Summary
Mrs Marina Ferrari draws the attention of the Minister for Europe and Foreign Affairs to the “double taxation” of French retirees who reside in Italy. Since 2021, it appears that the Italian tax administration has been asking these French retirees to declare the retirement income they receive in order to subject them retroactively to Italian income tax. This practice of the Italian tax service seems disregard article 18 of the tax convention of October 5, 1989 signed by the Government of the French Republic and the Government of the Italian Republic. Although the French and Italian tax administrations have recently strengthened their dialogue and have made available an internet page for users explaining that this double taxation is justified, no change in law can justify this change in practice of the Italian tax administration which occurred in 2021. Consequently, it wishes to know to what extent the bilateral tax convention between France and Italy can be renegotiated in order to put an end to this injustice which affects French retirees who reside in Italy.
