Summary

Article 30 of Law No. 2017-1338 for confidence in political life of September 15, 2017 authorized the Government to take by order, within nine months of its promulgation, the necessary measures so that political parties and groups subject to Law No. 88-227 of March 11, 1988 relating to the financial transparency of political life can, in the event of proven market failure, ensure financing electoral campaigns by obtaining loans, advances or guarantees. The Government has therefore assessed the relevance of creating a democracy bank to respond to the financing difficulties of certain candidates or certain political groups, particularly with regard to possible market failures. At the end of this study, it appears that access to credit is less due to an absence of banking services, than to filling a bank of democracy, as well as questions of information or deadlines, which can be handled by the credit mediator who, for his part, was established by article 28 of the law for confidence in political life of September 15, 2017. This mediator was appointed by decree of the President of the Republic on August 3, 2018, published in the Official Journal of August 4, 2018. He will be responsible for promoting or instigating solutions of conciliation with credit institutions and financing companies regarding loans and access to a bank account. Its mission will also be to maintain a dialogue of trust with players in the banking sector, to promote good practices and to support the definition of market agreements. Consequently, the action of the mediator should make it possible to respond effectively to the financing difficulties encountered by candidates and political parties or groups, without the need to create a dedicated banking structure. The Government will take stock of the functioning of this new institution to assess whether it makes it possible to respond to the problems which had justified the commitment to its reflection.
