Estonian University of Life Sciences Act

The bill establishes the law of the Estonian University of Life Sciences, which stipulates the university's purpose, tasks, management and funding bases. The draft is related to the draft law on higher education. The draft stipulates the responsibility of the university in areas related to the development of rural life and rural economy. The bill renews the management structure of the university by providing that the university is managed by the Council, the Senate and the Rector. According to the draft, strategic decision-makers at the university and a seven-member council including external members, whose composition is appointed by the government for five years. According to the current regulation of the University Act, the council is an academic decision-making body, in which external members are not included, and non-university members belong to the board of trustees, the composition of which is determined by the government. The bill additionally provides for a senate as the governing body of the university, which is responsible for matters of study and research and development activities. The Senate has the power to grant issue regulations and adopt decisions within their competence. The rector, as the governing body of the university and chairman of the senate, is responsible for the execution of the university's statutes, development plan and budget. The university's activities are financed from the state budget, and the basis of the financing will not be changed. Compared to the current law, the bill foresees an amendment regarding the establishment of a private school or a private research and development institution. If it is currently possible to establish it in the event that it is with a foundation, one of the founders of which is the state, then according to the draft, a private legal entity founded by a university does not have the right to establish a private school or a private research and development institution. The planned entry into force of the law is September 1, 2019. The new management model will be fully implemented from January 1, 2020.

The Act on Amendments to the Act on Vocational Education Institutions and Amendments to Other Acts Related to It

The draft better connects vocational education with the needs of the labor market, renews the principles of financing vocational education, enables better access to vocational education and enhances the process of assessing the quality of vocational education. The planned changes are based on the goals set in the Estonian lifelong learning strategy 2020 and the vocational education program 2018-2021 prepared for its implementation. According to the bill, the school council approves the number of training places for the calendar year, which is previously approved by the board of school advisors. This means that the state, in cooperation with partners, negotiates the training volumes of each school. The change makes it possible to respond more directly to the needs of learners and the labor market in cooperation with local entrepreneurs. According to the bill, schools will be allocated operating support from the state budget and, if necessary, targeted support. Performance funding accounts for up to 20 percent of the base funding volume and depends on the school's academic results. Base funding gives the school the certainty of covering operational costs, performance funding increases motivation and autonomy. The draft also expands the target group of the school lunch subsidy, according to which schools are allocated a school lunch subsidy for non-secondary education students studying in primary education curricula in stationary education, regardless of their age. Based on the current procedure, the school lunch allowance is given to a student who has reached the age of 20 without a secondary education for the current academic year to the end. The bill changes the conditions for receiving a vocational teacher's short-term support, and in the future, teachers who are going to teach at a vocational school in Tallinn or Tartu can also apply for the initial support. According to the changes, from September 1, 2020, the initial allowance will be paid in one installment, currently it is paid in three installments. Initial support is also provided for support specialists who work at a vocational training institution for the first time. There is initial support for support specialists and teachers approximately 12,700 euros. With the aim of widening access to advanced education, the draft provides for the possibility of conducting general education in a non-stationary form of education in vocational education institutions. Acquisition of basic education in non-stationary education for a person aged 17 or older is currently also guaranteed by the local government unit, and there is also the possibility to carry out the relevant education in a state gymnasium. The draft aims to change the current accreditation of vocational education organization, which is replaced by quality assessment. A school with the right to conduct open-ended studies in the curriculum group receives meaningful feedback in the quality assessment process to improve both the learning process and organization at least once every six years.

Eelnõu näeb ette luua võimalus rakendada õpilaste suhtes täiendavaid mõjutusmeetmeid, et tagada turvaline ja õppimist soodustav koolikeskkond. Turvalisuse tagamiseks, ohuolukordade ennetamiseks ning vajadusel sekkumiseks näevad muudatused ette võimaluse koolil rakendada täiendavalt kahte mõjutusmeedet. Esiteks, võtta kooli hoiule esemed ja ained, mis on koolis keelatud või millega võib seada ohtu enda või teiste turvalisuse või mis on kohandatud vara rikkumiseks või hävitamiseks. Teiseks viia läbi turvakontroll vaatlemise ja kompimise teel ning õpilase esemete läbivaatus.
