Ms. Nathalie Colin-Oesterlé draws the attention of the Minister of Labor and Solidarity to the consequences of Decree No. 2026-261 of April 8, 2026, raising from 70 to 80 years the age threshold giving right to exemption from employer contributions for the employment of an employee at home. While the desire to refocus this system on the most dependent populations can be understood, this measure nevertheless raises serious concerns about its concrete impact. on seniors aged 70 to 79. Ms. Nathalie Colin-Oesterlé draws the attention of the Minister of Health, Families, Autonomy and People with Disabilities to the treatment of migraine in France and the persistent inequalities in access to innovative treatments. A chronic neurological pathology that is still too often trivialized because it is largely invisible, migraine nevertheless constitutes a major public health issue. In France, it concerns around 12% of the population adult, or several million people, with a significantly higher prevalence among women. It is now identified as the leading cause of disability among women under 50. The repercussions of this disease go far beyond just physical pain. Seizures can prevent daily, social or professional activity. Patients frequently report a profound alteration of their quality of life. Psychological comorbidities are also common, including anxiety, depression or sleep disorders. In this context, the arrival of new targeted therapeutic classes, notably anti-CGRP antibodies, constitutes a major advance for patients who have failed traditional disease-modifying treatments. These medications have demonstrated their effectiveness and tolerance in the prevention of severe migraines and are recommended by learned societies in patients with forms resistant to existing treatments. However, France today appears to be an exception in Europe: while these treatments are reimbursed or accessible in many neighboring countries, their cost remains largely the responsibility of patients when they are prescribed in the city. This situation creates significant inequalities of access, particularly in depending on the level of income or place of residence, with certain large metropolises concentrating the majority of issues. More broadly, late access to diagnosis also constitutes a major problem: the average time before diagnosis exceeds seven years and a third of patients have never consulted a health professional for their migraine. Le government bill relating to l'extension des prérogatives, des moyens, de l'organisation et du contrôle des polices municipales et des gardes champêtres actuellement soumis au Parlement est le fruit d'une large concertation entreprise dans le cadre des réunions du « Beauvau des polices municipales », qui se sont déroulées d'avril 2024 à mai 2025. A cette occasion, le Gouvernement a proposé de réformer les prérogatives de la police municipale, de renforcer ses moyens d'action ainsi que la formation professionnelle tout au long de la carrière. Ce government bill, adopté par le Sénat le 28 janvier 2026, ne comporte pas, en revanche, de mesure sur les droits à pension des policiers municipaux. En effet, une telle disposition aurait été considérée comme un cavalier législatif. Il convient toutefois de rappeler que les agents de police municipale sont d'ores et déjà classés, par l'arrêté interministériel du 12 novembre 1969, dans la catégorie active en raison des missions spécifiques qu'ils exercent. Ils bénéficient ainsi d'un âge d'ouverture des droits à la retraite anticipé, fixé à cinquante-neuf ans pour les agents nés à partir de 1974. La modification de ces règles n'a pas été envisagée lors de la réforme des retraites intervenue en 2023, et toute évolution devrait être abordée dans le cadre d'une réflexion globale sur la pénibilité. Il convient néanmoins de souligner qu'une importante réforme statutaire et indemnitaire des fonctionnaires de police municipale est intervenue récemment. En premier lieu, au plan statutaire, depuis le 1er décembre 2023, l'accès à l'échelon spécial pour les agents de police municipale de catégorie C est facilité, cet échelon étant devenu un échelon de droit commun. De même, la carrière des directeurs de police municipale, cadre d'emplois de catégorie A, a été alignée sur celle, plus avantageuse, des agents relevant de la catégorie dite « A type ». La condition d'effectifs à encadrer pour créer des postes de directeur de catégorie A a également été assouplie. La revalorisation indiciaire résultant de cette réforme a un impact sur le montant de la pension des agents concernés. En second lieu, le Gouvernement a procédé à une revalorisation substantielle du régime indemnitaire des policiers municipaux par le décret n° 2024-614 du 26 juin 2024, avec la création, sur décision de l'organe délibérant de la collectivité, de l'« indemnité spéciale de fonction et d'engagement » (ISFE). Cette indemnité, à l'instar de the whole of régime indemnitaire des fonctionnaires territoriaux, est prise en compte dans le calcul des retraites par le régime de retraite additionnelle de la fonction publique (RAFP), dans la limite de 20 % du traitement indiciaire brut (article 2 du décret n° 2004-569 du 18 juin 2004 relating to retraite additionnelle de la fonction publique). Mme Nathalie Colin-Oesterlé attire l'attention de M. le ministre d'État, ministre de l'intérieur, sur la pénurie d'inspecteurs du permis de conduire et ses conséquences sur l'accès à l'examen. Il est impératif d'améliorer l'accès à l'examen du permis de conduire en réduisant significativement les délais d'attente pour les candidats. La demande de passage du permis de conduire en France est en forte hausse, avec 1 370 994 nouveaux candidats en 2023, notamment en raison de la réforme abaissant l'âge du permis. En 2024, 1,567 million de places d'examen ont été proposées alors qu'il en faudrait au moins 2,19 millions en 2025. On ne compte aujourd'hui qu'environ 1 200 inspecteurs en exercice. Cette situation entraîne des délais d'attente importants pour passer l'examen, qui pénalisent fortement les jeunes, tant sur le plan personnel que professionnel. L'allongement des délais a également un impact financier : les candidats contraints d'attendre plusieurs mois doivent souvent reprendre des leçons de conduite pour ne pas perdre en niveau, ce qui accroît le coût global de leur formation. La situation est encore plus critique pour les candidats ayant échoué à l'examen. En Moselle, par exemple, les délais pour obtenir une nouvelle date d'examen peuvent dépasser six mois. Or plusieurs départs à la retraite d'inspecteurs sont déjà annoncés dans ce département, ce qui ne fera qu'aggraver la situation. Face à ces contraintes, certains individus pourraient être tentés de conduire sans permis. Le nombre de conducteurs non titulaires du permis est estimé à plus de 800 000 aujourd'hui, soit une augmentation de 60 % par rapport à 2014. Il est donc urgent d'augmenter le nombre d'inspecteurs du permis de conduire. Les capacités de formation de l'Institut national de sécurité routière et de recherches (INSERR) doivent également être renforcées : seulement 30 inspecteurs sont formés chaque année à ce jour, ce qui ne permet pas de répondre aux besoins. Par ailleurs, il est essentiel de mieux préparer les candidats pour réduire le taux d'échec. Le volume minimal obligatoire de 20 heures de formation est insuffisant, alors que la durée moyenne effective d'apprentissage est de 35 heures, soit la moyenne européenne. La conduite anticipée, qui inclut au moins 28 heures de formation (24 heures de conduite et 4 heures de théorie), affiche un taux de réussite de 74,7 %, contre seulement 55,9 % pour la formation classique. Cette modalité, ainsi que la conduite accompagnée, doivent être encouragées. Mobilians Éducation et Sécurité Routière estime ainsi qu'une augmentation de 10 % du taux de réussite moyen de l'examen de la catégorie B du permis de conduire équivaudrait à l'ajout de plus de 100 inspecteurs du permis de conduire sans coût additionnel pour l'État. Aussi, elle lui demande quelles mesures sont envisagées pour remédier à cette situation et ainsi garantir l'efficacité du système de formation et d'examen du permis de conduire.

Supplementary health insurance is the second largest financier of the health system after compulsory health insurance: it has paid 29.7 billion euros in services in 2022, which represents 12.6% of the consumption of medical care and goods. However, the operation of these insurances has become complex. To take out a contract, policyholders must have sufficient information on the prices and guarantees offered in order to compete. However, the structuring of reimbursements (particularly in audiology, dental and optics) has much complicated in recent years, making it more difficult to understand reimbursement levels and options. These activities, although legal, often generate nuisances (noise, incessant comings and goings, feeling of insecurity) incompatible with the family life and residential tranquility, particularly for children, which raises questions regarding security and public tranquility. The recent law promulgated on November 19, 2024 offers new tools to control the development of these rentals, by lowering on the one hand the threshold necessary for a simple majority to modify the co-ownership regulations and adopt the ban on rentals in furnished tourist accommodation and by requiring on the other hand that any new co-ownership regulation decides on the possibility of renting or not furnished tourist accommodation. Despite this progress, co-owners will be faced with a difficult choice: either to authorize the rental of furnished tourist accommodation, at the risk of seeing activities such as loverooms set up in their co-ownerships; or that of completely banning furnished tourist accommodation to avoid the establishment of loverooms and thus deprive co-owners of a controlled economic opportunity. In this context, the MP would like to know if it is possible for the Government to allow co-owners to authorize the rental of classic furnished tourist accommodation by specifically excluding loverooms in the co-ownership regulations, without such a clause being considered null and void. Such a measure would offer a balanced alternative between preserving the quality of life of residents and the possibility of economic activity in conditions respectful of the family environment.

Ms. Nathalie Colin-Oesterlé draws the attention of the Minister to the Minister of Labor, Health, Solidarity and Families, responsible for health and access to care, on the conditions of access to daily allowances for people suffering from cystic fibrosis, recognized as a long-term condition (ALD) by Decree No. 2011-77 of January 19, 2011. In application of article L. 313-1 of the social security code, Patients must have worked at least 600 hours during the 12 calendar months or 365 days preceding work stoppage or have contributed on the basis of remuneration fixed with reference to the amount of the hourly minimum wage over this same period to qualify for daily allowances. However, these conditions appear profoundly unsuitable for the realities experienced by people with cystic fibrosis. This chronic pathology requires heavy daily care, frequent hospitalizations and disabling treatments. These medical constraints make it difficult, if not impossible, to maintain continuous professional activity over a long period. Due to the unpredictable course of the disease and the extreme fatigue it generates, these patients may experience discontinuous career paths, marked by frequent interruptions of activity. Many can neither reach the threshold of 600 hours of work required nor demonstrate sufficient contributions over the 12 months preceding the date of interruption, despite significant efforts to remain in employment. This situation creates a major social injustice, going against the principle of social protection and the values of national solidarity. Patients suffering from cystic fibrosis are thus doubly penalized : on the one hand, by their state of health and, on the other hand, by legislation unsuitable for the chronicity and seriousness of their illness. She therefore asks what measures the Government plans to take to adapt the conditions of access to daily allowances to the specificities of cystic fibrosis, in particular by removing or relaxing the condition of one continuous year of prior contribution, in order to guarantee protection. fairer and more adapted social system for these patients.

Mrs. Nathalie Colin-Oesterlé draws the attention of the Minister of the Economy, Finance and Industrial and Digital Sovereignty to the situation of people in a situation of dependency living in EPHAD, lessors of rental properties subject to income tax. Today, elderly people housed in EHPADs can benefit from a tax reduction of 25% on accommodation expenses up to 10,000 euros per year, i.e. a maximum reduction of 2,500 euros per person accommodated, in accordance with article 199 quindecies of the general tax code. However, in reality, many people in a dependent situation rent out their property to finance these often very high costs. They nevertheless remain taxed on all rental income received, which considerably increases their tax burden. This situation worsens tax injustice for people who are already vulnerable. In a context marked by persistent financial difficulties in EHPADs and the entry into force of Law No. 2024-317 of April 8, 2024 laying down measures to build a society of healthy aging and autonomy, it seems essential to review the taxation applicable to people in a situation of dependency. Like the income paid to a relative in need which is deducted from income tax, a similar approach could be considered for the rental income of elderly people living in EPHADs.
