Mr. Anthony Brosse questions the Minister of Labor and Solidarity on the situation of former local elected officials who have liquidated their retirement rights with IRCANTEC and subsequently resumed an elective mandate of the same category. In application of the interministerial instruction of July 8, 1996, still in force to this day, the accumulation of an IRCANTEC pension and the exercise of a mandate giving rise to official allowances under a same category is prohibited. This rule leads to the automatic and immediate suspension of pension payment, without any choice being offered to the elected official concerned. The latter makes compulsory contributions again, without being able to maintain the benefit of his retirement, even if the amount of this is modest and his local commitment renewed without financial aim. If the principle of non-cumulation between active contribution and perception of a retirement within the same scheme is understandable, the total lack of flexibility in its implementation appears disproportionate in view of the sincere commitment of local elected officials. While numerous written questions have already mentioned this situation and work has been carried out to clarify it, no regulatory change has seen the light of day since 1996. He therefore asks whether the Government is considering introducing a choice allowing the elected official to choose between maintaining his allowance without a new contribution and resuming contributions with suspension of the allowance and whether a revision of the interministerial instruction of July 8, 1996 is being studied in order to put an end to this rigidity, felt as an injustice by the elected officials who recommit themselves to the service of their municipality.

Mr. Anthony Brosse draws the attention of the Minister of Health, Families, Autonomy and Disabled People to the situation of workers in establishments or work assistance services (ESAT) and their membership of mutual insurance. Disabled workers accommodated in ESAT “benefit from collective coverage with compulsory membership”, within the meaning of article L. 344-2-10 of the social action and families code. But this same article must be the subject of a decree in order to exempt certain categories of people from this subscription. Despite the passing of Law No. 2023-1196 of 12/18/2023 more than two years ago, this regulatory measure has not yet been taken by the Government. Mr. Anthony Brosse questions the Minister of Health, Families, Autonomy and People with Disabilities on the integration of fibromyalgia into the list of diseases recognized as long-term conditions (ALD). Currently, treatment for fibromyalgia is possible by off-list ALD, in accordance with article R. 322-6 of the social security code. A severe form must nevertheless be detected by a medical advisor, complicating the process of recognizing the pathology. In 2023, the Ministry of Health indicated that “the absence of known causes allowing medical admission criteria to be defined, the lack of identified diagnostic tests and the variability of care and treatments do not make it possible to constitute the basis for the creation of a long-term condition (ALD)”. Two years later, he would like to know if the research medical has progressed and the Government is now considering integrating fibromyalgia into the list of diseases recognized as ALD.

Mr. Anthony Brosse draws the attention of the Minister of Health, Families, Autonomy and People with Disabilities to the need to accelerate the process of universalizing the training of chiropodists and podiatrists and to support in particular the opening of a new training course within the University of Orléans. Re-engineered in 2012, pedicure-podiatrist training today needs to evolve to correspond to the realities of exercise and prepare future professionals for the growing needs of the health system and new prerogatives. This development would bring the profession closer to the university and would create a body of university teacher-researchers who would break the existing glass ceiling in terms of research in rehabilitation sciences. These transformations would ultimately involve moving from three-year training to five-year training and obtaining a master's degree for new graduates. To initiate this movement, the National Order of Chiropodists-Chiropodists worked with the University of Orléans on a 5-year training course which would make it possible to train 25 new professionals from the start of the 2026 school year, in a region which does not have a training school. Thus, he wishes to know if the Government plans to accelerate the universityization of the training of chiropodist-podiatrist and if an exemption could be issued concerning the opening of a first training course in five years within the University of Orléans.

Mr. Anthony Brosse draws the attention of the Minister of Labor, Health, Solidarity and Families to the difficulties encountered by the Mutualité sociale agricole (MSA) in ensuring compulsory medical examinations in occupational health by doctors. In the Loiret department, several agricultural companies face the impossibility of organizing resumption, pre-pre-resumption or periodic medical visits for their specialized employees, as required by the labor code. Certain requests addressed to the MSA remained unanswered for several months, despite reminders, due to an insufficient number of doctors. This shortage of occupational physicians in the MSA network is aggravated by the absence of candidates and the various budgetary constraints which lead to a worrying blockage: the legal obligations of employers cannot be fulfilled; the protection of employee health is compromised. Therefore, he would like to know if the Government plans to implement, in the coming weeks, measures to enable the MSA to sustainably recruit occupational physicians in rural areas, by authorizing, for example, salary exemptions, targeted incentives, or innovative organizational measures.

Mr. Anthony Brosse questions the Minister Delegate to the Minister of the Armed Forces, responsible for memory and veterans, on the reparations granted to families of harkis beyond 1975. Law No. 2022-229 of February 23, 2022, based on a decision of the Council of Ministers of August 6, 1975, sets December 31, 1975 as the deadline for the reparations system for harkis having stayed in one of the structures aimed at welcoming them in Hexagon. However, despite the decision of the Council of Ministers to close the forestry camps and hamlets, the departure of the Harkis from these structures extended over several years. Thus, he asks him if the date of December 31, 1975 is intended to evolve, with regard to the families who continued to stay in these camps after their official closure. Furthermore, the repair system provided for by this same law is not effective only from 2023, he asks if the Government plans to open the system to the beneficiaries of harkis who died between 1975 and 2022, for the sake of equality and memorial continuity. M. Anthony Brosse alerte Mme la ministre de l'agriculture et de la souveraineté alimentaire sur la réduction budgétaire intervenue sur le dispositif DiNA (dispositif national d'accompagnement des projets et des initiatives des coopératives d'utilisation de matériel agricole) qui soutient, au-delà du premier rôle de partage des machines, le développement de projets collectifs des Cuma au service de l'emploi rural, du renouvellement des générations en agriculture, de la réduction des produits phytosanitaires, de l'adaptation au changement climatique ou de la souveraineté alimentaire et énergétique. Ayant fait l'objet d'un rapport du CGAAER, d'une concertation entre le réseau Cuma et la DGPE en 2022-2023 et d'une nouvelle mouture en 2024, ce dispositif est articulé avec les enjeux des politiques publiques et permet de démultiplier, via les collectifs d'agriculteurs, leurs impacts. Cette aide à l'accompagnement stratégique est unique en son genre dans l'agriculture. Il est mobilisé par plus de 600 Cuma chaque année au niveau national, impliquant plus de 14 000 agricultrices et agriculteurs. La mise à mal du déploiement de ce dispositif, alors même qu'il a été récemment refondu avec l'administration de Mme la ministre, suscite l'inquiétude et l'incompréhension du réseau Cuma, au vue de l'efficience que produit le DiNA et dans le cadre d'une enveloppe qui reste modeste au regard d'autres dispositifs de soutien. Alors que l'accompagnement des agricultrices et agriculteurs est un sujet central, il souhaite savoir quelle ambition et pérennité elle souhaite donner à ce dispositif, seule ligne budgétaire dédiée aux Cuma.

L'utilisation de matériaux d'origine locale et biosourcée dans les bâtiments présente un intérêt environnemental. C'est notamment à ce titre que la réglementation environnementale (RE 2020), mise en place depuis 2022 pour la construction neuve, permet de valoriser l'utilisation de matériaux peu carbonés et, le cas échéant, stockant du carbone. De la même manière que pour les bâtiments neufs, il convient de définir les modalités permettant l'usage des matériaux bois et biosourcés dans le cadre de la rénovation des bâtiments existants. Pour ce qui concerne les bâtiments faisant l'objet d'une rénovation, la circulaire du 13 décembre 1982 formule un ensemble de recommandations pour la prise en compte de la sécurité lors des travaux de réhabilitation ou d'amélioration de l'habitat existant. Toute intervention sur l'habitat existant doit ainsi respecter le principe de non diminution du niveau de sécurité antérieur et il convient donc de s'assurer que les travaux ne dégraderont pas le niveau de sécurité. Pour autant, le respect de ce principe n'interdit pas systématiquement l'usage de bois et de matériaux biosourcés dans les rénovations, notamment pour la réalisation de travaux d'isolation thermique. S'agissant du risque induit par l'utilisation de matériaux combustibles dans les bâtiments, plusieurs travaux sont en cours, au niveau des ministères chargés de la construction et de la sécurité civile. Ces travaux visent à mieux prendre en compte les matériaux bois et biosourcés dans les programmes de rénovation tout en préservant un niveau de sécurité adapté à l'évaluation du risque au regard des connaissances scientifiques actuelles. Pour les immeubles de moyenne hauteur (bâtiment de 4ème famille, dont la hauteur du dernier plancher est située entre 28 et 50 mètres), un décret du 16 mai 2019 et un premier arrêté du 7 août 2019 fixent les exigences applicables lors de travaux de rénovation de façade dont la demande de permis de construire ou la déclaration préalable est déposée depuis le 1er janvier 2020. Un second arrêté du 7 août 2019, révisant l'arrêté du 31 janvier 1986 relating to protection contre l'incendie des bâtiments d'habitation, fait également évoluer les règles de sécurité incendie applicables pour les bâtiments d'habitation, dès lors que ces travaux font l'objet d'une demande de permis de construire depuis le 1er janvier 2020. Un travail est engagé pour préparer une prochaine révision des règles de sécurité incendie pour les établissements recevant du public, les bâtiments d'habitation et les bâtiments à usage professionnel, dans l'objectif de sécuriser l'usage du bois et des matériaux biosourcés dans la construction et la rénovation, tout en maintenant un haut niveau de sécurité incendie dans les bâtiments. Ces travaux portent sur les textes règlementaires applicables pour les bâtiments neufs, mais ont également pour objectif de préciser dans quelle mesure la mise en œuvre de certaines solutions techniques lors de la rénovation d'un bâtiment peut être présumée ne pas aggraver sa vulnérabilité vis-à-vis des risques d'incendie.
