Summer Meals Act of 201 9 This bill revises provisions related to the Summer Food Service Program (SFSP) of the Department of Agriculture (USDA), which provides meals to children and teens in low-income areas during the summer months when school is not in session. The bill redefines areas in which poor economic conditions exist , where the SFSP may operate, as areas in which at least 40% (currently, 50%) of the children have been determined to be eligible for free or reduced price school meals under the school lunch and breakfast programs. The bill reimburses service institutions (other than school food authorities) for up to one meal and one snack per child each day during after-school hours, weekends, and school holidays during the regular school calendar. Currently, such institutions are reimbursed for meals and snacks served to children over the summer months or to children who are on vacation under a continuous school calendar. USDA may award competitive grants to service institutions to increase participation in the summer food service program for children at congregate feeding sites through innovative approaches to limited transportation and mobile meal trucks. Service institutions that are participating in the summer food service program for children may serve up to three meals, or two meals and one snack, during each day of operation. Currently, this option is reserved for camps and service institutions that serve meals primarily to migrant children.

Protecting Home Oxygen and Medical Equipment Act of 2019 or the Protecting HOME Act of 2019 This bill requires the Centers for Medicare & Medicaid Services to apply specified payment adjustments for durable medical equipment under Medicare. The bill also excludes the creation of separate payment classes and monthly payment rates for oxygen items under Medicare from certain budget neutrality requirements.

Buy America 2.0 Act This bill prohibits federal funding of a transportation or infrastructure project unless the steel, iron, and manufactured goods used for the project are produced in the United States, except where (1) inconsistent with the public interest; (2) iron, steel, and the relevant manufactured goods are not produced in the United States in sufficient and reasonably available quantities and of a satisfactory quality; or (3) inclusion of iron, steel, and manufactured goods produced in the United States will increase the cost of the overall project by more than 25%. The bill revises and expands Buy America provisions pertaining to public transportation, rail loan and loan guarantees, and aviation. The bill permanently extends the prohibition on the use of funds for a public water system project that does not use iron and steel products produced in the United States.

Pregnant Workers Fairness Act This bill prohibits employment practices that discriminate against making reasonable accommodations for job applicants or employees affected by pregnancy, childbirth, or related medical conditions. Specifically, the bill declares that it is an unlawful employment practice to (1) fail to make reasonable accommodations to known limitations of such job applicants or employees, unless the accommodation would impose an undue hardship on an entity's business operation; (2) deny employment opportunities based on the need of the entity to make such reasonable accommodations to an applicant or employee; (3) require such job applicants or employees to accept an accommodation that they do not want, if such accommodation is unnecessary to perform the job; (4) require such employees to take paid or unpaid leave if another reasonable accommodation can be provided to their known limitations; or (5) take adverse action in terms, conditions, or privileges of employment against an employee requesting or using such reasonable accommodations. The bill sets forth enforcement procedures and remedies under various statutes that cover different types of employees in relation to such unlawful employment practices. The Equal Employment Opportunity Commission must provide examples of reasonable accommodations that shall be provided to affected job applicants or employees unless the employer can demonstrate that doing so would impose an undue hardship. The bill prohibits state immunity under the Eleventh Amendment to the Constitution from an action for a violation of this bill.

Broadband Conduit Deployment Act of 2019 This bill directs the Department of Transportation to issue a notification and requirement to states that each state is required to evaluate the need for broadband conduit as part of any project. to construct a new highway or to construct an additional lane or paved shoulder for an existing highway that is commenced after the enactment of this bill and that receives funding under the federal-aid highway program.

Breast Cancer Research Stamp Reauthorization Act of 2019 This bill reauthorizes through December 31, 2027, provisions requiring the U.S. Postal Service to issue a special postage stamp for first-class mail that costs more than the regular first-class stamp to raise funds for breast cancer research.

Newborn Care Improvement Act of 2019 This bill increases from 7 to 14 the number of days that the Department of Veterans Affairs (VA) may furnish health care services, including post-delivery care, to the newborn child of a woman veteran who delivered the child in a VA facility or another facility pursuant to a VA contract for such services.

Broadband Mapping After Public Scrutiny Act of 2019 or the Broadband MAPS Act of 2019 This bill requires the Federal Communications Commission to establish a challenge process for collecting and using broadband coverage data submitted by private and governmental entities to verify coverage data reported by broadband service providers.

Safe Schools Improvement Act of 2019 This bill requires states to direct their local educational agencies (LEAs) to establish policies that prevent and prohibit conduct, including bullying and harassment, that is sufficiently severe, persistent, or pervasive to (1) limit students' ability to participate in, or benefit from, school programs; or (2) create a hostile or abusive educational environment that adversely affects students' education. LEAs shall also provide (1) students, parents, and educational professionals with annual notice of the conduct prohibited in their disciplinary policies; (2) students and parents with grievance procedures that target such conduct; and (3) the public with annual data on the incidence and frequency of that conduct at the school and LEA level. The Department of Education must conduct, and report on, an independent biennial evaluation of programs and policies to combat bullying and harassment in elementary and secondary schools. The National Center for Education Statistics shall collect state data to determine the incidence and frequency of the conduct prohibited by LEA disciplinary policies.

Improving Training for School Food Service Workers Act This bill adds requirements regarding the availability of training that the Department of Agriculture provides under current law for local food service personnel in schools. The training must be scheduled primarily during regular, paid working hours; offered in-person whenever appropriate; and incorporate hands-on training techniques. If the training is scheduled outside of working hours, food service personnel must be informed about the necessity of scheduling the program and compensated for attending the program. Personnel may not be penalized for failing to attend a program outside of working hours.

Stop Senior Scams Act This bill establishes a Senior Scams Prevention Advisory Council, which shall create model educational materials to educate employees of retailers, financial-services companies, and wire-transfer companies on how to identify and prevent scams that affect seniors.

Rural Access to Hospice Act of 2019 This bill allows federally qualified health centers (FQHCs) and rural health centers (RHCs) to receive payment under Medicare for hospice services. Currently, attending physicians who work for FQHCs and RHCs may provide hospice services only outside of FQHC or RHC work hours and must bill Medicare under their own provider numbers; FQHCs and RHCs may not receive payment under Medicare for such services.

Home Health Payment Innovation Act of 2019 This bill makes a series of changes relating to payment and coverage of home health services under Medicare and Medicare Advantage (MA). Specifically, the bill allows the home-confinement requirement (also known as the homebound requirement) for home health services to be waived under Medicare and MA. Currently, as a condition of eligibility for such services, a physician must certify that an individual has difficulty leaving home without assistance (e.g., a wheelchair, special transportation, or help from another person) due to an illness or injury. The bill also alters the payment methodology under the Medicare prospective payment system for home health services, including by eliminating the requirement that such methodology include certain behavioral assumptions regarding the implementation of specified changes to units of payment and case-mix adjustment factors.

Medicare Enrollment Protection Act This bill creates a special Medicare enrollment period for individuals enrolled in, or transitioning out of, continuation coverage under the Consolidated Omnibus Budget Reconciliation Act (COBRA)—a federal law that allows an individual to maintain health coverage following loss of coverage due to termination of employment or another qualifying event. The bill exempts such individuals from certain monthly premium increases associated with delaying Medicare coverage.

United States Postal Service Shipping Equity Act This bill authorizes the mailing of alcoholic beverages by a covered entity in accordance with the delivery requirements otherwise applicable to a privately carried shipment. Covered entity is defined as an entity (including a winery, brewery, or beverage distilled spirits plant, or other wholesale, distributer, or retailer of alcoholic beverages) that has registered with, obtained a permit from, or obtained approval of an application from the Department of the Treasury pursuant to the Federal Alcohol Administration Act or the Internal Revenue Code provisions regarding alcohol, tobacco, and certain other excise taxes. The bill directs the U.S. Postal Service (USPS) to prescribe regulations: (1) requiring such mailing to be through a means that ensures direct delivery to a duly authorized agent at a postal facility or to the addressee, who must be at least 21 years of age and present a valid, government-issued photo identification at the time of delivery; (2) prohibiting such alcoholic beverages from being for resale or any other commercial purpose; and (3) requiring such covered entity to certify that the mailing is not in violation of applicable laws or regulations and to provide other information as directed by the USPS, including with respect to the prepayment of state alcohol beverage taxes.

Protecting the Right to Organize Act of 2019 This bill amends the National Labor Relations Act and related labor laws to extend protections to union workers. Specifically, it revises the definition of "employee" and "supervisor" to prevent employers from classifying employees as exempt from labor law protections, expands unfair labor practices to include prohibitions against replacement of or discrimination against workers who participate in strikes, makes it an unfair labor practice to require or coerce employees to attend employer meetings designed to discourage union membership, permits workers to participate in collective or class action litigation, allows injunctions against employers engaging in unfair labor practices involving discharge or serious economic harm to an employee, expands penalties for labor law violations, including interference with the National Labor Relations Board or causing serious economic harm to an employee, and allows any person to bring a civil action for harm caused by labor law violations or unfair labor practices.

Stronger Child Abuse Prevention and Treatment Act This bill reauthorizes through FY2025 and revises the Child Abuse Prevention and Treatment Act and the Child Abuse Prevention and Treatment and Adoption Reform Act of 1978 to expand services for preventing and treating child abuse. Specifically, the bill establishes requirements concerning collecting and exchanging data about child abuse and neglect. For instance, the bill requires the Department of Health and Human Services (HHS) to (1) establish uniform national standards for tracking and reporting child fatalities and near-fatalities resulting from maltreatment, and (2) develop an electronic interstate data exchange system that allows states to share information from their child abuse and neglect registries with other states. In addition, the bill addresses child abuse and neglect related to families impacted by substance use disorders, racial bias in the child protective services system, and child sexual abuse. Finally, the bill requires HHS to examine unregulated custody transfers and make recommendations for preventing, identifying, and responding to such transfers.

Better Respiration through Expanding Access to Tele-Health Act or the BREATHE Act This bill requires the Centers for Medicare & Medicaid Services to establish a pilot program in which qualifying respiratory therapists may provide telehealth services under Medicare. Specifically, the program must allow respiratory therapists to provide telehealth disease management services (e.g., smoking cessation counseling) for individuals with chronic obstructive pulmonary disease.

Medical Nutrition Equity Act of 2019 This bill expands coverage under Medicare, Medicaid, other specified federal health-care programs, and private health insurance to include foods, vitamins, and individual amino acids that are medically necessary for the management of certain digestive and metabolic disorders and conditions.

Gold Star Family Tax Relief Act This bill treats certain military survivor benefits that are received by children as earned income of the child for the purposes of the kiddie tax (the tax on the unearned income of children). This has the effect of exempting the benefits from such tax.

Copyright Alternative in Small-Claims Enforcement Act of 2019 or the CASE Act of 2019 This bill creates the Copyright Claims Board, a body within the U.S. Copyright Office, to decide copyright disputes. Damages awarded by the board are capped at $30,000. Participation in board proceedings is voluntary with an opt-out procedure for defendants, and parties may choose instead to have a dispute heard in court. If the parties agree to have their dispute heard by the board, they shall forego the right to be heard before a court and the right to a jury trial. Board proceedings shall have no effect on class actions. The board shall be authorized to hear copyright infringement claims, actions for a declaration of noninfringement, claims that a party knowingly sent false takedown notices, and related counterclaims. The bill provides for various procedures, including with respect to requests for information from the other party and requests for the board to reconsider a decision. The board may issue monetary awards based on actual or statutory damages. The parties shall bear their own attorneys' fees and costs except where there is bad faith misconduct. A board's final determination precludes relitigating the claims in court or at the board. Parties may challenge a board decision in federal district court only if (1) the decision was a result of fraud, corruption, or other misconduct; (2) the board exceeded its authority or failed to render a final determination; or (3) in a default ruling or failure to prosecute, the default or failure was excusable.

Puppy Protection Act of 2019 This bill requires the Department of Agriculture to expand standards that govern the humane handling, care, treatment, and transportation of animals to include new requirements for commercial dog dealers. Specifically, the standards must require dog dealers to provide to dogs adequate housing, exercise, and veterinary care; appropriate and nutritious food; continuous access to potable water; and meaningful socialization with humans and compatible dogs for at least 30 minutes each day. The standards must also include requirements for breeders to use safe breeding practices and make all reasonable efforts to find humane placement for retired breeding dogs.

National Museum of the American Latino Act This bill establishes the National Museum of the American Latino in the Smithsonian Institution. The purposes of the museum are to (1) illuminate Latino contributions to the story of the United States; (2) provide for the collection, study, research, publication, and establishment of exhibitions and programs related to Latino life, art, history, and culture; and (3) provide for collaboration with Smithsonian Institution museums and research centers and other museums and educational institutions in the United States and abroad to promote the study and appreciation of Latino life, art, history, culture, and its impact on society in the United States. The bill establishes a Board of Trustees for the museum to advise and assist the Board of Regents of the Smithsonian on all matters related to the administration and preservation of the museum. The Director of the museum shall manage the museum and may carry out educational and liaison programs in support of its goals. The Director of the Institute of Museum and Library Services shall establish and carry out specified grant programs and a scholarship program, including a grant program to promote the understanding of the Latin American diaspora in the United States. The Board of Regents shall designate a site for the museum and is authorized to design and construct it.

Women's Suffrage Centennial Commemorative Coin Act This bill directs the Department of the Treasury to mint and issue up to 400,000 $1 silver coins that are emblematic of the women who played a vital role in rallying support for the 19th Amendment to the U.S. Constitution. Such coins may be issued during the period beginning on January 1, 2020, and ending on December 31, 2020. All surcharges received from the sales of such coins shall be paid to the American Women's History Initiative of the Smithsonian Institution.

Ensuring Access to Quality Complex Rehabilitation Technology Act of 2019 This bill establishes a specific benefit category (i.e., classification) for complex rehabilitation technology items under Medicare. The Centers for Medicare & Medicaid Services must set payment for such items in accordance with a specified methodology that includes certain clinical conditions and quality standards. The bill also excludes such items from Medicare's competitive acquisition program (in which rates are set through a competitive bidding program rather than by an established fee schedule). The bill defines complex rehabilitation technology item to include complex rehabilitation manual and power wheelchairs, specialized seating and positioning items, and adaptive equipment such as standing frames and gait trainers, including associated accessories.

This resolution expresses the sense of the House of Representatives that only a two-state solution to the Israeli-Palestinian conflict can ensure Israel's survival as a secure Jewish and democratic state and fulfill the legitimate aspirations for a Palestinian state. It also expresses the sense that any U.S. proposals that fail to expressly endorse a two-state solution will likely put a peaceful end to the conflict further out of reach.

Keep Our Promise to America's Children and Teachers Act or the Keep Our PACT Act This bill provides funding for disadvantaged students under the Elementary and Secondary Education Act of 1965 (ESEA) and students with disabilities under the Individuals with Disabilities Education Act (IDEA) for FY2020-FY2029. Specifically, the bill (1) provides funding for grant programs under the ESEA operated by local educational agencies dealing with the disadvantaged, and (2) reauthorizes the IDEA to assist states and outlying areas in providing special education and related services to children with disabilities.

Disaster Tax Relief Act of 2019 This bill allows various tax credits, tax deductions, and modifications to existing rules for individuals and businesses affected by federally declared disasters that occurred after December 31, 2018, and before April 15, 2019. With respect to individuals and businesses in the affected areas, the bill waives the 10% additional tax on certain early distributions from retirement plans, permits individuals to recontribute funds to retirement plans if the funds were distributed for a home purchase that was cancelled on account of a disaster, increases the limit and extends the repayment deadline for loans from retirement plans, allows an employee retention tax credit for employers affected by disasters, temporarily increases the limitation on tax deductions for charitable contributions for relief efforts in disaster areas, modifies the rules for the deduction for personal casualty losses, and allows taxpayers residing in disaster areas to use earned income from the immediately preceding year for the purpose of determining earned income for the earned income tax credit and the child tax credit.

Safe Step Act This bill requires a group health plan to establish an exception to medication step-therapy protocol in specified cases. A medication step-therapy protocol establishes a specific sequence in which prescription drugs are covered by a group health plan or a health insurance issuer. A request for such an exception to the protocol must be granted if (1) the treatment is expected to be ineffective, (2) the treatment will cause or is likely to cause an adverse reaction to the individual, (3) the treatment is expected to decrease the individual's ability either to perform daily activities or occupational responsibilities or adhere to the treatment plan, (4) the individual is stable based on the prescription drugs already selected, or (5) there are other medical reasons that warrant withholding the treatment. The bill requires a group health plan to implement and make readily available a clear process for an individual to request an exception to the protocol. Requests must be granted no later than three days after receipt of the request. In certain cases where the life, health, and ability of the individual are jeopardized by the protocol, the request shall be granted no later than 24 hours after receipt of the request.

Helping Ensure Life- and Limb-Saving Access to Podiatric Physicians Act or the HELLPP Act This bill adds podiatrists as covered physicians under the Medicaid program. Additionally, the bill revises certain documentation requirements related to Medicare coverage of therapeutic shoes for individuals with diabetes. Finally, the bill subjects payments made to a Medicaid provider or supplier to a continuing levy for federal taxes owed by the provider or supplier.

Promotion and Expansion of Private Employee Ownership Act of 201 9 This bill expands tax incentives and federal assistance for employee stock ownership plans (ESOPs) that are sponsored by S corporations. The bill provides additional tax incentives for ESOPs by (1) extending to all domestic corporations, including S corporations, provisions allowing deferral of tax on gain from the sale of employer securities to an ESOP; and (2) allowing a tax deduction for 50% of the interest received by a bank on loans to S corporation-sponsored ESOPs for the purchase of employer securities. The Department of the Treasury must establish the S Corporation Employee Ownership Assistance Office to foster increased employee ownership of S corporations. The bill defines an "ESOP business concern" and allows such a concern to continue to qualify as a small business for the purposes of programs under the Small Business Act. An "ESOP business concern" is a business concern that was a small business concern eligible for a loan, preference, or other program under the Small Business Act before more than 49% of the business concern was acquired by an ESOP.

Reach Every Veteran in Crisis Act This bill requires the Department of Veterans Affairs (VA) to establish measurable targets to evaluate the effectiveness of the VA's mental health and suicide prevention media outreach campaigns. The VA must also establish a process to oversee such outreach campaigns that includes a delineation of the roles of officials in leadership and contract oversight positions within the Office of Mental Health and Suicide Prevention of the Veterans Health Administration. Finally, the VA must ensure that each contract entered into for the development of such outreach campaigns includes a requirement that the contractor track and report on the established metrics.

Home Health Care Planning Improvement Act of 2019 This bill allows Medicare payment for home health services ordered by a nurse practitioner, a clinical nurse specialist, a certified nurse-midwife, or a physician assistant. Currently, coverage is provided only for services ordered by a physician.

Revitalizing Underdeveloped Rural Areas and Lands Act of 2019 or the RURAL Act of 2019 This bill modifies the definition of income used to determine the tax-exempt status of a mutual or cooperative telephone or electric company to exclude certain government grants, contributions, and assistance. Specifically, the bill excludes from income (1) grants, contributions, and assistance provided under the Robert T. Stafford Disaster Relief and Emergency Assistance Act or by local, state, or regional governmental entities for disasters or emergencies; and (2) certain grants or contributions provided by a government entity for electric, communications, broadband, internet, or other utility facilities or services.

Prescription Drug Sunshine, Transparency, Accountability and Reporting Act or the Prescription Drug STAR Act This bill establishes requirements for prescription drug manufacturers to provide certain information about pricing, discounts, and product samples of applicable drugs. Specifically, the bill requires the Department of Health and Human Services (HHS) to annually determine whether there are price increases of a certain threshold for outpatient prescription drugs covered under Medicare, excluding low-cost drugs. Manufacturers must provide HHS with an explanation for drug prices that (1) cumulatively increase by at least 10% or $10,000 over one year; (2) cumulatively increase by at least 25% or $25,000 over three years; or (3) are at least $26,000 annually, per individual, if first covered by Medicare during the applicable year. The manufacturer must explain the role of the factors contributing to such prices and other relevant information, including manufacturing costs, marketing costs, and revenue. Additionally, drug manufacturers must provide HHS with aggregate data related to product samples of drugs, devices, biologic products, and medical supplies given to hospitals, physicians, or other medical professionals during the previous calendar year, beginning in 2023. The bill further requires HHS to make publicly available the information related to drug discounts, rebates, and price concessions that is provided annually to HHS by group health plans. Drug manufacturers also must report to HHS certain sales information for drugs available under Medicare for which the manufacturer does not have a rebate agreement in place. The bill requires HHS to study and report on trends concerning inpatient hospital drug costs.

This bill reauthorizes through FY2025 and revises the Energy Efficiency and Conservation Block Grant Program. Under the program, the Department of Energy provides grants to local governments, states, and Indian tribes for energy efficiency and conservation projects and programs. This bill expands the allowable uses of grant funds to include the deployment of energy distribution technologies that significantly expand access to alternative fuels.
