'Operation Swords of Iron' Iron Dome Supplemental Appropriations Act This bill provides $2 billion in appropriations for the Department of Defense to provide to the government of Israel for the procurement of the Iron Dome defense system to counter short-range rocket threats. The funds must be provided to address emergent requirements in support of Operation Swords of Iron.

Addressing Whole Health in Medicare Advantage Act This bill allows Medicare Advantage plans to offer certain supplemental benefits that are currently only available to chronically ill enrollees to enrollees with low-income or who meet other criteria, such as socioeconomic risk factors.

This joint resolution nullifies the policy update issued by the Food and Nutrition Service (FNS) on May 5, 2022, related to discrimination on the basis of gender identity and sexual orientation. The Government Accountability Office (GAO) deemed the policy update a rule on June 5, 2023, and therefore subject to the Congressional Review Act (CRA) requirement that a rule must be submitted to Congress and the GAO before it can take effect. The CRA also permits Congress to review and disapprove rules using specified procedures. In June 2020, the U.S. Supreme Court held in Bostock v. Clayton County that, under Title VII of the Civil Rights Act of 1964, the prohibition on sex discrimination in employment includes discrimination on the basis of sexual orientation and gender identity. The FNS determined that the Bostock analysis also applies to certain FNS-enforced requirements under the Food and Nutrition Act of 2008 and Title IX of the Education Amendments of 1972 because the requirements are sufficiently similar to those in the Civil Rights Act of 1964. The FNS rule concludes that the prohibitions against sex discrimination in the FNS-enforced statutes prohibit discrimination on the basis of gender identity and sexual orientation. The rule also directs state agencies and program operators to handle complaints alleging discrimination on the basis of gender identity and sexual orientation as complaints of prohibited sex discrimination.

Seniors’ Access to Critical Medications Act of 2023 This bill allows physicians to dispense outpatient prescription drugs and related supplies to patients outside of their office buildings without violating certain prohibitions under the Stark law (i.e., the Physician Self-Referral Law) for Medicare and Medicaid. Current law requires physicians to dispense outpatient prescription drugs and related supplies to patients in their office buildings in order to qualify for an exception (the in-office ancillary services exception) under the Stark law. The bill specifies that, beginning on May 11, 2023, physicians may dispense outpatient prescription drugs and related supplies in locations other than their office buildings. The bill also requires the Centers for Medicare & Medicaid Services to withdraw specified guidance that contradicts the bill’s changes.

Cutting Copays Act This bill eliminates cost-sharing for generic drugs for those with the lowest-income under the Medicare prescription drug benefit's Low-Income Subsidy Program beginning in 2024.

CBDC Anti-Surveillance State Act This bill prohibits a Federal Reserve bank from offering products or services directly to an individual, maintaining an account on behalf of an individual, or issuing a central bank digital currency (i.e., a digital dollar) directly or indirectly to an individual. Further, The Board of Governors of the Federal Reserve System and the Federal Open Market Committee are prohibited from using a central bank digital currency to implement monetary policy.

Safeguarding Endangered Children, Unaccompanied and at Risk of Exploitation Act of 2023 or SECURE Act of 2023 This bill requires regular reports to Congress detailing the status of unaccompanied non-U.S. national ( alien under federal law) children. The bill also rescinds certain funding for the agencies responsible for the report for each day that a report is late. Specifically, the Department of Health and Human Services (HHS), the Department of Homeland Security (DHS), and the Federal Bureau of Investigation must jointly report to Congress every 60 days on such children that have been in the custody of the Office of Refugee Resettlement (ORR) since January 1, 2021, and have been released to a parent, family member, or sponsor within the United States. This report must provide each child’s age, sex, location, and detail the child’s health and well-being. Additionally, the report must provide specified information about adults living in the child’s home, such as whether adults in the home have been subject to a fingerprint-based check of national crime information databases. The report must also specify the number of children that ORR has tried to contact without success on at least three separate attempts. The report must be provided for up to three years or until all of the specified children have been accounted for. The bill also rescinds certain funding from HHS, DHS, and the FBI for each day that a report is late. Up to $10 million may be rescinded from each agency for each fiscal year.

Crucial Communism Teaching Act This bill directs the Victims of Communism Memorial Foundation to develop a civic education curriculum and oral history resources for high school students to promote understanding of certain political ideologies (e.g., communism and totalitarianism) that conflict with principles of U.S. democracy.

This bill requires various changes to the passport application process and addresses related issues. The bill requires all U.S. regular passports to contain a written notice advising travelers (1) to check travel.state.gov for updated travel warnings, (2) to register with the Department of State prior to overseas travel, (3) that many countries deny entry to travelers whose passport expires within six months, and (4) to renew their passports within at least one year of the expiration date. Further, the bill makes permanent existing State Department authority to assess a surcharge on the passport application fee to cover the costs of increased demand prompted by certain legal requirements. This authority currently expires on September 30, 2026. For three years starting from this bill's enactment, the State Department may use direct hire authority to expedite the hiring of individuals into Passport and Visa Examining positions (Series 0967). Finally, the bill requires the Department of State to report to Congress about passport processing wait times, agency plans for a public outreach campaign, and related information.

Providing Essential Temporary Shelter Assistance For Emergencies Act of 2023 or the PETSAFE Act of 2023 This bill directs the Federal Emergency Management Agency (FEMA) to establish a pilot program to provide grants for mobile pet shelters during emergencies and major disasters. FEMA may provide funds to state, local, and tribal governments to establish a new pet shelter site that is a mobile unit, which may be a companion animal mobile equipment trailer, to be used in case of evacuation due to emergencies and major disasters. FEMA's authority to approve projects under this bill shall cease on January 1, 2029.

Preserving Access to Home Health Act of 2023 This bill repeals certain payment adjustments for home health services under Medicare that are based on behavioral changes. It also requires the Medicare Payment Advisory Commission to incorporate certain information into its evaluations of the financial performance and impact of home health agencies, including trends under Medicare Advantage, Medicaid, and other payers with respect to home health services.

Fishery Improvement to Streamline untimely regulatory Hurdles post Emergency Situation Act or the FISHES Act This bill establishes deadlines for the approval of National Oceanic and Atmospheric Administration (NOAA) requests for fishery resource disaster assistance funding. Specifically, the bill requires the Office of Management and Budget (OMB) to approve or deny a spend plan (a type of funding request submitted to NOAA by a state, an Indian tribe, or other eligible requester with an affirmative fishery resource disaster determination) within 30 days of its receipt from NOAA. For any denial, OMB must return the plan to NOAA within 15 days of the denial with a description of the changes necessary for the spend plan to be approved. The bill provides that NOAA, in consultation with the requester, must make the necessary changes and resubmit the spend plan to OMB for approval. OMB must approve or deny a resubmitted spend plan within 15 days of its receipt. The bill also requires OMB to provide certain information regarding approved spend plans (e.g., the dates of the approval and each denial or resubmission) on its website.

Stillbirth Health Improvement and Education for Autumn Act of 2023 or the SHINE for Autumn Act of 2023 This bill authorizes grants and establishes other programs to improve data collection on stillbirths. Specifically, the Department of Health and Human Services (HHS) may award grants for surveillance and data collection on stillbirths, and HHS must issue guidelines for health departments and vital statistics units concerning the collection of stillbirth data. HHS must also develop educational awareness materials about stillbirths and make them publicly available. Furthermore, HHS must implement a fellowship program to provide training in perinatal autopsy pathology and otherwise support research on stillbirths and fetal autopsies. The bill also requires HHS to issue a report with educational guidelines on stillbirths and stillbirth risk factors.

Treat and Reduce Obesity Act of 2023 This bill expands Medicare coverage of intensive behavioral therapy for obesity. Specifically, the bill allows coverage for therapy that is provided by (1) a physician who is not a primary care physician; or (2) other health care providers (e.g., physician assistants and nurse practitioners) and approved counseling programs, if provided upon a referral from, and in coordination with, a physician or primary care practitioner. Currently, such therapy is covered only if provided by a primary care practitioner. The bill also allows coverage under Medicare's prescription drug benefit of drugs used for the treatment of obesity or for weight loss management for individuals who are overweight.

Substance Wastewater Inspection For Trends in Detection Act of 2023 or the SWIFT Detection Act of 2023 This bill expands certain federal programs to specifically include wastewater surveillance to monitor the use of controlled substances. Specifically, the bill incorporates wastewater surveillance into (1) grants for states, tribes, and territories to prevent overdoses of controlled substances, and (2) a pilot program to support coordination between public health and law enforcement laboratories to improve the detection of fentanyl and other synthetic opioids.

Strengthening Efforts to End Violence Against Children Act of 2023 This bill modifies the framework for providing foreign aid to programs that support vulnerable children by expanding the goals of these programs and requiring additional reports. Specifically, aid may be provided to programs that (1) support family care for vulnerable children and extend protective services to children living outside of family care; (2) promote the protection of children from violence, exploitation, abuse, and neglect through preventative and responsive programming; and (3) provide lifesaving protection and interventions for vulnerable children in emergency settings. The bill also requires the President, among other reporting requirements, to develop and submit to Congress a strategy for coordinating, implementing, and monitoring assistance programs for children in adversity, submitting a review to Congress every 4 years afterwards.

Stop China’s Continuous Purchase of Land Act or the Stop CCP Land Act This bill requires states that receive certain federal program funds to restrict the purchase of agricultural land by a covered foreign country. Covered foreign country means a country included in Department of State regulations as subject to certain prohibitions (i.e., Belarus, Burma, China, Cuba, Iran, North Korea, Syria, and Venezuela), as well as Russia. Specifically, a state may not receive funds for certain programs funded by the Inflation Reduction Act of 2022 (e.g., certain energy efficiency and conservation programs) unless that state has a law prohibiting a covered foreign country (or persons acting on behalf of the country) from purchasing agricultural land in the state. Further, a state must require that a person from a covered foreign country that holds agricultural land in the state prior to the state law's enactment submit an annual report to the state on the agricultural holdings. The Department of Agriculture must submit a report to Congress on how the Agricultural Foreign Investment Disclosure Act of 1978 should be updated to ensure accurate documentation and monitoring of foreign investment in agricultural land. The Government Accountability Office must submit a report to Congress that includes (1) an assessment of this bill's impact on national security, and (2) any measures that can be taken to better secure U.S. real estate from foreign manipulation.

Concentrating on High-value Alzheimer's Needs to Get to an End Act of 2023 or the CHANGE Act of 2023 This bill specifies that Medicare annual wellness visits and initial preventive physical examinations must include the use of an approved tool from the National Institute of Aging to detect cognitive impairment, as well as associated documentation of the tool that was used and the results.

Accelerating Kids' Access to Care Act This bill requires state Medicaid programs to establish a process through which qualifying out-of-state providers may enroll as participating providers for five years without undergoing additional screening requirements, unless the state has an agreement with other states that governs coverage of children with medically complex conditions that is in accordance with specified guidance from the Centers for Medicare & Medicaid Services (CMS). Among other requirements, a qualifying provider must (1) serve individuals under the age of 21; (2) have previously been screened for Medicare participation or for participation in the Medicaid program of the state in which the provider is located; and (3) have been determined by the CMS or state Medicaid program to pose a limited risk of fraud, waste, or abuse.

Community News and Small Business Support Act This bill allows certain small businesses and employers of journalists tax credits for advertising in local media and for the wages of not more than 1,500 local news journalists in any calendar quarter. Specifically, the tax credit for advertising in local media allows small businesses with less than 50 full-time employees a limited credit for the expense of advertising in a local newspaper, or in any licensed broadcast radio or television station that serves a local community. The credit for the wages of a local news journalist is a payroll tax credit that takes into account wages not exceeding $12,500 in any calendar quarter.

Main Street Tax Certainty Act This bill makes permanent the tax deduction for qualified business income. (Under current law, the deduction expires after December 31, 2025.) Qualified business income is defined as the net amount of qualified items of income, gain, deduction and loss with respect to any trade or business, excluding capital gains or losses, dividends, interest income, or income earned outside the U.S.

Federal Mechanical Insulation Act The bill directs federal agencies to identify energy saving and water saving measures, such as the installation of mechanical insulation property, in certain annual energy and water evaluations of federal buildings. Thus, the bill allows the installation of mechanical insulation property (e.g., thermal insulation) to be considered an energy or water efficiency measure that may be used in federal buildings under the National Energy Conservation Policy Act.

This resolution urges combatants in the conflict in Sudan to agree to an immediate cease-fire. The resolution condemns the outbreak of armed conflict and departure from the transition to a democratic government. The resolution also calls on the President and federal agencies to urgently resource and scale up the delivery of humanitarian assistance to Sudan and the region.
