take to respond to the emergency reported by professionals in order to guarantee the sustainability of the legal protection system for adults and to recognize the MJPMi of justice auxiliaries in their place.
