Summary
The law of March 8, 2018 relating to student guidance and success provides for the end of the management delegation from which student mutual societies benefited. Many employees of these structures will actually see their functions disappear within these organizations. It is within this framework that the law provided for the automatic transfer, to the health insurance organizations of the general system, of the employment contracts of employees of the delegated bodies assigned to management activities of the compulsory regime. As part of the discussions initiated between the national health insurance fund (CNAM) and the student mutual societies on the modalities of implementing the transfer of activities, a common methodology was defined in order to determine the personnel to be transferred, in accordance with the law, to the health insurance funds. Regarding staff assigned to functions of affiliation, liquidation and reimbursement of services, physical or telephone reception, they are clearly identified since these functions are separated from those relating to activities relating to additional services. The transfer of these personnel to the CNAM should not pose any difficulty. Difficulties could, however, arise with regard to the personnel who are brought to deal indifferently, within the delegated mutual societies, with missions relating to one or the other of these activities. For these personnel, the CNAM and the mutual insurance companies have implemented a defined distribution key, for each of the delegated structures, according to the respective number of employees assigned to compulsory scheme activities or supplementary scheme activities. Applied to these personnel, mainly made up of agents working on support functions, the distribution key thus defined makes it possible to determine the number of employees not exclusively assigned to a single activity who must be transferred to health insurance. The management of the situation of employees of student mutual societies is therefore the subject of particular attention by the CNAM services. The work continues on the basis of the aforementioned methodology and no difficulties have been reported at this stage.
