Mr. Raphaël Arnault alerts the Minister of the Interior regarding the wave of violent attacks by the small far-right group “La Cockarde Student” which have been perpetrated in recent days. On the occasion of the CROUS elections in the faculties which take place from February 3 to 5, 2026, several students and unionists were targeted by activists from “La Cocarde Studente”. Several faculties were the scene of these attacks, notably in Aix-en-Provence where a student who refused to take a leaflet from the far-right union was subjected to a violent attack by five members of “La Cocarde Student” who insulted him, threatened him and dealt him several blows. In Nanterre, a group of 25 people made up of members of the “Student Cockade” but also older people, outside the faculty and who accompanied them, carried out an attack of rare violence on campus against several students. Hooded and armed with brass knuckles and bats, they notably hit a student in the head, which caused head trauma and impaired vision and hearing. Another student was injured in the hands, causing him to lose a lot of blood. Other attacks also took place on the Grenoble and Lyon campuses. These attacks continue several goals. They aim first to establish a climate of terror within universities, to prevent the action of student organizations committed to greater social justice and equality. They also seek to discourage the electoral participation of students, in the hope of influencing the distribution of seats within representative bodies. These acts are part of an attempt to promote a ideological project based on discriminatory and racist measures, such as the so-called “national priority”. The “La Cocarde Student” group is also part of a dynamic of radical one-upmanship in the face of other far-right organizations, notably the “UNI” union, whose national leader was recently filmed making Nazi salutes. Faced with the intensification of violence attributed to “La Cocarde student”, a rapid reaction from the ministry is required. The MP therefore questions the Minister on the actions he plans to implement in order to avoid new attacks and aggressions and to guarantee the safety of students on campuses in the face of threats from small far-right groups. He would also like to know if there are plans to initiate, by decree taken in the Council of Ministers, a dissolution procedure administrative of “La Cockade Student” on the basis of article L. 212-1 of the internal security code.

Mr. Raphaël Arnault draws the attention of the Minister of Health, Families, Autonomy and People with Disabilities to the alarming situation in the Avignon hospital center and particularly in the operating theater. In fact, the operating room of the Avignon hospital center has been going through a major crisis since the end of 2022. In November 2024, this situation worsened, leading to the “right of withdrawal” of agents for “serious danger and imminent”. The latter regularly describe to the MP a particularly violent and dangerous working atmosphere, which would push many agents to burn-out. An independent expert report assessing working conditions and psychosocial risks in this service points to: institutional violence; a structural impossibility of respecting the elementary and fundamental rights of agents; a chronic and structural disorganization of the operating room with off-ground management; overexposure of agents to psychosocial risks; situations of severe professional burnout with a continuum of psychological suffering; shortcomings in the assessment and prevention of professional risks This extremely violent establishment governance which is assumed, carried out and imposed raises questions. How is it possible to allow such actions to take place within the hospital public service in an establishment supporting the Vaucluse territorial hospital group? Despite numerous alerts addressed to the management of the establishment and the competent authorities, the situation has not improved and no action has been taken. This situation is the vector of suffering among agents and could continue to give rise to situations dramatic. Faced with this lack of sufficient responses provided locally, he asks what measures the Government intends to take to guarantee the protection of the health of agents, the safety of patients and the continuity of the public hospital service within the Avignon hospital center and more broadly to prevent and treat such situations of serious danger in public health establishments.

Mr. Raphaël Arnault alerts the Minister of Health, Families, Autonomy and Persons with Disabilities to the announcement of the closure of the operating surgery department of the Apt country hospital center. The regional health agency and the Apt country hospital center have announced the complete closure of the operating surgery department by December 31, 2025. Within a few weeks, it will therefore be a living area of more than 30,000 residents who will find themselves without an operating surgery service. This decision was taken without any consultation: neither with unions, nor with local elected officials and even less with users. The reasons given are usual: lack of profitability and deficit, in line with health marketization policies. However, the surgery department would have recorded an annual increase in revenue of 400,000 euros. He is also question of the audit carried out in January 2025, which local elected officials were unable to consult. The opacity of this procedure leaves doubt as to the real reason for the closure of this service. The department of Vaucluse is already a disaster-stricken department in the field of health: the Avignon operating theater is overloaded and has experienced several recent crises, 4 CMPEAs have closed throughout the department, 42 psychiatric beds closed to Carpentras and the list goes on. As always, access to care is sacrificed in the smallest local units, which overloads the services of the largest hospitals by forcing patients to travel hours to be treated. Le Gouvernement est sensible à the whole ofs problèmes que pose la conciliation entre la vie professionnelle et la vie familiale et en particulier aux difficultés que rencontrent les parents salariés en cas de maladie de leurs enfants. Des avancées majeures ont été réalisées ces dernières années pour mieux les accompagner et renforcer leurs droits. La durée du congé de présence parentale, qui permet au salarié de s'occuper d'un enfant de moins de vingt ans à charge, dont l'état de santé nécessite une présence soutenue et des soins contraignants, a été allongée. Ainsi, le salarié ayant atteint le nombre maximal de 310 jours de congé avant l'expiration de la période de trois ans a droit à un renouvellement de son congé au titre de la même maladie, du même handicap ou du même accident dont l'enfant a été victime avant le terme de la période de trois ans. Concrètement, les salariés concernés bénéficient d'un crédit de 620 jours de congé mobilisables pendant trois ans. La loi n° 2023-622 du 19 juillet 2023 aimed at renforcer la protection des familles d'enfants atteints d'une maladie ou d'un handicap ou victimes d'un accident d'une particulière gravité a instauré des mesures supplémentaires. Sur le modèle du congé de maternité, elle instaure une protection contre la rupture du contrat de travail. L'employeur ne peut pas rompre le contrat de travail des salariés pendant le congé de présence parentale ainsi que pendant les périodes travaillées en cas de congé pris de manière fractionnée ou à temps partiel, sauf à pouvoir justifier d'une faute grave ou lourde du salarié ou de son impossibilité de maintenir ce contrat pour un motif étranger à l'état de santé de l'enfant du salarié. La sanction de la méconnaissance de la protection du parent est la nullité. Le salarié pourra prétendre soit à la réintégration assortie d'une indemnité compensatrice des salaires perdus, soit à des dommages-intérêts d'au moins 6 mois de salaire. Ensuite, pour mieux tenir compte des drames familiaux, la loi du 19 juillet 2023 a prolongé le congé prévu en cas de décès d'un enfant, à savoir quatorze jours s'il a moins de 25 ans et douze jours s'il est plus âgé. Le congé pour annonce de la survenue d'un cancer, d'un handicap ou d'une pathologie chronique de l'enfant est passé de deux à cinq jours. Enfin, le recours au télétravail a été facilité pour les parents aidants et les démarches des parents bénéficiant de l'allocation journalière de présence parentale ont été simplifiées. Toutefois, la durée du congé de présence parentale est prise en compte en totalité pour la détermination des droits que le salarié tient de son ancienneté dans l'entreprise ainsi que pour le calcul des droits inscrits sur son compte personnel de formation. Le salarié conserve, par ailleurs, le bénéfice de tous les avantages qu'il avait acquis avant le début du congé. Enfin, les partenaires sociaux améliorent, par le dialogue social, ces mesures législatives, que ce soit par l'octroi de jours de congés supplémentaires rémunérés, l'aménagement des conditions de télétravail, des horaires, la possibilité de débloquer le compte épargne-temps ou un dispositif de don de jours. Ces mesures conventionnelles sont à privilégier à une modification de la législation qui mettrait à la charge de l'employeur un coût financier supplémentaire, notamment pour les petites entreprises, et qui viendrait s'ajouter au remplacement des salariés absents.

Mr. Raphaël Arnault questions the Minister of State, Minister of National Education, Higher Education and Research, about the pressure from far-right networks against the new Education for Emotional, Relational and Sexual Life (ÉVARS) program. Since the publication of the new program, various far-right networks have organized to prevent its implementation. Among them, several collectives and parent associations, which are known for their entry into the school to propagate reactionary ideas and against the values of the Republic. This is particularly the case of a collective, created by a party, whose values, faithful to far-right ideology, are in total contradiction with those of the republican school. This network promotes racist, Islamophobic and LGBTphobic ideas, disseminates false information on the content taught and relays speeches affirming that the school would be corrupted by “wokism” and “Islamization”. These networks launch smear campaigns and misinformation aimed at parents, organize rallies in front of schools and threaten teachers. The new ÉVAR program in schools, as well as that of ÉVARS in middle and high schools, has been strongly criticized by these networks which, since 2024, have led a real offensive to prevent its implementation at the start of the school year in September 2025. Through their far-right media and political relays, as well as through their activism, they have disseminated numerous false information about the program. Among their unfounded accusations, they notably claimed that the latter taught sexual practices to primary school students or that he encouraged gender transitions. These attacks weaken the State's capacity to combat physical and sexual violence against children, as well as to effectively lead the fight for equality between girls and boys, which must start from an early age. However, these networks are very established, including in institutions, since these networks were able to organize a conference within the Senate itself. Several of these Organizations even appealed to the Council of State to obtain the cancellation of the program. Although the Council of State has validated the program's compliance with the law, far-right networks continue their pressure and disinformation campaigns against it. Considering the methods used to impose a climate of terror in schools on this subject, he asks what measures are taken to guarantee freedom teaching and to protect the teaching teams providing ÉVARS.

Mr. Raphaël Arnault draws the attention of the Minister to the Minister of Labor, Health, Solidarity and Families, responsible for health and access to care, to the abusive use of article R. 4127-28 of the public health code. Doctors, in particular psychiatrists, are today exposed to disciplinary procedures initiated on the basis of article R. 4127-28 of the public health code, which prohibits the issuance of tendentious reports or certificates of convenience. This text is regularly invoked by certain employers to denounce medical certificates issued in the context of work stoppage or an occupational accident. However, article R. 441-10 of the social security code, modified by decree no. 2019-854 of August 20, 2019, requires practitioners to mention “all findings which could present a importance for determining the traumatic or morbid origin of the lesions”. Consistent case law recognizes that these certificates must be detailed, particularly when the pathology is linked to factors of a professional nature, such as work overload, violence, or toxic exposure. The misuse of article R. 4127-28 of the public health code harms the quality of care, the recognition of occupational diseases and weakens the clinical independence of practitioners. It favors strategies of judicial or ordinal harassment on the part of malicious employers, contrary to the fundamental principles set out in article L. 1110-1 of the public health code. He would like to know the provisions that the ministry plans to take as regulations necessary to develop article R. 4127-28 of the Public Health Code, in order to protect doctors against unjustified prosecution when they act strictly within the framework of their legal obligations.

Mr. Raphaël Arnault draws the attention of the Minister of State, Minister of the Interior, to the fact that “the identity check takes place without harming the dignity of the person who is subject to it” according to the internal security code. However, a survey on access to rights by the Defender of Rights published on June 24, 2025, on police/population relations, reveals that certain populations experience more police checks than others. Indeed, the Defender of Rights notes that “despite these very significant increases in checks, categories of the population report less frequent checks than certain social groups: male, young and populations perceived as black, Arab or North African remain over-represented among those frequently checked”. The investigation shows that these young men have four times more likely to have been stopped at least once by the police than the rest of the population. This risk is increased to 12 times more for in-depth checks (search, pat-down, driving to the station, order to leave the premises). This type of control is also rarely justified by the police given that “among people who have experienced an extensive control, only 42% say they have benefited from justification; this proportion is 51% among people who have experienced a simple identity check.” These facts are not new. In 2009, surveys carried out by the CNRS and Open Society Justice around several Parisian stations established that individuals perceived as “black” were already subject to six times more police checks than individuals perceived as “white”. For individuals perceived as “Arab”, this frequency is multiplied by eight compared to individuals perceived as “white”. These identity checks are discriminatory and abusive towards populations perceived as non-white. They undermine the dignity of people when these controls are targeted more towards black, Arab or North African people. In a judgment delivered on November 9, 2016, the Court of Cassation qualified the discriminatory controls as gross negligence attributable to the State. This decision established the principle according to which the probationary regime applicable to non-discrimination also extends to the activities of law enforcement. However, in the absence of a report, receipt or any other equivalent support, it becomes impossible to establish proof of a possible breach. The Defender of Rights had, however, as early as 2016, highlighted the existence of an obligation positive responsibility for the authorities to implement procedures and practices to prevent any form of discrimination. La loi du 14 mars 2016 relating to la protection de l'enfant, renforcée par les dispositions de la loi du 7 février 2022 relating to la child protection, consacre une protection spécifique permettant à toute personne se déclarant Mineur non accompagné (MNA) d'être mise à l'abri dans le cadre d'un accueil provisoire d'urgence jusqu'à ce que sa situation soit évaluée. En application de article L. 221-2-4 du code de l'action sociale et des familles, issu de la loi du 7 février 2022 précitée, l'évaluation de la minorité et de l'isolement ainsi que la mise à l'abri relèvent de la responsabilité du conseil départemental au regard de ses compétences en matière de protection de l'enfance. Afin d'identifier les personnes se disant MNA, et sous la responsabilité du conseil départemental, une évaluation pluridisciplinaire est menée par des professionnels formés à l'évaluation sociale et ayant une expérience ou une qualification dans les métiers de la protection de l'enfance, du droit, de la psychologie, de la santé ou de l'éducation. Celle-ci inclut les éléments éventuellement transmis par la préfecture. La personne se déclarant MNA peut, à tout moment, saisir le juge des enfants en application de l‘article 375 du code civil afin que sa minorité et son isolement soient reconnus. Toutefois, la saisine du juge des enfants à la suite d'une décision de refus d'admission à l'aide sociale à l'enfance du président du conseil départemental n'est pas suspensive de la décision mettant fin immédiatement à sa prise en charge. La possibilité pour le juge des enfants d'ordonner des mesures provisoires dans l'attente de sa décision en matière d'assistance éducative, sur le fondement de article 375-5 du code civil, reste à sa libre appréciation. Il est également à noter que le Conseil d'Etat dans la décision n° 471867 du 14 mars 2023 estime qu'il est également possible pour la personne de saisir le juge du référé liberté sur le fondement de article L. 521-2 du code de justice administrative. A ce titre, le juge des référés peut enjoindre la poursuite de l'accueil provisoire s'il estime que l'appréciation du président du conseil départemental est manifestement erronée et qu'il existe un risque immédiat de mise en danger de la santé ou de la sécurité de la personne concernée. Dès lors, les personnes se déclarant MNA disposent de plusieurs garanties procédurales leur permettant de faire valoir leur droit si leur minorité est confirmée par les services spécialisés.

Mr. Raphaël Arnault questions the Minister to the Minister of Regional Planning and Decentralization, responsible for transport, on what the Government intends to implement to limit the impacts of domestic flights from small airports which do not host commercial flights nor are used for civil security. Avignon-Provence airport, which is in the 1st district of Vaucluse, is illustrated of unnecessary infrastructure, which impacts residents due to pollution, takes up a significant portion of public money from the region and land, all to benefit a handful of very wealthy people who travel by private jets. First of all, the airport is financed mainly by public subsidies and by land revenue from the SAAP (Avignon Provence Airport Company), including the CCI (chamber of commerce and industry) is the sole shareholder. This leads to a situation of chronic deficit, particularly in the context of exploitation. In addition, Avignon airport is intended for business aviation and short trips, while the city is well served by the TGV and two motorways: private aviation is therefore not essential for regional mobility. Avignon airport is not the only one in France to be ecological and social nonsense. Mr. Raphaël Arnault alerts the Minister of Health and Access to Care to the extremely worrying situation in operating theaters in France. The competition between public and private hospitals creates dramatic situations. The race to provide care, the multiplication of operations and fee-for-service pricing are putting hospitals and their staff in danger. A hospital is not a business like any other, it fulfills a essential public service mission: caring for the population. Caregivers are human beings, not machines. They must be treated with respect. In Avignon, 80 of the 120 operating theater staff exercised their right to withdraw in the face of working conditions that jeopardized their health and safety. The hospital hires temporary staff who do not have the required qualifications, whether for cleaning the blocks or even among the caregivers. Broken machines, including the hoof cleaner, which leaves staff exposed to bodily fluids (blood, urine). An overloaded department, in which patients are piled up. The danger is real and has been recognized by occupational medicine. And this situation is not isolated: in other hospitals such as those of Clermont-Ferrand or Nice, the conditions are similar.
