National Aeronautics and Space Administration Authorization Act

National Aeronautics and Space Administration Authorization Act - Authorizes appropriations to the National Aeronautics and Space Administration (NASA) for research and development, construction of facilities, and research and program management. Permits appropriations for research and development to be used: (1) for any items of a capital nature (other than acquisition of land) which may be required at locations other than NASA installations for the performance of research and development contracts; and (2) for grants to nonprofit institutions of higher education, or to nonprofit organizations whose primary purpose is the conduct of scientific research, for purchase or construction of additional research facilities. Stipulates that when so specified in an appropriation Act any amount appropriated for "Research and development" or for "Construction of facilities" may remain available without fiscal year limitation. Permits the funds for construction of any of specified facilities: (1) in the discretion of the NASA Administrator, to be varied upward ten percent; or (2) following a report by the Administrator to the Committee on Science and Technology of the House of Representatives and the Committee on Aeronautical and Space Sciences of the Senate on the circumstances of such action, to be varied upward 25 percent to meet unusual cost variations. Limits the total cost of all construction work to the total of the amounts specified. Permits one-half of one percent of the funds appropriated for research and development to be transferred to the "Construction of facilities" appropriation. Authorizes the expenditure of such funds, together with $10,000,000 of the funds appropriated for construction of facilities, to construct, expand, or modify laboratories and other installations. Disallows any amount appropriated pursuant to this Act from being used for any program deleted by the Congress from requests as originally made to either the House Committee on Science and Technology or the Senate Committee on Aeronautical and Space Sciences. Disallows any amounts appropriated pursuant to this Act from being used for any program in excess of the amount actually authorized for that particular program for research and development or research and program management. Disallows any amount from being used for any program which has not been presented to or requested of such committees, with certain exceptions. Expresses the sense of the Congress that it is in the national interest that consideration be given to geographical distribution of Federal research funds whenever feasible, and that NASA should explore ways and means of distributing its research and development funds whenever feasible. Authorizes NASA, if authorized in an appropriation Act, to enter into a contract for tracking and data relay satellite services.

Earth Resources and Environmental Information System Act - Title I: Earth Resources and Environmental Information System; Policies and Management - States the policies and purposes of this Act. Title II: Establishment of the Earth Resources and Environmental Information System - Establishes an Earth Resources and Environmental Information System, consisting of a "space segment" and a "data handling segment", to provide data and information on the resources and environment of the Earth to both domestic and foreign users. Title III: Federal Coordination and Planning - Requires the Director of the Office of Science and Technology Policy in the Executive Office of the President to oversee and coordinate, for research and development, the validation and operational phases of the system. Requires the National Aeronautics and Space Administration to establish and operate the space segment of the System, including replacement of satellites, to complete validation of the System, and to insure that other countries can acquire data from such segment. Requires the Secretary of the Interior to establish and operate the data handling segment of the System. Title IV: Miscellaneous Provisions - Authorizes appropriations to carry out the purposes of this Act.

Stipulates that no amount appropriated pursuant to this Act may be used for any program: (1) deleted by the Congress from requests as originally made to either the House Committee on Science and Technology or the Senate Committee on Aeronautical and Space Sciences; (2) in excess of the amount actually authorized for that particular program; and (3) which has not been presented to or requested of either such committee, unless specified conditions have been met. Authorizes the National Aeronautics and Space Administration to enter into a contract for tracking and data relay satellite services. States that the Administrator of NASA may prescribe regulations prohibiting the disclosure of any technical information obtained by the Administration in its conduct of research or development activities, or permitting the release of such information with restrictions, if such technical information was submitted in confidence or contains data which if released may be detrimental to the position of the United States as a leader in aeronautical and Space technology.

National Science and Technology Policy, Organization, and Priorities Act of 1976

National Science and Technology Policy and Organization Act - Title I: National Science Policy - Declares that the United States shall adhere to a national policy for science and technology which includes the following principles: (1) the continuing development and implementation of a national strategy for determining and achieving the appropriate scope, level, direction, and extent of scientific and technological efforts based upon a continuous appraisal of the role of science and technology in achieving goals and formulating policies of the United States; (2) the enlistment of science and technology to foster a healthy economy in which the directions of growth and innovation are compatible with the prudent and frugal use of resources and with the preservation of a benign environment; and (3) the development and maintenance of a solid base for science and technology in the United States. States the declaration of Congress that the Federal Government should maintain central policy-planning elements in the executive branch in mobilizing resources for essential science and technology programs, in securing appropriate funding for those programs, and to review systematically Federal science policy and programs and to recommend legislative amendments when needed. States that, in order to expedite and facilitate the implementation of the policy enunciated in this Act, the following coordinate procedures are of paramount importance: (1) Federal procurement policy should encourage the use of science and technology to foster frugal use of materials, energy, and appropriated funds; to assure quality environment; and to enhance product performance; (2) explicit criteria, including cost-effectiveness principles where feasible, should be developed to identify the kinds of science and technology programs that are appropriate for Federal funding support and to determine the extent of such support; (3) Federal promotion of science and technology should maximize quality of research, stability of scientific and technological institutions, and, for urgent tasks, timeliness of results; and (4) antitrust regulation should not preclude cooperation among competing firms in industrial research and development unless such cooperation is anticompetitive. Title II: Office of Science and Technology Policy - Presidential Science and Technology Advisory Organization Act - Establishes in the Executive Office of the President the Office of Science and Technology Policy. Provides for the appointment of a Director, four Assistant Directors, and other personnel. Specifies the functions of the Office, including to: (1) advise the President of scientific and technological considerations involved in areas of national concern; (2) evaluate the scale, quality, and effectiveness of the Federal effort in science and technology and advise on appropriate actions; (3) advise the President on scientific and technological considerations with regard to Federal budgets; and (4) assist the President in providing general leadership and coordination of the research and development programs of the Federal Government. Title III: The Federal Science and Technology Survey Committee - Establishes within the Executive Office of the President, and in association with the Office of Science and Technology Policy, a Federal Science and Technology Survey Committee. States that the Committee shall consist of from five to twelve members appointed by the President. Specifies the qualifications of the members of the Committee. States that the functions of the Committee shall be to survey, examine, and analyze the total context of the Federal science and technology effort including missions, goals, personnel, funding, organization, facilities, and activities in general. Stipulates that the life of the Committee shall be 24 months from the date of its first organizational meeting. Title IV: Miscellaneous - Authorizes to be appropriated such sums as may be necessary to carry out the purposes of this Act.

Permits utilization of research and development appropriations for: (1) items of a capital nature which may be required at locations other than installations of the Administration for the performance of research and development contracts, and (2) grants to nonprofit institutions of higher education, or to nonprofit organizations whose primary purpose is the conduct of scientific research, for purchase or construction of additional research facilities. Sets forth further guidelines regarding the use and availability of funds appropriated pursuant to this Act. Specifies procedures where amounts designated for specific programs may be varied upward and whereby up to one half of one percent of the funds appropriated for research and development may be combined with $10,000,000 of funds appropriated for facility construction to construct or modify laboratories or other installations deemed by the Administration to be immediatley needed. Prohibits utilization of sums appropriated pursuant to this Act for: (1) any research or management program in excess of the amount specifically authorized for that program, (2) any program deleted by Congress from requests originally made, or (3) any program which has not been presented to either the House Committee on Science and Technology or the Senate Committee on Aeronautical and Space Sciences unless each such Committee has been given notice of any such proposed action and transmits written notice to the Administration that it has no objection. Directs the Administration to consider geographical distribution whenever feasible in allocating its research and development funds. Authorizes the Administration, when so provided in appropriation Acts, to enter into and to maintain a contract for tracking and data relay satellite services. Establishes an additional Associate Administrator for Advanced Research and Technology within the Administration. Revises the compensation of members of the Aerospace Safety Advisory Panel. Expresses the sense of Congress regarding the need for, and the construction, modernization, and availability of aeronautical test facilities. Declares that Congress finds that the general welfare of the United States requires application of the Administration's expertise to ground propulsion systems research and development.

Requires the President to transmit to Congress not later than April 15, 1975, a report containing recommendations for proposed actions to be taken to carry out the policy set forth in this Act and such revisions in the budget proposed by fiscal 1976 as the President deems necessary to do so. Requires the President to submit each year prior to 1980, as part of the Aeronautics and Space Report, a description of activities and evaluation of progress under this Act, and an evaluation of the desirability of establishing a permanent Earth resources satellite system.

National Policy and Priorities for Science and Technology Act - Declares that it is the continuing policy and responsibility of the Federal Government to take appropriate measures directed toward achieving various goals, including: (1) a continuing Federal investment in science and technology adequate to the needs of the Nation; and (2) the strengthening of national capabilities for technological planning and policy formulation. Declares it to be the purpose of this Act to promote the effective application of science and technology to the furtherance of national goals by: (1) establishing a Council of Advisors on Science and Technology in the Executive Office of the President to provide a source of scientific and technological analysis and judgment to the President; (2) establishing an Intergovernmental Science and Technology Advisory Committee to foster the application of science and technology to State and regional needs; (3) establishing an Interagency Federal Coordinating Committee on Science and Technology to coordinate agency research and development efforts; and (4) having the President submit an annual Science and Technology Report to the Congress. Title I: Council of Advisors on Science and Technology - Establishes in the Executive Office of the President a Council of Advisors on Science and Technology. Directs the Council to annually appraise progress in science and technology in relation to the needs of the Nation and, taking account of the state of the economy through consultation with the Council of Economic Advisors, to determine the desired level of Federal investment in science and technology for the fiscal year immediately following the fiscal year in which such determination is made, and make appropriate recommendations to the President and Congress. States that the Council shall serve as a source of scientific and technological analysis and judgment for the President with respect to major policies, plans, and programs of science and technology of the Federal Government. Requires the President to transmit annually to the Congress, beginning October 15, 1976, a Science and Technology Report which shall set forth: (1) a review of development of national significance in science and technology; (2) the significant effects of current and foreseeable trends in science and technology on the social, economic, and other requirements of the Nation; (3) a review and appraisal of selected science and technology-related programs, policies, and activities of the Federal Government; (4) an inventory and projection of critical and emerging national problems the resolution of which might be substantially assisted by the application of science and technology; (5) the identification and assessment of scientific and technological measures that can contribute to the resolution of such problems, in light of the related social, economic, political, and institutional considerations; (6) the existing and projected scientific and technological resources, including specialized manpower, that could contribute to the resolution of such problems; (7) recommendations for legislation on science and technology-related programs and policies that will contribute to the resolution of such problems; and (8) recommendations with regard to Federal investment level and priorities in science and technology, as made by the Council pursuant to this Act. Title II: Federal Coordinating Committee for Science and Technology - Establishes the Federal Coordinating Committee for Science and Technology. States that the Committee shall consider problems and developments in the fields of science and technology and related activities affecting more than one Federal agency, and shall recommend policies and other measures: (1) to provide more effective planning and administration of Federal scientific and technological programs; (2) to identify research needs including areas of research requiring additional emphasis; (3) to achieve more effective utilization of the scientific and technological resources and facilities of Federal agencies, including the elimination of unnecessary duplication; and (4) to further international cooperation in science and technology. Abolishes the Federal Council for Science and Technology. Title III: National Science Foundation - Directs the National Science Foundation to recommend and encourage the pursuit of national policies designed to foster research and education in science and engineering, and the application of scientific and technical knowledge to the solution of national problems. Requires the Foundation to initiate an educational program of continuing education in science and engineering in order to enable scientists and engineers who have been engaged in their careers for at least five years to pursue courses of study designed to: (1) provide them with new knowledge, techniques, and skills in their special fields; or (2) acquire new knowledge, techniques, and skills in other fields which will enable them to render more valuable contributions to the Nation. Title IV: State and Regional Science and Technology Programs - Establishes, within the National Science Foundation, an Intergovernmental Science and Technology Advisory Committee. Provides that the Committee shall advise and assist the Foundation in: (1) identifying and defining civilian problems at the State, regional, and local levels and the environment in which solution to these problems ought to be provided; (2) identifying areas of highest priority for study, assessment, and development of policy alternatives by the Foundation under this title; and (3) identifying and fostering ways to facilitate the transfer and utilization of results of civilian research and development activities so as to maximize the application of science and technology to civilian needs. Authorizes the Director of the National Science Foundation to make grants not to exceed $100,000 to any State to pay a part of the cost of establishing an Office of State Science and Technology. Title V: General Provisions - Authorizes appropriations to carry out the various provisions and titles of this Act.

Directs the Administrator to report annually to the President on his activities and accomplishments pursuant to this Act. Provides for a study by the National Academy of Sciences of the nature and likelihood of potential effects on public health and the environment of the discharge of such gas. Directs the Administrator of the National Aeronautics and Space Administration to report to the Congress on such potential effects. Provides for a program of standards to limit the emissions of such gas from major sources. Provides for the enforcement of prohibitions upon the manufacture and sale of aerosol spray containers which discharge such gas, including penalties of up to $10,000 in civil fines per day of violation under this Act. Authorizes appropriations to carry out this Act.

Solar Energy Act - Title I: Findings, Policy, Purpose and Definitions - Declares it the policy of the United States to reduce national reliance on crude oil imports as an energy source by demonstrating the reliability of solar energy generation facilities. Title II: Solar Energy Fiscal Year 1977 Suggested Budget Outlays for Operating Expenses, Plant and Equipment, and Construction - Recommends budget outlays for fiscal year 1977 in the following areas: solar heating and cooling, agricultural and industrial process heat, solar-thermal electric, photovoltaic, ocean-thermal, wind, solar crop irrigation, resource assessment and technology utilization, and other areas of solar energy research. Includes recommended budget outlays for specific projects. Title III: Responsibilities of the Administration - Amends the Energy Reorganization Act of 1974 to direct the Administrator of the Energy Research and Development Administration to: (1) insure, to the maximum extent possible, that procurement under such Act be on a cost-sharing basis with private business; (2) consult with the Administrator of the Small Business Administration before granting or contracting of any demonstration projects under the Act; and (3) report to the President and the Congress by September 30, 1977 on the integration of existing electric utility systems with decentralized solar-electric generation systems.

Establishes objectives for research programs designed to implement a national materials policy which provides for the maximum effective use of limited resources. Title II: Organization and Operation - Establishes a National Materials Policy Board in the Executive Office of the President to advise the President on alternative methods of implementing national materials policy, and to review Federal programs which affect national materials policy. Directs the President to appoint a Special Assistant for Materials Policy to serve as chairman of the Board. Establishes a Commission on Materials Research and Operations to review programs recommended by the Board. Directs the Commission to establish a Patent Policy Committee to consider special problems relating to dispositions of patents resulting from Government-funded research. Establishes Select Committees in both the House of Representatives and the Senate on the subject of materials policy.

Earth Resources Information Satellite System Act - Title I: Earth Resources Information System Policies and Management - Declares it the policy of the United States to establish an Earth Resources Information System to aid in the effective management and utilization of the Earth's resources through the use of earth satellites and other observation sources. Title II: Establishment of the Earth Resources Information System - Establishes the Earth Resources Information System, to be implemented immediately by the President in a manner consistent with the purposes of this Act. Title III: Federal Coordination, Planning and Regulation - Establishes an Office of Earth Resources Policy in the Executive Office of the President to aid in the planning, coordination, and review of all phases of the development of the Earth Resources Information System. Directs the National Aeronautics and Space Administration to continue research and development activities and to consult with and assist the Earth Resources Satellite Corporation in order to fulfill the purposes of this Act. Title IV: Creation of an Earth Resources Satellite Corporation - Authorizes the establishment of the Earth Resources Satellite Corporation if the President determines that a corporation is required to operate the domestic ground segment in order to achieve the purposes of this Act. Directs the Corporation to manage the commercial domestic data handling segment of the Earth Resources Information System. Authorizes the Corporation to contract for research and development and services necessary for its operation. Title V: Miscellaneous Provisions - Requires that notification of negotiations between private entities and any foreign businesses, with respect to facilities; operations; or services authorized by this Act, be given to the State Department. Authorizes judicial relief in the United States district court for actions taken which violate any of the provisions of this Act. Directs the President to transmit an annual report to Congress on Federal activities taken to achieve the objectives of this Act. Directs the Corporation to submit annual reports of its activities to the President and Congress. Authorizes the appropriation of $1,000,000 for fiscal year 1976 to implement the provisions of this Act.

Solar Heating and Cooling Demonstration Act - Declares it to be the policy of the United States and the purpose of this Act to provide for the demonstration within a three-year period of the practical use of solar heating technology and to provide for the development and demonstration within a five-year period of the practical use of combined heating and cooling technology. Directs the Administrator of the National Aeronautics and Space Administration to initiate and carry out a program as provided in this Act for the development and demonstration of solar heating systems for use in residential dwellings and commercial buildings. Provides for the installation of solar heating systems in residential dwellings, to be monitored by the Secretary of Housing and Urban Development. Provides that such residential dwellings shall be located in a sufficient number of different geographic areas in the United States to assure a realistic and effective demonstration of solar heating and cooling systems involved. Directs the Director of the National Science Foundation to initiate, support and fund basic and applied research activities related to solar energy in support of the objectives of this Act. Directs the Secretary of Housing and Urban Development to assure the full dissemination of information with respect to the activities conducted under this Act to Federal, State, and local authorities, the building industry and the public at large. Directs the Secretary to establish and operate a Solar Heating and Cooling Information Data Bank for collecting, reviewing, processing, and disseminating solar heating and cooling information in support of the objectives of this Act. Sets forth reporting requirements for agencies conducting activities under this Act. Provides for adjustment of the maximum dollar amount of any Federally-assisted mortgage loan or the maximum per-unit or other cost of any Federally-constructed housing if such structure is furnished with solar heating or combined solar heating and cooling equipment under the demonstration program established by this Act. Provides that within sixty days after creation of any permanent Federal organization having jurisdiction over the energy research and development functions of the United States, all research and development functions vested in other agencies by this Act, along with related records, documents, personnel, obligations and other items shall be transferred to the new organization. Authorizes the appropriation of up to $50,000,000 to carry out this Act.

Establishes, under the National Aeronautics and Space Act, the National Technology Resources Council in the Executive Office of the President. Specifies the membership composition of such Council. Makes it the function of the Council to prepare a technology resources survey and to advise and assist the President with respect to other technology resource matters. Directs the Council to prepare and transmit to the President and Congress a technology resources survey identifying the existing scientific, engineering and technologucal activities, capabilities, which each might be used to practical advantage in the resolution of the nation's critical domestic problems. Enumerates the items to be included in such survey. Authorizes the Council to exercise specified administrative powers. Directs the Administrator, through the Office of Technology Application to: (1) upon request, furnish technical assistance to the Council; (2) upon direction of the Council, accept responsibility for specific domestic problems and (3) utilize aerospace firm and other scientific organizations in the private sector to assist in developing scientific strategies for the resolution of critical domestic problems.
