Tighten Washington's Belt Act of 2010

Tighten Washington's Belt Act of 2010 - Requires the Office of Management and Budget (OMB), within 15 days after the end of a session, to issue a Discretionary Sequestration Report and, if in such report OMB estimates that any sequestration is required, the President to issue an order (effective on issuance) fully implementing without change all such sequestrations. Requires the Congressional Budget Office (CBO), within 10 days after the end of session, also to issue a Discretionary Sequestration Report. Subjects to permanent cancellation any budgetary resources sequestered from any account, except those in special fund accounts or offsetting collections sequestered in appropriation accounts. Applies the same percentage sequestration to all programs, projects, and activities within a budget account. Requires the Comptroller General, upon request of the congressional budget committees, to report to Congress and the President on the extent to which each such issued presidential order or OMB or CBO report complies with all of the requirements contained in this Act, either certifying that the order fully and accurately complies with such requirements or indicating the respects in which it does not. Requires Discretionary Sequestration Reports for each of FY2011-FY2015 to set forth estimates for: (1) the applicable discretionary spending limits; (2) the new budget authority and the breach, if any; (3) the sequestration percentages necessary to eliminate the breach; and (4) the level of enacted sequesterable budget authority, and resulting estimated outlays to be sequestered for each account. Requires the OMB report to explain: (1) any differences between OMB and CBO estimates for any breach and any required discretionary sequestration percentages; and (2) differences in the amount of sequesterable resources for any budget account to be reduced if such difference is greater than $5 million. Establishes discretionary spending limits for FY2011-FY2015. Sets forth sequestration enforcement mechanisms. Subjects all discretionary budget authority to such sequestration procedures, except: (1) benefits and compensation provided to active duty military and to veterans defined as discretionary spending; (2) provisions of discretionary spending legislation the President and Congress designate as emergency requirements; and (3) salaries or other expenditures that may not be reduced on account of constitutional requirements.

Requires a two-thirds recorded vote of Members in the House and a roll call vote of at least two-thirds of the Members of the Senate before legislation increasing the statutory limit on the public debt may be considered as passed or agreed to in either chamber. Permits a successful appeal from the ruling of the Chair in the Senate on such prohibition, but only by an affirmative roll call vote of two-thirds of its Members. Repeals Rule XXVIII (Statutory Limit on Public Debt) of the Rules of the House, and known as the "Gephardt Rule," providing for mandatory adjustment of the statutory limit on the public debt to conform to a budget resolution.

Medicare SGR Improvement and Reform Act of 2009 - Amends title XVIII (Medicare) of the Social Security Act to provide an increased annual update for the Sustainable Growth Mechanism (SGR) formula for determining rates in the fee schedule for Medicare physician payments. Sets a three-year time limit for the commencement of a health care lawsuit. Prescribes requirements for: (1) unlimited damages for a claimant's actual economic losses in health care lawsuits; (2) court supervision of arrangements for payment of such damages, including limitation of contingent attorney fees; (3) restrictions on punitive damages; and (4) payment of future damages to claimants in health care suits. Terminates funding of the Medicare Improvement Fund as of January 1, 2010. Amends the Public Health Service Act to prescribe requirements for the licensure of biological products as biosimilar or interchangeable. Includes under the Federal Food, Drug, and Cosmetic Act fees relating to the licensure of a biological product. Amends patent law with respect to biosimilar products. Directs the Secretary of Health and Human Services (HHS) to adopt a single set of consensus-based operating rules for each health information transaction.

Post 9/11 Troops to Teachers Enhancement Act - Amends the Troops-to-Teachers program of the Elementary and Secondary Education Act of 1965 (which provides veterans with teacher certification stipends in exchange for three years of service in a high-need local educational agency [LEA] or public charter school). Expands program eligibility to cover certain individuals: (1) who, on or after September 11, 2001, serve at least 90 continuous days on active duty in the Armed Forces before being honorably released from such service; or (2) who, on or after January 8, 2002, are separated or released from active duty after at least four (currently, six) years of continuous active duty immediately preceding such separation or release, and agree to serve in the Armed Forces Reserves for at least three years. Makes any LEA that is receiving school improvement funds eligible to host Troops-to-Teachers program participants. Directs the Secretary of Education to establish an Advisory Board, composed of federal, state, and veteran service organization representatives, to collect, study, and disseminate feedback from the program and report to Congress on how the program is operating and might be improved. Reserves specified funding to carry out the Troops-to-Teachers program through FY2014.

Allows an individual to elect to continue and extend such coverage through an election similar to that permitted under the American Recovery and Reinvestment Act of 2009 (ARRA). Declares that the extended period of continuation under this Act shall not exceed six months. Amends ARRA to extend: (1) until June 30, 2010, the period to determine eligibility for COBRA premium assistance; and (2) the period for which premium assistance is provided to an eligible individual. Makes this Act effective as if included in the enactment of ARRA.

Consistency, Accuracy, Responsibility, and Excellence in Medical Imaging and Radiation Therapy Act of 2009 - Amends the Public Health Service Act to require personnel who perform or plan the technical component of either medical imaging examinations or radiation therapy procedures for medical purposes to possess, effective January 1, 2013: (1) certification in each medical imaging or radiation therapy modality and service provided from a certification organization designated by the Secretary of Health and Human Services (HHS); or (2) state licensure or certification where such services and modalities are within the scope of practice as defined by the state for such profession and where the requirements for licensure, certification, or registration meet or exceed the standards established by the Secretary. Exempts physicians, nurse practitioners, and physician assistants. Directs the Secretary to: (1) establish minimum standards for personnel who perform, plan, evaluate, or verify patient dose for medical imaging examinations or radiation therapy procedures; (2) establish a program for designating certification organizations after consideration of specified criteria; (3) provide a method for the recognition of individuals whose training or experience are determined to be equal to, or in excess of, those of a graduate of an accredited educational program in that specialty; and (4) approve and publish a list of accrediting bodies for such certification organizations. Authorizes the Secretary to develop alternative standards for rural or health professional shortage areas as appropriate to assure access to quality medical imaging. Amends the Social Security Act to allow Medicare payment for medical imaging and radiation therapy services furnished on or after January 1, 2013, only if the examination or procedure is planned or performed by an individual who meets this Act's requirements.

Health Care Consumer Protection Act of 2009 - Amends the Public Health Service Act to require an issuer of group health insurance coverage in connection with a group health plan that cancels or does not renew the coverage by reason of nonpayment of premiums to: (1) provide to the administrator of the plan and to each participant receiving coverage, during the 14-day period beginning on the date of such cancellation or non-renewal, written notice of the cancellation or non-renewal, the reason for such cancellation or non-renewal, and the right of reinstatement; and (2) reinstate the coverage as if it had not lapsed if the premiums due and such reasonable administrative fee as the state regulating such coverage may specify are paid to the issuer by not later than 60 days after the date the cancellation or non-renewal would otherwise have become effective. Applies such requirement in the same manner to health insurance coverage offered by a health insurance issuer in the individual market. Requires the notice to be provided to an association or other organization responsible for paying premiums as well as the individuals whose coverage is affected.

Education Assistance to Realign New Eligibilities for Dependents (EARNED) Act of 2009 - Allows any former member of the Armed Forces who has 20 years of active-duty service as of any date between September 30, 2011, and ending July 31, 2009, including at least 90 days of such service after September 10, 2001, and is honorably discharged to transfer to their dependents any remaining entitlement to educational assistance under the post-9/11 veterans' educational assistance program.

Defund ACORN Act - Prohibits any federal contract, grant, cooperative agreement, or other form of agreement from being awarded to, any federal funds in any other form from being provided to, or any federal employee or contractor from promoting any organization that: (1) has been indicted for a violation under any federal or state law governing the financing of a campaign for election for public office or any law governing the administration of such an election, including a voter registration law; (2) had its state corporate charter terminated due to its failure to comply with federal or state lobbying disclosure requirements; (3) has filed a fraudulent form with any federal or state regulatory agency; or (4) employs, has under contract, or retains to act on its behalf any individual who has been indicted for a violation under federal or state law relating to an election for federal or state office. Identifies, specifically, the Association of Community Organizations for Reform Now (ACORN) and any affiliate as such an organization. Requires the Federal Acquisition Regulation to be revised to carry out provisions of this Act relating to contracts.
