Disaster Loan Fairness Act of 2012

Disaster Loan Fairness Act of 2012 - Amends the Small Business Act to provide the interest rate to be charged by the Small Business Administration (SBA) for loans made to small businesses beginning on January 1, 2011, and ending four years after the date of enactment of this Act in major disaster areas. Requires such rate to be the lesser of 4% or one-half the prevailing rate for similar loans in the area for those unable to attain credit elsewhere, or three-fourths the prevailing rate for those able to attain credit elsewhere. Requires the SBA Administrator to refund excess interest payments made by qualifying borrowers before the enactment of this Act. Directs the Administrator to report to Congress on whether the reduced rate has resulted in: (1) a greater number of applications for disaster-related loans, (2) a greater number of approvals for such loans, or (3) a decreased default rate.

Fair Minimum Wage Act of 2012

Fair Minimum Wage Act of 2012 - Amends the Fair Labor Standards Act of 1938 (FLSA) to increase the federal minimum wage for employees to: (1) $8.10 an hour on the first day of the third month after the enactment of this Act; (2) $8.95 an hour after one year; (3) $9.80 an hour after two years; and (4) the amount determined by the Secretary of Labor (based on increases in the Consumer Price Index) after three years, and annually thereafter. Increases the federal minimum wage for tipped employees to $3.00 an hour for one year on the first day of the third month after the enactment of this Act. Provides a formula for subsequent annual adjustments of the wage increase to ensure that it remains equal to 70% of the wage in effect under FLSA for other employees. Directs the Secretary of Labor, 60 days before any increase in the minimum wage, to publish it in the Federal Register and on the Department of Labor's website.

Servicemembers Access to Justice Act of 2012 - Waives a state's sovereign immunity with respect to the enforcement of uniformed services members' employment or reemployment rights or benefits under the Uniformed Services Employment and Reemployment Rights Act of 1994 (USERRA). Makes unenforceable agreements between an employer and employee requiring arbitration of disputes arising under USERRA. Provides exceptions. Requires the validity and enforceability of such an agreement to be determined by a court (as opposed to the arbitrator). Provides increased liquidated damages, and authorizes punitive damages, against state or private employer violations of USERRA. Provides a right to a jury trial in such cases. Requires (under current law, authorizes) the award of attorney fees in actions to enforce USERRA. Requires (under current law, authorizes) a court to use equitable relief, including injunctions and restraining orders when appropriate, for USERRA violations. Requires federal procurement contracts to include a notice that the contractor may have USERRA obligations. Requires a Comptroller General study on the effectiveness of federal education and outreach programs on employer obligations under USERRA.

Farmer's Privacy Act of 2012

Farmer's Privacy Act of 2012 - Prohibits the Administrator of the Environmental Protection Agency (EPA), in exercising any authority under the Federal Water Pollution Control Act (commonly known as the Clean Water Act), from conducting aerial surveillance of agricultural land unless the Administrator has: (1) obtained the voluntary written consent of the owner or operator of the land to be surveilled; (2) provided between 5 and 10 days' notice to the owners or operators of land in the area to be surveilled; and (3) obtained from the U.S. District Court for the District of Columbia a certification of reasonable suspicion that a violation of the Act exists in the area to be surveilled. Requires the Administrator to ensure that such consent: (1) specifies a period of up to one year during which the consent is effective, (2) contains a specific description of the geographical area to be surveilled, (3) contains limitations on the days and times during which the surveillance may be conducted if requested by such owner or operator, and (4) is granted voluntarily. Prohibits the Administrator from threatening additional, more detailed, or more thorough inspections or coercing or enticing such owner's or operator's consent. Requires the Administrator to make available to such owners or operators images of such land obtained from such surveillance.

Voter Confidence and Increased Accessibility Act of 2011 [ sic ] - Amends the Help America Vote Act of 2002 (HAVA) to revise requirements for the audit capacity of voting systems, particularly those for a permanent paper record. Requires the voting system to require the use of an individual, durable, voter-verified paper ballot of the voter's vote that shall be marked and made available for inspection by the voter before the voter's vote is cast and counted, and which shall be counted by hand or read by an optical scanner or other counting device. Requires the voting system to provide the voter with an opportunity to correct any system-made error in the voter-verified paper ballot before it is permanently preserved. Requires each paper ballot used to be: (1) suitable for a manual audit, and (2) counted by hand in any recount or audit conducted with respect to any federal election. Sets forth a special rule for treatment of disputes when paper ballots have been shown to be compromised. Requires the Director of the National Science Foundation (NSF) to make grants to eligible entities to study, test, and develop accessible ballot voting, verification, and casting mechanisms and devices and best practices to enhance the accessibility of paper ballot voting and verification mechanisms for individuals with disabilities, for voters whose primary language is not English, and for voters with difficulties in literacy. Specifies additional voting system requirements and prohibitions. Requires the NSF Director to make grants to eligible entities to conduct research on the development of election-dedicated voting system software. Makes available additional funding to enable states to meet the costs of the requirements imposed by this Act. Provides for complaints to the Attorney General by persons aggrieved by violations of HAVA. Requires each state to administer audits of federal election results, without advance notice to the precincts selected, consisting of random hand counts of the voter-verified paper ballots. Makes an exception from this requirement for elections in which the winning candidate had no opponent or received 80% or more of the vote total. Prescribes requirements for determination of the number of ballots counted under the audit. Prescribes the process for administering audits. Requires the Election Auditor of a state, as soon as practicable after the completion of an audit, to submit the results to the Election Assistance Commission (EAC) for publication. Prohibits certification of the results of any election until completion of audits. Provides for payments to states for the costs of conducting audits. Exempts from this Act any election for which a recount under state law will commence before certification of the election results. Repeals the EAC's exemption from certain federal government contracting requirements.

Domestic Fuels Protection Act of 2012

Domestic Fuels Protection Act of 2012 - Amends the Solid Waste Disposal Act to provide that no person shall be liable under any federal, state, or local law, and no provider of financial assurance may deny payment for a claim, because an underground storage tank, underground storage tank system, or associated dispensing equipment at a stationary facility is not compatible with any fuel or fuel additive for use in a motor vehicle, nonroad vehicle, or engine if such tank or equipment has been determined to be compatible pursuant to the guidelines and regulations issued under this Act. Directs the Administrator of the Environmental Protection Agency (EPA) to issue regulations setting standards for determining whether underground storage tanks and systems and associated dispensing equipment are compatible with any fuel or fuel additive that is authorized and registered by the Administrator or by statute for use in a motor vehicle or engine or nonroad vehicle, engine, or equipment. Deems tanks, systems, and equipment that are listed by a nationally recognized testing laboratory as compatible with such a fuel or fuel additive as of the date of enactment of this Act to be compatible under such regulations. Amends the Clean Air Act to prohibit a person selling such fuel who complies with such regulations from being liable under any federal, state, or local law if: (1) a self-service purchaser introduces any such fuel into a vehicle, engine, or equipment for which the fuel has not been approved under such Act; or (2) the introduction of any such fuel voids the warranty of the manufacturer of such vehicles, engines, or equipment. Excludes from such protection: (1) a person who sells a transportation fuel and does not comply with the misfueling regulations adopted by the Administrator, and (2) a person who intentionally misfuels. Prohibits filing or maintaining in any U.S. or state court any civil action or proceeding against an entity engaged in the design, manufacture, sale, or distribution of any qualified product or of any motor vehicle, engine, or nonroad equipment for damages, abatement, restitution, fines, penalties, or other relief resulting from the introduction of any such product into a motor vehicle, engine, or nonroad equipment. Requires actions filed or pending upon enactment of this Act to be dismissed with prejudice. Defines a "qualified product" as any fuel or fuel additive that is registered under federal law or any transportation fuel or fuel additive that contains renewable fuel and that is designated for introduction into interstate commerce under federal law, any component thereof, or any blend stock. Prohibits a qualified productfrom being considered a defective product if it does not violate a control or prohibition with respect to any of its characteristics or components imposed by the Administrator under the Clean Air Act.

Directs the Secretary, working in conjunction with the Inland Waterways Users Board, to submit to Congress a 20-year program for making capital investments on inland and intracoastal waterways. Authorizes such program to be based on the 20-year capital investment strategy contained in the Inland Marine Transportation System (IMTS) Capital Projects Business Model, Final Report published on April 13, 2010, as approved by the Board. Amends the Internal Revenue Code to limit expenditures from the Inland Waterways Trust Fund to 50% of the total cost of the construction or rehabilitation project. Prohibits expenditures from the Fund for: (1) construction or rehabilitation of dams, or (2) rehabilitation expenditures equal to or exceeding $100 million.

Chesapeake Bay Program Reauthorization and Improvement Act - Amends the Federal Water Pollution Control Act (commonly known as the Clean Water Act or CWA) to establish: (1) financial reporting requirements for restoration activities in the Chesapeake Bay watershed and (2) the Independent Evaluation and Technical Advisory Committee to review and report on restoration activities in the Bay ecosystem and to provide recommendations to the Administrator of the Environmental Protection Agency (EPA) and the Secretary of the Department of Agriculture (USDA) on such activities. Authorizes appropriations for FY2013-FY2018. Requires the Administrator to: (1) complete an economic analysis of each EPA statement (i.e., guidance, policy, memorandum, regulation, or statement of general applicability and future effect that is designed to implement, interpret, or prescribe law or policy relating to water quality in the Bay); and (2) establish technical guidelines to be used by the Chesapeake Bay Nutrient and Sediment Trading Commission in establishing a voluntary interstate nitrogen, phosphorus, and sediment trading program for the Bay. Prohibits such guidelines from applying to agricultural nonpoint sources or nonindustrial private forest lands except to the extent that such guidelines consist of guidelines issued under the Food Security Act of 1985 concerning environmental service markets. Requires a total maximum daily load (TMDL) for nitrogen, phosphorus, or sediment for a segment of the Bay and its tributaries to use timeframes other than daily (such as annual, monthly, or seasonal) for certain economic sectors, including agriculture, in which a nondaily timeframe is appropriate. Authorizes a point source to meet National Pollutant Discharge Elimination System (NPDES) permit limits on nitrogen, phosphorus, or sediment through trade administered by the Chesapeake Bay Nutrient and Sediment Trading Commission. Provides that powers are reserved solely to states to implement a total maximum daily nutrient or sediment load in the Bay. Authorizes, in Bay states that have developed TMDL plans that reduce loading through an iterative process that employs adaptive management principles, NPDES permits to be issued for new or existing point source discharges that include wasteload allocations consistent with such plan and that demonstrate progress towards achieving the wasteload allocation specified in such plan by treatment, trading or other means. Authorizes individuals or entities undertaking land development activities to be permitted to meet requirements for managing stormwater by offsetting such activities through the establishment of equivalent stormwater management practices off-site within the Bay ecosystem. Authorizes Bay states to use funds made available under the nonpoint source management program for activities related to reducing losses of nitrogen, phosphorus, or sediment from agricultural or nonindustrial private forest land through a watershed partnership developed under the Food and Security Act of 1985. Establishes an independent Chesapeake Bay Nutrient and Sediment Trading Commission in the Office of the Chesapeake Bay Program to: (1) administer the nitrogen, phosphorus, and sediment trading program for Delaware, Maryland, New York, Pennsylvania, Virginia, West Virginia, and the District of Columbia to ensure that credits are generated to attract market participants and facilitate trading mechanisms among and within such jurisdictions to meet water quality goals; (2) operate a registry for interstate water quality trading; and (3) develop a system to allow for trading to occur between point source and non-point source dischargers and any combination thereof among and within Bay states. Terminates the Commission on September 30, 2018. Amends the Food Security Act of 1985 to require the Secretary to enter into a memorandum of understanding with the chief executive of a Bay state upon such executive's request to establish a watershed partnership. Authorizes each partnership to establish a watershed strategy for demonstrating aggregate reductions in losses of nitrogen, phosphorus, and sediment, on a basin or subbasin scale in the Bay watershed, from agricultural or nonindustrial private forest land in the state. Requires such strategies to establish an assurance process in which qualified producers or owners of non-industrial forest land may participate. Requires the Secretary to: (1) provide conservation technical assistance to educate agricultural and private forest landowners in the Bay regarding water quality requirements, (2) publish a list of eligible agricultural and forestry activities that result in environmental service benefits, and (3) establish a pilot program for the Bay watershed for the facilitation of creating environmental service markets.

Amends the Tariff Act of 1930 regarding the imposition of countervailing duties on imports into the United States from a country subsidizing, directly or indirectly, the manufacture, production, or export of merchandise which materially injures a U.S. industry or threatens to. Declares that merchandise on which countervailing duties must be imposed includes merchandise from a nonmarket country, unless the administering authority cannot identify and measure subsidies provided by the government of the nonmarket economy country (or a public entity within its territory) because the economy of that country is essentially composed of a single entity. Requires the administering authority to reduce the antidumping duty on a class or kind of merchandise from a nonmarket economy country in cases where: (1) such country (or a public entity within its territory) has provided the merchandise with a countervailable subsidy (other than an export subsidy); (2) the subsidy has reduced the average price of imports of that class or kind of merchandise during the relevant period; and (3) the extent to which the subsidy, in combination with the use of normal value, has increased the weighted average dumping margin for such merchandise can be reasonably estimated. Requires the administering authority, in such cases, to reduce the antidumping duty by the amount of the increase in the weighted average dumping margin estimated (but not by more than the portion of the countervailing duty rate attributable to the countervailable subsidy).

Requires the Director to: (1) determine the current and historical rates and amounts of recovery of improper payments and targets for recovering improper payments, and (2) establish a plan for at least 10 Recovery Audit Contracting programs to identify and recover overpayments and underpayments in 10 agencies.

Title II: Temporary Extension of Unemployment Compensation Provisions - Amends the Supplemental Appropriations Act, 2008 with respect to the state-established individual emergency unemployment compensation account (EUCA). Extends the final date for entering a federal-state agreement under the Emergency Unemployment Compensation (EUC) program through March 6, 2012. Postpones the termination of the program until August 15, 2012. Amends the Assistance for Unemployed Workers and Struggling Families Act to extend until March 7, 2012, requirements that federal payments to states cover 100% of EUC. Amends the Unemployment Compensation Extension Act of 2008 to exempt weeks of unemployment between enactment of this Act and August 15, 2012, from the prohibition in the Federal-State Extended Unemployment Compensation Act of 1970 (FSEUCA of 1970) against federal matching payments to a state for the first week in an individual's eligibility period for which extended compensation or sharable regular compensation is paid if the state law provides for payment of regular compensation to an individual for his or her first week of otherwise compensable unemployment. (Thus allows temporary federal matching for the first week of extended benefits for states with no waiting period.) Amends the FSEUCA of 1970 to postpone similarly from December 31, 2011, to February 29, 2012, termination of the period during which a state may determine its "on" and "off" indicators according to specified temporary substitutions in its formula. Amends the Railroad Unemployment Insurance Act, as amended by the American Recovery and Reinvestment Act of 2009, the Worker, Homeownership, and Business Assistance Act of 2009, and the Tax Relief, Unemployment Insurance Reauthorization, and Job Creation Act of 2010, to extend through February 29, 2012, the temporary increase in extended unemployment benefits for employees with 10 or more years of service as well as for those with less than 10 years. Title III: Temporary Extension of Health Provisions -Amends title XVIII (Medicare) of the Social Security Act (SSA) to set the update to the single conversion factor in the formula for the physicians' fee schedules for the first two months of 2012 at zero (thus freezing the physician payment update for the first two months of 2012). Requires the conversion factor for the remaining portion of 2012 and subsequent years to be computed as if the zero update for the first two months of 2012 had never applied. Amends the Tax Relief and Health Care Act of 2006, as modified by other federal law, to extend section 508 hospital reclassifications for two months through November 30, 2011. ("Section 508" refers to Section 508 of the Medicare Modernization Act of 2003 [MMA], which allows the temporary reclassification of a hospital with a low Medicare area wage index, for reimbursement purposes, to a nearby location with a higher Medicare area wage index, so that the "Section 508 hospital" will receive the higher Medicare reimbursement rate.) Extends through February 29, 2012, the 1.0 floor on geographic indexing adjustments to the work portion of the physician fee schedule. Extends through February 29, 2012, the process allowing exceptions to limitations on medically necessary therapy caps. Amends the Medicare, Medicaid, and SCHIP Benefits Improvement and Protection Act of 2000 to extend until February 29, 2012, an exception to a payment rule that permits laboratories to receive direct Medicare reimbursement when providing the technical component of certain physician pathology services that had been outsourced by certain (rural) hospitals. Amends SSA title XVIII to extend the bonus and increased payments for ground ambulance services until March 1, 2012. Amends the Medicare Improvements for Patients and Providers Act of 2008 (MIPPA) to extend the payment of certain urban air ambulance services until February 29, 2012. Extends increased payments for super rural ambulance services until March 1, 2012. Amends MIPPA to extend the physician fee schedule mental health add-on payment provision through February 29, 2012. Extends through February 29, 2012, hold harmless provisions under the prospective payment system (PPS) for hospital outpatient department (OPD) services. Extends the minimum payment for bone mass measurement through the first two months of 2012. Amends SSA title XIX (Medicaid) to extend the Qualifying Individual (QI) Program through February 29, 2012, at specified allocations. xtends the Transitional Medical Assistance (TMA) Program through February 29, 2012. Amends part A (Temporary Assistance for Needy Families) (TANF) of SSA title IV to extend the TANF program through February 29, 2012. Title IV: Mortgage Fees and Premiums - Amends the Housing and Community Development Act of 1992 to require the Director of the Federal Housing Finance Agency (FHFA) to require each government-sponsored enterprise (GSE) (the Federal National Mortgage Association [Fannie Mae] and the Federal Home Loan Mortgage Corporation [Freddie Mac]) to charge a guarantee fee in connection with any guarantee of the timely payment of principal and interest on securities, notes, and other obligations based on or backed by mortgages on residential real properties designed principally for the occupancy of from one to four families. Requires the FHFA Director to prohibit a GSE from consummating any offer for a guarantee to a lender for mortgage-backed securities if: (1) the guarantee is inconsistent with the requirements of this Act; or (2) the risk of loss is allowed to increase, through the lowering of the underwriting standards or other means, for the primary purpose of meeting the requirements of this Act. Requires direct deposit into the Treasury of any amounts received from fee increases imposed by this Act that are necessary to comply with the minimum increase required by this Act. Requires the Director to require each GSE, as part of its annual report, to: (1) describe changes made to up-front fees and annual fees as part of the guarantee fees negotiated with lenders, changes to the riskiness of the new borrowers compared to previous origination years or book years, and any adjustments required to improve for future origination years or book years, in order to be in complete compliance with guarantee fee requirements; and (2) assess how the changes in such guarantee fees met the requirements of this title. Amends the National Housing Act with respect to requirements for each mortgage secured by a 1- to 4-family dwelling that is an obligation of the Mutual Mortgage Insurance Fund. Directs the Secretary of Housing and Urban Development (HUD), in addition to other required or authorized premiums, to establish and collect through FY2021 annual premium payments of up to 10 basis points of the remaining insured principal balance for any mortgage for which the Secretary collects an annual premium on the remaining insured principal balance. Title V: Other Provisions - Subtitle A: Keystone XL Pipeline - Directs the President, acting through the Secretary of State, to grant a permit for the Keystone XL pipeline project application filed on September 19, 2008. Waives such requirement if the President determines that the Keystone XL pipeline would not serve the national interest. Requires the President, in that case, to report to certain congressional committees and officials a justification for his determination, including consideration of economic, employment, energy security, foreign policy, trade, and environmental factors. Declares that a permit for such pipeline shall take effect by operation of law if after 60 days following enactment of this Act the President fails to: (1) determine that the Keystone XL pipeline would not serve the national interest, or (2) grant the permit. Subtitle B: Budgetary Provisions - Amends the Congressional Budget Act of 1974 to make it out of order in the Senate to consider a bill, resolution, amendment, motion, or conference report that includes an emergency designation. Permits waiver or suspension of such prohibition, or successful appeals from a ruling of the Chair, only by an affirmative vote of three-fifths (60 votes) of the Senate. Prohibits the budgetary effects of this Act from being entered on either PAYGO scorecard maintained pursuant to the Statutory Pay-As-You-Go Act of 2010.

Deems a foreign manufacturer or producer of products covered under this Act that registers an agent to consent to the personal jurisdiction of the state or federal courts of the state in which the agent is located for the purpose of any judicial proceeding. Requires any person who imports into the United States a covered product manufactured or produced outside the United States to make to the U.S. Customs and Border Protection (CBP) a declaration that, to the best of the person's knowledge, with respect to the importation of each covered product, the foreign manufacturer or producer of the product has registered an agent in the United States. Subjects to certain penalties an importer who fails to provide this or files a false declaration. Requires foreign manufacturers or producers of a covered product to report within five business days to the head of the applicable agency their determination to conduct a safety recall or other safety campaign of a covered product that is identical or substantially similar to a covered product offered for sale in the United States. Requires the Secretary of Agriculture and the Commissioner of Food and Drugs to study jointly the feasibility and advisability of requiring foreign producers of food distributed in commerce to register an agent in the United States who is authorized to accept service of process on behalf of such producers for the purpose of any state or federal regulatory proceeding or civil action in state or federal court. Requires the head of an applicable agency similarly to study the feasibility of methods requiring foreign manufacturers or producers of component parts of covered products distributed in U.S. commerce to register agents in the United States for purposes of such service of process. Requires the Comptroller General to study methods to enforce judgments of any state or federal regulatory proceeding or civil action in state or federal court against Chinese manufacturers that exported defective drywall to the United States during 2004-2007.

Requires such an employer to remain on the list for up to three years after each relocation. Makes such an employer ineligible for federal grants or federal guaranteed loans for five years after being added to the list, except where the employer demonstrates that a lack of such loan or grant would threaten national security, result in substantial job loss in the United States, or harm the environment. Requires the head of federal or state executive agency or military department, when awarding a civilian or defense-related contract, to give preference to a U.S. employer that does not appear on the list. Requires a business entity that initiates or receives a customer service communication to require each of its employees or agents participating in the communication to disclose their physical location at the beginning of each such communication unless all involved employees or agents are located in the United States. Exempts any communication: (1) initiated by a consumer if the consumer knows or reasonably should know that the employee or agent is located outside the United States, or (2) related to the provision of emergency services. Requires such a business entity, upon request, to transfer a customer to a customer service agent who is physically located in the United States. Authorizes the Federal Trade Commission (FTC) to exclude certain classes or types of business entities or customer services communications from the requirements of this Act under exceptionally compelling circumstances. Sets forth enforcement provisions.

Provides for the mailing of wine and beer sent by a licensed winery or brewery in accordance with the laws of the state, territory, or district where the addressee or agent takes delivery. Establishes in USPS the position of the Chief Innovation Officer who shall have proven expertise and success in the postal and shipping industry and in innovation, marketing, technology, and management. Establishes a Postal Innovation Advisory Commission. Requires the Postmaster General to report to Congress on a comprehensive strategy for maximizing USPS revenue through innovative postal and nonpostal products and services. Prohibits USPS from reducing the frequency of mail delivery to fewer than six days each week or from increasing the expected delivery time for market-dominant products.

Invest in American Jobs Act of 2011 - Revises Buy American requirements with respect to federal-aid highways, capital investment grants to support intercity passenger rail service (rail grants), and Amtrak, particularly the handling of waiver requests. Revises similar Buy American requirements with respect to public transportation, particularly rolling stock. Requires the cost of rolling stock components and subcomponents produced in the United States to increase from 60% in FY2012 by 10% annual increments up to 100% for FY2016 and ensuing fiscal years. Revises waiver requirements as well to mirror those for federal-aid highways. Applies the rail grant Buy American requirements under this Act to recipients of rail loans and loan guarantees with respect to railroad rehabilitation and improvement. Prescribes Buy American requirements for procurement of a facility or equipment under federal aviation programs similar to those for rolling stock. Requires the Secretary of Transportation (DOT) to report annually to Congress on: (1) each project for which a waiver of Buy American requirements was issued; and (2) the country of origin and product specifications for steel, iron, or manufactured goods acquired pursuant to each waiver. Amends the Federal Water Pollution Control Act to prescribe Buy American requirements for steel, iron, and manufactured goods used in the construction of a publicly owned wastewater treatment works. Adds similar Buy American requirements to the Public Works and Economic Development Act of 1965, with respect to economic development programs, and to the Robert T. Stafford Disaster Relief and Emergency Assistance Act, with respect to the Federal Emergency Management Agency (FEMA) Hazard Mitigation Grant Program. Declares that only a vessel owned by a U.S. citizen for which a certificate of documentation with a registry endorsement is issued may engage in support of exploration, development, or production of resources in, on, above, or below the exclusive economic zone (EEZ), or any other activity in the EEZ, to the extent that the regulation of such activity is not prohibited under customary international law. Exempts from this requirement any activities requiring either a coastwise endorsement or a fishery endorsement. Subjects to U.S. shipping law any vessels operating in the EEZ, to the extent that the regulation of such operation is not prohibited under customary international law. Directs the Secretary of the department in which the Coast Guard is operating to establish a program to provide Coast Guard personnel with the training necessary for implementation of U.S. shipping law in the EEZ.

Transit System Flexibility Protection Act of 2011 - Authorizes the Secretary of Transportation to make grants for the operating costs of equipment and facilities for use in public transportation systems as follows: (1) not exceeding 50 percent in systems that operate 75 or fewer buses during peak service hours in an urbanized area with a population of at least 200,000, and (2) not exceeding 25 percent in systems that operate a minimum of 76 buses and a maximum of 100 buses during peak service hours in such an urbanized area.

Sexual Assault Training Oversight and Prevention Act or STOP Act - Establishes a Sexual Assault Oversight and Response Council, composed mainly of civilians, as an independent entity from the chain of command of the Department of Defense (DOD). Directs the Council to: (1) appoint personnel to the Sexual Assault Oversight and Response Office, and advise such Office; (2) appoint the Director of Military Prosecutions (Director); (3) review each request of the Director with respect to a case stemming from a sexual-related offense that has been referred to a military appellate court or to the Department of Justice (DOJ); and (4) submit to the Secretary of Defense, Congress, and the Attorney General a report on each Director request for referral to a higher court. Requires the Council to advise on the development of sexual assault reporting protocols, risk-reduction and response training, and policy. Establishes within DOD the Sexual Assault Oversight and Response Office, headed by an Executive Director, to undertake specified duties and responsibilities relating to the investigation, prevention, and reduction of sexual assault incidents within the Armed Forces. Requires the Office to establish protocols to ensure that all reports of sexual assault are taken out of the chain of command and reported directly to the Office. Establishes the position of Director of Military Prosecutions, appointed by the Council, to have independent and final authority to oversee the prosecution of all sexual-related offenses committed by a member of the Armed Forces, and to refer such cases to trial by courts-martial. Amends the Duncan Hunter National Defense Authorization Act for Fiscal Year 2009 to require the Secretary to implement a centralized database, known as the Military Sexual Registry, for the collection of information regarding sexual assaults within the military, including the nature of the assault, the victim, the offender, and the outcome of associated legal proceedings. Requires the Registry to be housed and maintained within the Office.
