Summary

M. André Chassaigne interroge M. le ministre de l'économie et des finances sur la difficulté d'interprétation d'une disposition du code du commerce introduite par la loi n° 2014-366 du 24 mars 2014. En effet, selon le 7e paragraphe de l'article L. 725-1, « la création ou l'extension d'un point permanent de retrait par la clientèle d'achats au détail commandés par voie télématique, organisé pour l'accès en automobile » est soumise à autorisation d'exploitation commerciale. La doctrine juridique concernant cela est relativement floue pour ce qui est des commerces auxquels elle s'applique. Il lui demande si ce dispositif est applicable aux "drives" de la restauration rapide.
