Summary
Ms. Laurence Maillart-Méhaignerie questions the Minister of Labor, Full Employment and Integration on the recognition of the right to strike for disabled people working in work assistance establishments or services (ESAT). ESATs allow a disabled person to carry out an activity in a protected environment if they have not acquired enough autonomy to work in an ordinary environment or in an adapted company. If the people in disabled working in Ésat are recognized as disabled workers, however they do not enjoy all the rights recognized to other workers. From July 2021, as part of the ESAT transformation plan, measures have been taken to strengthen the place and recognition of disability in the world of work. Decree No. 2022-1561 of December 13, 2022 clarified and enriched several of these measures. However, several associations representing disabled workers have raised the need to recognize the right to strike for ESAT workers with an integration contract. The recognition of the right to strike for ESAT workers appears to be a fair and equitable measure, allowing disabled workers to integrate more fully into the world of work and to have a right fully recognized by the Constitution. She therefore asks him if a development in favor of the recognition of the right to strike for workers in ESAT, or of an analogous form of social demand, was envisaged by the Government.
