Dentist and Optometric Care Access Act of 2019 or the DOC Access Act of 2019 This bill prohibits private health insurance plans from setting rates for items and services provided by a doctor of optometry, of dental surgery, or of dental medicine for which the plan does not pay a substantial amount. Additionally, an agreement between a plan and such a doctor for limited scope dental or vision benefits may last longer than two years only with the prior acceptance of the doctor for each term extension. Plans also may not restrict such a doctor's choice of laboratories or suppliers. The bill establishes a private right of action for a person adversely affected by a violation of this bill. The bill does not supersede state laws regarding health insurers and dental or vision benefit plans.

This resolution states that immigrants and their descendants have made America stronger and naturalized citizens are just as American as those whose families have been in the United States for generations. It also expresses a commitment to keep America open to those who lawfully seek refuge from violence and oppression and those willing to work hard to achieve the American Dream, regardless of race, ethnicity, faith, or country of origin. The resolution strongly condemns as racist the President’s comments about immigrants and those who look to the President like immigrants and states that these have legitimized hatred of new Americans and people of color, including his reference to immigrants and asylum seekers as “invaders.”

Protecting Access to Student Transcripts Act of 2019 This bill prohibits institutions of higher education that participate in federal student-aid programs from denying students' access to their transcripts, degree scrolls, or other certifications because of loan default.

This resolution (1) recognizes the start of the inland waterway system navigation season, (2) acknowledges the work of the U.S. Army Corps of Engineers in maintaining the inland waterway system as vital to the nation's economy, (3) recognizes that more than 78% of the locks and dams operated by the Corps on the system are well beyond their 50-year design life, and (4) expresses that investment in the inland waterway system is needed and would significantly impact the competitiveness of American commodities in international markets.

Relief for Defrauded Students Act of 2019 This bill provides statutory authority for specific borrower defenses to repayment under the Federal Direct Loan program. Specifically, the bill allows a defense to repayment of a loan under the program if (1) the institution of higher education (IHE) made a substantial misrepresentation of the nature of its educational program, its financial charges, or the employability of its graduates; (2) the IHE made an act or omission in violation of state law; or (3) the IHE made any other act or omission as specified by the Department of Education (ED). Under current law, ED is required to specify in regulation which acts and omissions of an IHE may be asserted by a borrower as a defense to repayment under the program. The bill requires ED, upon determination that a borrower is entitled to student loan relief, to cancel any outstanding balance of principal and interest due on each loan and return to the borrower the amount of any payments made on each loan.

Fair and Open Skies Act This bill prohibits the Department of Transportation (DOT) from issuing a foreign air carrier permit or an exemption from certain air carrier certificate requirements under the United States-European Union Air Transport Agreement of April 2007, unless DOT finds that issuing the permit or exemption would be consistent with Article 17 bis of the agreement, which provides that opportunities created by the agreement do not undermine labor standards or the labor-related rights and principles contained in the laws of the respective parties to the agreement; and imposes conditions on the permit or exemption necessary to ensure compliance with Article 17 bis . The bill modifies policy considerations relating to air carrier certificates to require DOT to consider preventing entry into U.S. markets by flag of convenience carriers (i.e., foreign air carriers established in a country other the home country of their majority owner in order to avoid regulations of the home country) and preventing the undermining of labor standards. In carrying out such air carrier certificate requirements, DOT must consider preventing entry of flag of convenience carriers into U.S. markets as being in the public interest and consistent with public convenience and necessity for safety in air transportation and air commerce. In formulating U.S. international air transportation policy relating to the elimination of discrimination and unfair competition, the Department of State and DOT must include in their considerations the undermining of labor standards.

Chiropractic Medicare Coverage Modernization Act of 2019 This bill expands Medicare coverage of chiropractic services to include all services provided by chiropractors, rather than only subluxation corrections through manual manipulation of the spine.

Therapeutic Fraud Prevention Act of 2019 This bill prohibits commercial conversion therapy, which is a practice or treatment designed to change a person's sexual orientation or gender identity or otherwise change behaviors, thoughts, or expressions related to gender or sexual attraction. This prohibition does not apply to treatment that assists an individual undergoing a gender transition or facilitates identity exploration and development.

This resolution expresses support for (1) equal rights and protections for all people, regardless of actual or perceived sexual orientation or gender identity; and (2) the designation of LGBTQ Equality Day on June 26 to commemorate Supreme Court decisions handed down on that day in 2003, 2013, and 2015. The resolution also acknowledges the need for further legislation to ensure that people in the United States are free from all forms of discrimination on the basis of actual or perceived sexual orientation or gender identity.

LGBTQ Data Inclusion Act This bill requires federal agencies that collect information through a survey that includes demographic data (where subjects self-report information or a proxy provides information about the subject or responds for all persons in a household) to review existing data sets to determine in which data sets information about sexual orientation and gender identity is not included, and to assess needed changes in survey methods related to asking questions on sexual orientation and gender identity. Agencies that publish reports relying on survey demographic data must include information on sexual orientation and gender identity.

Made in America Act of 2019 This bill requires projects under various federal programs to use materials manufactured in the United States, with exceptions. The bill applies to materials such as steel, plastic, concrete, and glass and applies to programs for broadband infrastructure, water treatment, health centers, and housing, among others.

America's Call To Improve Opportunities Now for National Service Act or the ACTION for National Service Act This bill (1) converts the Corporation for National and Community Service into the National and Community Service Administration; (2) reauthorizes programs carried out by the administration; (3) establishes a National Service Foundation to accept and administer gifts on behalf of the administration; and (4) modifies the calculation of national service educational awards. Furthermore, the bill creates a 21st Century American Service Outreach Program to notify individuals age 17 and not more than age 30 about their eligibility to participate in national service programs,; increases living stipends for such volunteers and the cap on such full-time positions; provides a living allowance to members of the National Civilian Community Corps, under specified conditions; and provides an exclusion from gross income, for income tax purposes, for such educational awards and living allowances.

Public Service Freedom to Negotiate Act of 2019 This bill prohibits strikes by certain individuals and requires the issuance of rules that provide for federal minimum standard collective bargaining rights and procedures. The Federal Labor Relations Authority (FLRA) shall determine for each state whether the laws of such state substantially provide for each of the minimum standard collective bargaining rights and procedures specified by this bill, including the right of public employees and supervisory employees to self-organize, form or join a labor organization, or collectively bargain. The FLRA must issue rules and take actions to establish and administer bargaining rights and procedures for those states that do not substantially provide for them. No employers, emergency services employees, or law enforcement officers may engage in a lockout, strike, or any other organized job action that would probably result in a measurable disruption of the delivery of emergency or public safety services. Furthermore, no labor organization may be the cause of a violation of such prohibition.

This bill establishes the Alzheimer's Research and Caregiving Trust Fund. Taxpayers may contribute to the fund at the time of filing of their tax returns. Amounts in the fund shall be available for research regarding the treatment or cure of Alzheimer's disease and for education, counseling, respite and other supportive services for the benefit of individuals with Alzheimer's disease and of their families, caregivers, and health care professionals.

Stopping Bad Robocalls Act This bill updates various policies and regulations relating to robocalls. Specifically, the bill requires the Federal Communications Commission (FCC) to protect consumer privacy as it relates to robocalls. The FCC must update regulations involving certain robocalls that are exempt from criminal liability to include specific requirements identifying classes of parties who may make such calls, parties who may be called, and how many times they may be called. Additionally, the bill removes the requirement that a citation be issued prior to a forfeiture penalty being imposed in cases where violations involving illegal robocalls have been intentional and where inaccurate caller identification information has been provided. The bill also implements a three-year statute of limitation for such violations requiring notice, and a four-year statute of limitation where an intentional violation has occurred. The FCC must promulgate regulations to address requirements for effective call authentication technology as well as to establish a process to streamline the ways in which a private entity may voluntarily share with FCC information relating to an illegal call or text or for calls with misleading or inaccurate caller identification information. Finally, the bill requires the FCC to ensure robocall blocking services provided on an opt-out basis are provided free of cost with transparency and redress options for consumers and callers.

Keep Physicians Serving Patients Act of 2019 This bill requires the Centers for Medicare & Medicaid Services to use specified data regarding physician wages and office rent when determining certain geographic adjustment factors for the payment of physician services under Medicare. With respect to such payment, the bill also makes permanent certain minimum adjustments to the work geographic index and extends to all localities certain minimum adjustments to the practice expense index.

Access to Genetic Counselor Services Act of 2019 This bill provides for coverage under Medicare of genetic counseling services that are furnished by genetic counselors. Covered services include those services, as well as incidental services and supplies, that would otherwise be covered under Medicare if provided by a physician.

United States Call Center Worker and Consumer Protection Act of 2019 This bill establishes restrictions on businesses that relocate call centers or redirect customer service calls to locations outside the United States. Specifically, a business must notify the Department of Labor that it intends to move its customer service call center overseas and Labor must maintain a publicly available list of such businesses. Subject to narrow exceptions, a business appearing on such list is ineligible to receive federal grants or guaranteed loans for five years after the business is added to the list. Further, agencies must condition the awarding of government contracts on the requirement that any call center activity pursuant to the contract must be performed in the United States. Additionally, the bill requires call center employees to disclose their physical location at the beginning of each call initiated or received, unless all employees of the business participating in the communication are located in the United States, among other exceptions.

Feed Emergency Enhancement During Disasters Act or the FEEDD Act This bill modifies the federal crop insurance program to authorize agricultural producers who harvest second crops as a result of a prevented planting to be eligible for specific crop insurance if certain conditions are met. Specifically, a producer may collect an indemnity that is equal to 100% of the prevented planting guarantee for the acreage of the first crop if (1) the acres planted are in an area with low hay or forage supplies due to widespread excessive moisture, flood, or drought; (2) the second crop will be planted with an intended use of animal feed that is hayed, gazed, or chopped; and (3) the second crop will be donated or used by the producer.

Military Readiness and Cost Savings Act This bill directs the Department of Defense to seek to enter into a contract with an institution—to be designated as the National Center for Military Painting and Applied Research—to serve as a resource for testing paint coatings for military assets and developing training tools and programs concerning military painting and coating. The bill includes authority to enter into an agreement to provide these services to the Coast Guard.

Broadband Data Improvement Act of 2019 This bill requires (1) broadband service providers to fulfill certain reporting requirements, and (2) the Federal Communications Commission (FCC) to establish a challenge process to aid in broadband mapping. Specifically, the bill requires each provider to report certain information regarding the geographic availability of broadband service it provides. The FCC must contract with an entity to provide data submission assistance to a provider that is unable to comply with this reporting requirement. Among other responsibilities, such entity shall provide support for the required challenge process and establish an ongoing data validation and verification process. The FCC is also required to establish a framework for a process whereby information challenging the accuracy of the National Broadband Map may be submitted. Subject to the challenge process and feedback received therefrom, specified federal agencies shall use the National Broadband Map to determine the extent of broadband availability and the areas of the United States that remain unserved.

75th Anniversary of the End of World War II Commemorative Coin Act This bill directs the Department of the Treasury to mint and issue up to 50,000 $5 coins, 500,000 $1 coins, and 750,000 half-dollar coins in commemoration of the 75th anniversary of the end of World War II. The coins shall be emblematic of the sacrifices made by millions of people of the United States 75 years ago in bringing an end to World War II. The design on each coin shall represent the World War II Victory Medal, which was awarded to all 16 million U.S. military personnel who served from December 7, 1941, to December 31, 1946. The bill requires all sales of such coins include specified surcharges, which shall be paid by Treasury to the congressionally designated National WWII Museum to fund its educational mission of telling the story of the U.S. experience in World War II.

Every Child Deserves a Family Act This bill prohibits discrimination on the basis of sexual orientation, gender identity, marital status, or religion in the provision of child welfare programs and services by entities receiving federal funding. The Department of Health and Human Services (HHS) must provide technical assistance to help states follow this requirement, including (1) guidance for bringing state laws into compliance, (2) developing training to increase cultural competency related to social identity, and (3) training for judges and attorneys involved in child welfare cases, among other supports. Additionally, HHS must establish the National Resource Center on Safety, Well-Being, Placement Stability, and Permanency for LGBTQ Children and Youth Involved with Child Welfare Services to provide training, technical assistance, and guidance to applicable state and local agencies and service providers. Further, the Religious Freedom Restoration Act may not be the basis for challenging the application or enforcement of this bill. The Government Accountability Office must study and report on states' compliance with the requirements of the bill no later than three years after enactment.

This bill directs the U.S. Postal Service (USPS) to continue to sell the Alzheimer's disease semipostal stamp for an additional six years. The USPS must continue to transfer proceeds from the sale of the stamp to the National Institutes of Health to fund medical research relating to Alzheimer's disease.

Improving Seniors' Timely Access to Care Act of 2019 This bill establishes several prohibitions, requirements, and standards relating to prior authorization processes under Medicare Advantage (MA) plans. Specifically, the bill prohibits MA plans from instituting additional prior authorization requirements for surgeries (including related items) that are furnished to a patient during other surgeries for which prior authorization was not required or was already received. Additionally, MA plans must (1) establish an electronic prior authorization program that meets specified standards, including the ability to provide real-time decisions in response to requests for items and services that are routinely approved; (2) annually publish specified prior authorization information, including the percentage of requests approved and the average response time; and (3) meet other standards, as set by the Centers for Medicare & Medicaid Services, relating to the quality and timeliness of prior authorization determinations.

School Milk Nutrition Act of 2019 This bill revises requirements for milk provided by the National School Lunch Program of the Department of Agriculture. The bill permits schools participating in the program to offer students low-fat flavored milk.

Affordable Housing Credit Improvement Act of 2019 This bill revises provisions of the low-income housing tax credit and renames it as the affordable housing credit . The bill increases the per capita dollar amount of the credit and its minimum ceiling amount beginning in 2019 and extends the inflation adjustment for such amounts. The bill modifies tenant income eligibility requirements and the average income formula for determining such income. It also revises rules for student occupancy of rental units and tenant voucher payments and prohibits any refusal to rent to victims of domestic abuse. The bill further modifies the credit to establish a 4% minimum credit rate for certain housing projects, repeal the qualified census tract population cap, prohibit local approval and contribution requirements, increase the credit for certain projects designated to serve extremely low-income households, increase the credit for certain bond-financed projects designated by state agencies, eliminate the basis reduction for properties that receive certain energy-related tax benefits, and increase the population cap for difficult development areas (i.e., areas with high construction, land, and utility costs relative to area median gross income). The bill also includes Indian and rural areas as difficult development areas and modifies other requirements relating to casualty losses, acquisition credits, and foreclosures.

Breaking Barriers for Women Veterans Act This bill requires the Department of Veterans Affairs (VA) to implement changes to better serve women veterans. Among other requirements, the VA must retrofit its existing medical facilities to support the provision of care to women veterans. Additionally, the VA must ensure its medical facilities have at least one full-time or part-time women's health provider. The bill also requires the VA to establish a training module for community providers that is specific to women veterans.

Honoring American Veterans in Extreme Need Act of 2019 or the HAVEN Act This bill modifies the treatment of certain veterans' benefits in bankruptcy. Specifically, the bill excludes from a debtor's current monthly income certain benefits, including disability benefits, paid by the Department of Veterans Affairs or the Department of Defense.

Sgt. Brandon Ketchum Never Again Act This bill requires the Department of Veterans Affairs (VA) to furnish inpatient psychiatric care upon request by a covered veteran at (1) the VA facility that is closest to where the veteran resides and that has the capacity and capability to provide such care, or (2) at a non-VA facility if the VA facility lacks such capacity or capability. A covered veteran is a veteran who is enrolled in the VA health care system and is entitled to inpatient psychiatric care.

Renewable Fuel Standard Integrity Act of 2019 This bill revises requirements for exemptions given to small refineries of crude oil under the renewable fuel program, which requires transportation fuel to contain a minimum volume of renewable fuel. Specifically, the bill establishes an annual deadline for petitions by small refineries for exemptions and subjects information in the petition to public disclosure requirements.

Impaired Driving Repeat Offender Prevention Act This bill directs the Department of Transportation to withhold specified graduated percentages of a state's apportionment of certain federal-aid highway funds for FY2022-FY2024 (5% in each fiscal year thereafter), if the state has not enacted and is not enforcing certain laws to prevent repeat intoxicated driving. Specifically, a state must require the installation of an ignition interlock device for a minimum of 180 days on each motor vehicle operated by an individual convicted of driving while intoxicated or driving under the influence.

Women's Health Protection Act of 2019 This bill prohibits state or local governments from imposing certain restrictions on access to abortion services. Specifically, state or local government may not require unnecessary tests or procedures in connection with the provision of abortion services, the same health care provider who provides abortion services to perform such tests or procedures, providers to offer medically inaccurate information to patients before or during abortion services, providers to refrain from prescribing certain drugs, certain hospital facility transfer agreements, one or more medically unnecessary in-person visits, or patients to disclose the reason for seeking abortion services. The bill also prohibits limitations or requirements that both single out and impede access to abortion services based on a number of factors (e.g., restrictions that are reasonably likely to decrease the availability of abortion services in a state). A state or local government also may not prohibit abortions prior to fetal viability nor prohibit abortions after fetal viability in cases where the health care provider determines that continuing the pregnancy poses a risk to the patient's life or health. Additionally, the Department of Justice, individuals, or health care providers may bring a lawsuit to prospectively enjoin a limitation or restriction that is prohibited by this bill. The bill further requires the government defending such a limitation or restriction to show that (1) it significantly advances the safety of abortion services or patient health, and (2) such advancement cannot be met by a less-restrictive measure.

Democracy Is Strengthened by Casting Light On Spending in Elections Act of 2019 or the DISCLOSE Act of 2019 This bill expands prohibitions and requires additional disclosures related to political spending. Specifically, foreign nationals are further restricted regarding their involvement in election related activity, including by prohibiting their participation in the decision-making process regarding an election expenditure. Existing foreign money prohibitions are expanded to prohibit disbursements for paid internet or digital communications. The Federal Election Commission must perform an audit after each election cycle to determine the incidence of illicit foreign money. In general, organizations making political expenditures must disclose donors who have contributed $10,000 or more during an election cycle. Certain of these organizations, including corporations, must also disclose their beneficial owners. The bill requires organizations to provide additional disclosures on certain political ads, including the donors who contributed the most money to that organization in the last year.

Stopping Harmful Image Exploitation and Limiting Distribution Act of 2019 or the SHIELD Act of 2019 This bill establishes a new criminal offense related to the distribution of intimate visual depictions. Specifically, it makes it a crime to knowingly distribute (or intentionally threaten to distribute) an intimate visual depiction of an individual (1) with knowledge of or reckless disregard for the individual's lack of consent and reasonable expectation of privacy, and (2) without a reasonable belief that distributing the depiction touches a matter of public concern. A violator is subject to criminal penalties—a fine, a prison term of up to five years, or both.

Conrad State 30 and Physician Access Reauthorization Act This bill modifies the Conrad 30 Waiver program, which incentivizes qualified foreign physicians to serve in underserved communities. It also extends statutory authority for the program through FY2021. Aliens coming to the United States under a J-1 nonimmigrant visa to receive medical training typically must leave the country and reside for two years abroad before being eligible to apply for an immigrant visa or permanent residence. The Conrad program waives this requirement for individuals who meet certain qualifications, including serving for a number of years at a health care facility in an underserved area. The bill increases the number of waivers that a state may obtain each fiscal year from 30 to 35 if a certain number of waivers were used the previous year, and provides for further adjustments depending on demand. An alien physician may be employed at an academic medical center to meet the Conrad program's employment requirements if the alien's work is in the public interest, even if the medical center is not in an underserved area. Employment contracts for alien physicians under the Conrad program shall contain certain information, such as the maximum number of on-call hours per week the physician shall have to work. Certain alien physicians (along with the physician's spouse and children) shall be exempt from the direct annual numerical limits on immigration, including those physicians that have met certain requirements related to visas for physicians to serve in underserved areas.

This bill requires the Department of Veterans Affairs (VA) to designate one week per year as Buddy Check Week for the purposes of organizing outreach events and educating veterans on how to conduct peer wellness checks. The VA shall ensure that the Veterans Crisis Line has a plan for handling the potential increase in calls that may occur during such week.

Maintain Access to Vital Social Security Services Act of 2019 This bill establishes procedures for closing or reducing services at Social Security Administration (SSA) field offices, including requirements related to public hearings, opportunities for comment, and notice to Congress and the public. The SSA shall report to Congress on previous office closures and submit a plan to ensure that field offices maintain their current levels of provided services.

Historic Tax Credit Growth and Opportunity Act of 2019 This bill increases the rehabilitation tax credit and modifies certain requirements for the credit. The bill increases the rate of the credit to 30% for smaller projects (rehabilitation expenditures not exceeding $3.75 million) and caps the credit for such projects at $750,000 for all taxable years. The bill also allows taxpayers to transfer all or a portion of the credits that are allowable for smaller projects. The bill expands the types of buildings eligible for rehabilitation by decreasing the rehabilitation threshold from 100% to 50% of project expenses. It also eliminates the basis adjustment requirement for the credit and modifies rules relating to the eligibility of tax-exempt use property for the credit.

Protecting America's First Responders Act This bill revises the Public Safety Officers' Benefits Program. That program provides death, disability, and education benefits to public safety officers and survivors of public safety officers who are killed or injured in the line of duty. Specifically, it revises the payment amount of disability benefits for claims pending more than one year. The amount must be based on the date of the adjudication of such claim rather than the date of the injury. It also increases the interim benefit payment amount and adjusts it based on the Consumer Price Index. Additionally, the payment amount of death benefits must be the greater of (1) the amount payable as of the date of the public safety officer's death, or (2) the amount payable based on the date of the adjudication of the claim. Currently, such amount is based only on the date of death. Next, the bill includes within the definition of firefighter for purposes of benefits an individual whose primary duty during an emergency response is to secure the scene or manage traffic. Further, the bill allows applicants who were denied benefits in the previous three years to reapply for benefits. The Bureau of Justice Assistance of the Department of Justice (DOJ) must use all available investigative tools, including subpoenas, to (1) expedite the processing of a claimant's eligibility for a death, disability, or education benefit; and (2) obtain necessary information from third parties (e.g., public agencies). Finally, DOJ must provide retroactive educational assistance to eligible survivors of public safety officer.

Physical Therapist Workforce and Patient Access Act of 2019 This bill makes the provision of physical therapy services a profession eligible for the National Health Service Corps (NHSC) Loan Repayment Program. The NHSC Loan Repayment Program assists specified health care professionals to repay eligible student loans in exchange for providing services in areas with limited access to health care.
