Summary

The Allowance for Disabled Adults (AAH) is a social minimum which helps protect people with disabilities from extreme poverty. Beneficiaries of the AAH-2 whose disability rate is between 50% and 79% can only benefit from the AAH subject to being recognized as a Substantial and Durable Restriction on Access to Employment (RSDAE) which attests, as its name indicates, a restriction in access employment, due to disability. AAH-1 beneficiaries, whose disability rate is equal to or greater than 80%, are not subject to this criterion. The choice was therefore made to target, for the payment of the AAH, people affected by a particularly high disability (AAH-1) and people affected by a less severe disability but who encounter significant difficulties in entering the labor market (AAH-2). Maintaining the right to AAH resulting from an incapacity rate of between 50% and 79% beyond retirement age contradicts the need for beneficiaries to certify an RSDAE, even though they are retired. All AAH beneficiaries whose incapacity rate is between 50% and 79% (AAH-2) therefore see their right to AAH interrupted at the legal retirement age. The liquidation of the Retirement for all AAH beneficiaries is automatic at the age of 62. In fact, AAH beneficiaries are automatically eligible for the retirement system for incapacity, which allows them in particular to liquidate their pension at this age at the full rate, even without meeting the insurance duration conditions. As the legal retirement age approaches, AAH beneficiaries are invited by mail to do assert their retirement rights. Once the organization which pays the AAH (family allowance fund or agricultural social mutuality fund) is in possession of the receipt for the old-age pension application sent by the beneficiary, the right to the AAH is maintained until the first pension payment due date. If retirement rights are low or zero, AAH-2 beneficiaries can request the Solidarity Allowance for the Elderly (ASPA) to supplement their resources. Indeed, for these beneficiaries, the right to ASPA opens at age 62, earlier than under common law. Since January 1, 2025, the maximum amount of the ASPA for a single person is €1,034.28 per month, an amount almost equivalent to that of the AAH (€1,033.32 per month since April 1, 2025). These people can therefore combine, where applicable, their retirement pension and/or their ASPA with remuneration, subject to the accumulation conditions in force. They therefore have the possibility of extending their professional activity.
