Consumer's Relocation Protection Act of 2003 - Authorizes States to exercise authority over motor carriers that engage in the intrastate transportation of household goods. Authorizes a State attorney general to bring a civil action against such a carrier in U.S. district court for injunctive relief and for a civil penalty. Directs the Secretary of Transportation to: (1) prescribe practices and procedures that ensure the fair and equitable treatment of individual shippers that utilize brokers of household goods; (2) establish a working group of State attorneys general, State consumer protection administrators, and Federal and local law enforcement officials; (3) establish a complaint handling system to log individual shipper informal complaints, an annual complaint database, and a procedure for public access to such data; and (4) require an annual report from each motor carrier and freight forwarder providing household goods transportation. Establishes civil and criminal penalties for holding household goods hostage (defined as refusing to relinquish a shipment upon payment of not more than 100 percent of a binding estimate for shipment plus the charges for additional services performed). Sets additional requirements for registration of motor carriers of household goods. Requires every motor carrier providing transportation of household goods to: (1) conduct a physical survey of the goods to be transported and provide the shipper with a written estimate of charges; and (2) prepare a written inventory of all articles tendered by an individual shipper and accepted by the carrier. Sets civil penalties for brokers violating this Act.

Amends the Public Health Service Act to remove language requiring, subject to certain provisions, health insurance issuers that offer health insurance coverage in the small group market in a State to accept every small employer that applies for such coverage.

Amends the National Defense Authorization Act for Fiscal Year 1996 to provide for the awarding of the Purple Heart to members held as prisoners of war before April 25, 1962, who were wounded while in captivity or who, while in captivity, were subjected to deprivation of food and medical treatment and to other forms of mistreatment. Requires the Secretary of the military department concerned to inform the former prisoner that historical information about the prison camp and other appropriate circumstances may be considered by the Secretary in evaluating an application for award of the Purple Heart and that the former prisoner may submit such information. Directs such Secretary to take into account the length of time that the award applicant was held in captivity to help determine whether the former prisoner was likely to have been wounded, starved, or denied medical treatment.

Prohibits the Secretary of Veterans Affairs from taking any action proposed under the Capital Asset Realignment for Enhanced Services initiative of the Department of Veterans Affairs: (1) unless the Secretary has notified Congress of the intention to take such action; and (2) until the later of the expiration of a 60-day period, or 30 days of continuous congressional session, after such notification.

John Marshall Commemorative Coin Act - Directs the Secretary of the Treasury: (1) to mint and issue not more than 400,000 silver one dollar coins emblematic of Chief Justice John Marshall and his contributions to the United States in commemoration of the 250th anniversary of his birth; and (2) in cooperation with the Legacy Fund of the Library of Congress, to develop and implement a marketing program to promote and sell the coins. Directs that all sales of coins minted under this Act include a ten dollar per coin surcharge, to be paid by the Secretary to the Supreme Court Historical Society for purposes of: (1) supporting historical research about the Supreme Court, the Constitution, and related topics; (2) supporting fellowship programs, internships, and docents at the Supreme Court; and (3) collecting and preserving related antiques, artifacts, and other historical items.

Backcountry Landing Strip Access Act - Prohibits either the Secretary of the Interior or the Secretary of Agriculture from taking any action which would permanently close or render or declare as unserviceable any aircraft landing strip located on Federal land under the respective jurisdiction, unless: (1) the head of the aviation department of each State in which the aircraft landing strip is located has approved such action; (2) notice of the proposed action has been published in the Federal Register; (3) a 90-day public comment period on the action has been provided; and (4) any comments received during the comment period have been taken into consideration by the Secretaries, as the case may be, and the appropriate State aviation department heads. Directs the Secretaries to: (1) adopt a nationwide policy for governing backcountry aviation issues related to the management of Federal land under their jurisdiction; and (2) require regional managers to adhere to it. Declares that a policy affecting air access to an aircraft landing strip located on Federal land (including any national policy required under this Act) shall not take effect unless certain conditions are met, including its statement that the FAA has the sole authority to control aviation and airspace over the United States.

Government Accountability and Streamlining Act of 2003 - Requires the Comptroller General, to the extent practicable, to prepare for public bills and joint resolutions (measures) reported by congressional subcommittees or committees, and submit to such subcommittees or committees, determinations of whether: (1) new Federal entities, programs, or functions are authorized by the measure; and (2) an existing entity or program carries out functions that are similar to those authorized by the measure and such existing entity or program may more effectively and efficiently perform the functions and carry out the purposes of the measure than the proposed entity or program. Requires such statements to accompany reports on legislation.

Home School Non-Discrimination Act of 2003 - Expresses the sense of the Congress that parents who choose private home education should be encouraged within the framework provided by the Constitution. Amends the Higher Education Act of 1965 (HEA) with respect to: (1) student aid eligibility of home-schooled students who have satisfied certain secondary education standards; and (2) institutional aid eligibility of the higher education institutions that such students attend. Amends the Individuals with Disabilities Education Act (IDEA) to provide, if a parent does not consent to an initial evaluation or special education or related services for a child with a disability, the local educational agency shall not be required to convene an individualized education program (IEP) meeting or develop an IEP for such child. Amends the Internal Revenue Code with respect to qualified elementary and secondary education expenses (the Coverdell Education Savings Account) to include home schools if they are treated as a home school or private school under State law. Amends the part of the General Education Provisions Act known as the Family Educational Rights and Privacy Act of 1974 to prohibit release of certain information on and educational records of students in non-public education, including any student educated at home or in a private school in accordance with State law, without written parental consent. Amends HEA to include students at home schools, whether treated as a home school or a private school under State law, among those prospective secondary school graduates eligible to apply for the Robert C. Byrd Honors Scholarship Program for higher education. Amends the Fair Labor Standards Act of 1938 to direct the Secretary of Labor to extend the hours and periods of permissible employment of employees between the ages of 14 and 16 years who are privately educated at a home school, whether the home school is treated as a home school or a private school under State Law, beyond those hours and periods applicable to employees of such ages who are educated in traditional public schools. (Thus allows home-school students to be employed during the traditional school day.)

Air Line Pension Act of 2003 - Sets forth special funding requirements for certain pension plans maintained by commercial passenger air carriers (plans), notwithstanding any contrary provisions of the Internal Revenue Code or of the Employee Retirement Income Security Act of 1974 (ERISA). Provides for such plans, if they have a funded percentage of less than 80 percent as of January 1, 2003, the following: (1) modifications of funding rules, including funded percentage, assumed interest rate for determining current liability, and estimation of current liability; (2) a moratorium on the deficit reduction contribution, under specified conditions; (3) a one-time amortization of 2008 unfunded current liability; and (4) recognition of a waiver in the deficit reduction contribution. Provides for such plans, if they are maintained for benefit of the carrier's employees pursuant to a collective bargaining agreement and if they terminated during calendar year 2003, the following: (1) restoration by the Pension Benefit Guaranty Corporation (PBGC) to the plan's pre-termination status and transfer of control of plan assets and liabilities to the employer, unless the collective bargaining agreement provides that the plan should not be restored; (2) exclusion of any expected increase in current liability due to benefits accruing during each plan year; (3) amortization of unfunded amounts under the restoration payment schedule; (4) inapplicability of certain contribution requirements to a restored plan until a plan year beginning on the initial post-restoration valuation date, with modified required annual payments; and (5) resetting of funding standard account balances. Limits PBGC liability with respect to certain plans under this Act.

Amends the Internal Revenue Code to provide that if a taxpayer is a member of an affiliated group of corporations which files a consolidated return, the tax attributes concerning reduction of tax attributes and exclusion from gross income by reason of discharge of indebtedness shall be the aggregate tax attributes of such group.

Terminates a provision that requires the Secretary of Transportation to ensure that all laborers and mechanics employed by contractors or subcontractors on the construction work performed on Federal-aid highway projects are paid prevailing rate wages. Permits a State to enact a law to provide for continued enforcement of the requirements of such provision in that State.

Clear Law Enforcement for Criminal Alien Removal Act of 2003 or the CLEAR Act of 2003 - States that: (1) State and local law enforcement personnel are fully authorized to investigate, apprehend, or remove aliens in the United States (including interstate transportation of such aliens to detention centers) in the enforcement of U.S. immigration laws; and (2) a State that does not have a statute permitting enforcement of Federal immigration laws within two years of enactment of this Act shall not receive certain Federal incarceration assistance. Amends the Immigration and Nationality Act with respect to illegal aliens to: (1) establish criminal penalties and forfeiture for aliens unlawfully present in the United States; (2) increase specified criminal and civil penalties for illegal entry and failure to depart violations; and (3) provide for payment of funds from certain civil penalties to State and local law enforcement agencies for apprehension of such aliens. Provides for the listing of immigration violators in the National Crime Information Center database. Requires States and localities to provide the Department of Homeland Security with specified information about apprehended illegal aliens. Eliminates certain Federal incarceration assistance for noncompliance. Directs the Attorney General to make grants to local police agencies for equipment and facilities related to housing and processing illegal aliens. Amends the Act to provide for Federal custody and State or local compensation of State or locally apprehended illegal aliens. Establishes a process for State and local claims against the Federal Government for failure to cooperate in enforcing immigration laws. Directs the Secretary or the Attorney General to establish immigration-related training for State and local personnel. Provides: (1) personal liability immunity for Federal, State, or local personnel enforcing immigration laws within the scope of their duties; and (2) civil rights money damage immunity for Federal, State, or local agencies enforcing immigration laws unless their personnel violated criminal law in such enforcement. States that the Department of Justice and the Department of Homeland Security shall continue to operate the Institutional Removal Program, which shall be expanded to all States.

Fair and Accurate Credit Transactions Act of 2003 - Amends the Fair Credit Reporting Act (FCRA) to extend Federal preemption to State law enacted after January 1, 2004, that declares explicitly that it is intended to supplement the FCRA and grant greater protection to consumers than is provided under Federal law. (Thus repeals the protection from Federal preemption granted to more stringent State consumer protection laws). Sets forth measures to address identity theft prevention, including: (1) credit card issuer responsibility to investigate cardholder change of address; and (2) truncation of credit and debit card account numbers. Places an affirmative duty upon a consumer reporting agency to: (1) make notification of fraud alert; (2) provide a summary of rights to identity theft victims; and (3) block information resulting from identity theft. Directs the Federal banking agencies to establish procedures for depository institutions to identify possible instances of identity theft. Instructs the Federal Trade Commission to prescribe rules for coordination of consumer complaint investigations. Requires a consumer reporting agency to take specified actions to reconcile discrepancies pertaining to a consumer address. Prohibits furnishing information to a consumer reporting agency that is known to include identity theft activity. Repeals limitations attached to mandatory free annual credit report disclosures that are furnished upon consumer request. Requires a consumer reporting agency, when fulfilling a consumer request for all information in the consumer's file, to include a summary of how any individual consumer credit score was derived and how it might be improved. Excludes from FCRA consumer disclosure requirements certain communications pertaining to employee misconduct investigations.

Medicare for the 21st Century Act - Amends title XVIII (Medicare) of the Social Security Act to add a new part D (Voluntary Medicare Outpatient Prescription Drug Discount and Security Program). Directs the Secretary of Health and Human Services to establish a Medicare Outpatient Prescription Drug Discount and Security Program under which an eligible beneficiary who voluntarily enrolls in such program is provided: (1) access to negotiated prices through an eligible entity with a contract under the program that has been selected by the beneficiary; (2) catastrophic coverage under the program; and (3) a prescription drug account and a public contribution into such account. Provides that, in estimating the benefits and administrative costs which will be payable from the Federal Supplementary Medical Insurance Trust Fund for a year for purposes of determining the monthly premium rate under Medicare part B (Federal Supplemental Medical Insurance), the Secretary shall exclude an estimate of any benefits and administrative costs attributable to application of the new part D program. Amends SSA title XIX (Medicaid) to provide for verification of eligibility for benefits under the new part D program.

United States Agricultural Products Market Access Act of 2003 - Amends the Trade Act of 1974 to direct the United States Trade Representative (USTR) to identify those foreign countries that: (1) deny fair and equitable market access to U.S. agricultural products or apply standards for the importation of U.S. agricultural products that are not related to public health concerns or cannot be substantiated by reliable analytical methods; and (2) are determined by the USTR to be priority foreign countries. Limits the identification of priority foreign countries to those that engage in the most onerous or egregious acts which have the greatest adverse impact on the relevant U.S. products. Provides that if available information indicates that such action is appropriate, the USTR may at any time: (1) revoke the identification of any foreign country as a priority foreign country; or (2) identify any foreign country as a priority foreign country. Provides funding for additional staff for the Office of the Assistant U.S. Trade Representative for Agricultural Affairs and Office of the Assistant U.S. Trade Representative for Monitoring and Enforcement. Requires the U.S. Trade Representative to initiate an investigation (without waiting for a petition by an interested person) regarding any act, policy, or practice of a priority foreign country identified under this Act.

Secondary Mortgage Market Enterprises Regulatory Improvement Act - Amends the Home Owners' Loan Act to rename the Office of Thrift Supervision as the Office of Housing Finance Supervision. Amends the Housing and Community Development Act of 1992 to transfer supervisory and regulatory authority over specified government sponsored enterprises (Fannie Mae and Freddie Mac) to the Director of the Office of Housing Finance Supervision from the Office of Federal Housing Enterprise Oversight of the Department of Housing and Urban Development (HUD) and from the Secretary of Housing and Urban Development. Requires the Director to ensure that the enterprises operate in a financially safe manner and remain adequately capitalized. Sets forth operating, administrative, and regulatory provisions, including: (1) public disclosure of information; (2) assessment authority; (3) authority to limit nonmission-related assets and set specified conforming loan limits; (4) establishment of a housing price index; (5) minimum and critical capital levels; (6) risk-based capital test; (7) capital classifications and undercapitalized enterprises; (8) receivership; (9) enforcement actions and penalties; and (10) reporting. Sets forth retained and new authorities of the Secretary. Abolishes the Office of Federal Housing Enterprise Oversight. Sets forth related transfer of personnel and facility and property provisions.

American Wetland Restoration Act - Amends the Federal Water Pollution Control Act to authorize the Secretary of the Army to issue mitigation bank (specified wetland resource restoration, creation, or enhancement projects or projects consisting solely of preservation of wetlands chartered by the Secretary for purposes of providing mitigation credits to offset wetland losses authorized by permits allowing activities in U.S. waters) charters. Authorizes a mitigation bank, upon receipt of its charter, to offer mitigation credits for sale and to provide compensatory mitigation for activities requiring authorization under the Act or provide required injunctive relief in an enforcement action by the Secretary or the Administrator of the Environmental Protection Agency. Directs the Secretary and the Administrator to establish standards and criteria applicable to the use of on-site mitigation, in lieu fees, and other off-site mitigation as compensatory mitigation that are similar to those applicable to a mitigation bank. Allows a State that operates an approved program regulating the discharge of dredged or fill material into navigable waters to administer a wetland mitigation banking program in accordance with State procedures if such banking program is approved by the Administrator as part of the State's dredged or fill material program.

Directs the Secretary of Defense to permit a former member of the armed forces who is entitled to compensation for a service-connected disability rated as total to travel on unscheduled military flights within the continental United States and on scheduled overseas flights operated by the Air Mobility Command to the same extent as retired members of the armed forces.

Veterans Health Care Full Funding Act - Requires each fiscal year budget submitted to Congress by the President to include requests for amounts for veterans health care programs. Requires amounts appropriated for such programs to be available for two consecutive fiscal years. Establishes the Veterans Health Care Funding Review Board within the Department of Veterans Affairs. Directs the Board, beginning with FY 2005, to determine the level of funding needed for such programs for that fiscal year and the next and to publish such determination in the Federal Register. Outlines veterans' health care needs factors to be considered by the Board in arriving at such determination. Repeals requirements for certain congressional notifications in connection with a funding request for a Department major medical facility project or lease. Provides a 30-day standard for access to medical care for veterans seeking primary or specialized care, as measured from: (1) the time the veteran contacts the Department seeking an appointment until the date a visit is completed (primary care); and (2) the date on which the veteran is referred to a specialist until the date a visit is completed (specialty care). Directs the Secretary of Veterans Affairs to develop a standard of waiting time during a visit and to periodically review the performance of Department facilities compared to that standard.

Parent's Right to Know Act of 2003 - Prohibits making available any funds appropriated for carrying out title X of the Public Health Service Act (Population Research and Voluntary Family Planning Programs) to any family planning project under specified provisions of that title if any service provider in the project knowingly provides contraceptive drugs or devices to a minor, unless: (1) the minor is emancipated; (2) by court direction; (3) the provider has given actual written notice to the custodial parent or guardian five days in advance; or (4) the minor has written consent of a custodial parent or guardian.

Death Tax Repeal Permanency Act of 2003 - Declares that the sunset provisions of the Economic Growth and Tax Relief Reconciliation Act of 2001 shall not apply to Title V: Estate, Gift, and Generation-skipping Transfer Tax Provisions of such Act. (Makes the repeal of estate and generation-skipping taxes under the Internal Revenue Code, and certain reductions of the gift tax, permanent.)

Mutual Funds Integrity and Fee Transparency Act of 2003 - Directs the Securities and Exchange Commission (SEC) to require mutual funds to disclose specified costs in their periodic reports to shareholders. States that a disclosure shall not be considered to be made in an appropriate disclosure document if it is made exclusively in a prospectus or statement of additional information. Amends the Investment Company Act of 1940 to require each investment adviser to a registered investment company to report at least annually to such company's board of directors regarding specified payments, services and research services. Imposes a fiduciary duty upon company boards of directors to: (1) supervise and determine that an investment adviser's direction of the company's brokerage transactions serves the best interests of company shareholders; (2) supervise revenue sharing arrangements to ensure compliance with this Act; and (3) determine that revenue sharing arrangements serve the best interests of company shareholders. Reduces from sixty percent to one-third the number of "interested persons" who may serve as board members of a registered company. Prohibits an "interested person" from serving as chairman of the board of a registered company. Revises accountant selection criteria to: (1) mandate accountant selection by the audit committee of a registered company; (2) confer direct responsibility upon the audit committee for appointment, compensation, and oversight of the independent public accountant employed to prepare or issue the audit report; (3) require such independent public accountant to report directly to the audit committee; and (4) require each audit committee member to be a member of the board of directors, and to otherwise be independent. Directs the SEC to study and report to specified congressional committees on the use of soft dollar arrangements by investment advisers.

Pharmaceutical Market Access Act of 2003 - Amends the Federal Food, Drug and Cosmetic Act to direct the Secretary of Health and Human Services to promulgate regulations allowing qualifying individuals to import covered products (in addition to pharmacists and wholesalers, whom current law authorizes to import such products). Amends provision pertaining to record keeping regarding imported covered products. States that the Secretary shall not have to store records in cases in which qualifying individuals have imported a covered product. Amends provisions regarding the testing of imported covered products. Declares that specified tests, including ones involving authenticity and degradation of products, shall not be required unless the importer is a wholesaler. Requires such tests to be conducted by the importer unless a product is a prescription drug subject to the provisions of this Act pertaining to counterfeit-resistant packaging. (Currently either the importer or the manufacturer may conduct such tests). Eliminates the sunset date current law establishes for the provisions pertaining to the importation of covered products. Classifies prescription drugs as misbranded if they do not incorporate specified counterfeit -resistant technologies in packaging.

Theodore Roosevelt Commemorative Coin Act - Directs the Secretary of the Treasury to mint and issue not more than: (1) 500,000 $1 coins with the image of Theodore Roosevelt as a Rough Rider on one side and an eagle design on the other side; and (2) 500,000 $1 coins with the image of Roosevelt on horseback on one side and a flaming sword of righteousness on the other side. Calls for the coins to be struck at the U.S. Mint at West Point, New York. Authorizes the Secretary to issue such minted coins beginning on January 1, 2006, and to initiate coin sales before such date (2006 will mark the 100th anniversary of Roosevelt receiving the Nobel Peace Prize). Requires surcharges from the sale of the coins to be paid to the Theodore Roosevelt Association to be used exclusively for educational programs at Sagamore Hill National Historic Site, including for construction and maintenance of a visitor's center.

Shrimp Importation Financing Fairness Act - Prohibits the Secretary of Commerce from imposing any new restrictive regulations on the domestic shrimping industry. Prohibits the Overseas Private Investment Corporation from issuing any contract of insurance or reinsurance or any guaranty, or from entering into any agreement to provide financing for a project undertaken or to be undertaken in a country which exported more than 20 million pounds (excessive amounts) of shrimp to the United States in the first six months of 2002, until three months after it has reduced its shrimp exports to less than three million pounds per month for three consecutive months. Requires the Secretary of the Treasury to instruct the U.S. Executive Director at the International Monetary Fund to use the voice, vote, and influence of the United States to oppose providing assistance to any foreign country that exported excessive amounts of shrimp to the United States in the first six months of 2002, until it fulfills the reduction requirements of this Act. Authorizes the Secretary to reduce the amount of U.S. contributions to the Fund according to a specified formula if, during the first such three-month period, the Fund provides assistance to any such country. Prohibits the Export-Import Bank of the United States from providing assistance to any country that exported excessive amounts of shrimp to the United States in the first six months of 2002, until it fulfills the reduction requirements of this Act.

Guardsmen and Reservist Employer Tax Act of 2003 - Amends the Internal Revenue Code to provide a reserve component employment credit equal to the sum of the employment credit with respect to all qualified employees of the taxpayer and the self-employment credit of a qualified self-employed taxpayer. Limits the credit to $25,000 for each qualified employee. Disallows the credit for failure to comply with reserve member employment or reemployment rights, or when a reserve member is called or ordered to active duty for training.

Children's Hope Act of 2003 - Amends the Internal Revenue Code to provide for a credit ($100, $200 for joint return) which is dependent on enactment of State qualified scholarship tax credits and which is allowed against the Federal income tax for charitable contributions to education investment organizations (as defined by this Act) that provide qualifying assistance for elementary and secondary education. Excludes from gross income amounts received from an education investment organization for qualified elementary and secondary education expenses.

Establishes a standard for access to care for veterans seeking care from the Department of Veterans Affairs of 30 days from the date the veteran contacts the Department seeking an appointment until the date on which a visit with a primary care provider is completed, or 30 days from the date on which the veteran is referred for specialty care until that date on which a visit with an appropriate specialty care provider is completed. Directs the Secretary to develop and disseminate an appropriate standard of waiting time between the time a veteran's visit is scheduled and the time the veteran is seen by the provider. Requires periodic review of the performance of Department facilities compared to that standard. Requires the Secretary, when unable to meet the standard for access to care, to furnish health care and services for that veteran in a non-Department facility.

Health Savings Account Availability Act - Amends the Internal Revenue Code to allow a deduction to individuals (both itemizers and nonitemizers) in high deductible health plans for contributions to health savings accounts. Limits monthly contributions to an account to one-twelfth of the annual deductible. Defines a high deductible plan and a health savings account. States that a plan or other arrangement shall not fail to be treated as a cafeteria plan solely because qualified benefits under such plan include a health flexible spending arrangement under which not more than $500 of unused health benefits may be: (1) carried forward to the succeeding plan year of such health flexible spending arrangement; or (2) contributed on behalf of an employee to a qualified retirement plan, an eligible deferred compensation plan, or a health savings account.

Assured Funding for Veterans Health Care Act of 2003 - Requires the Secretary of the Treasury to make available to the Secretary of Veterans Affairs for programs, functions, and activities of the Veterans Health Administration for FY 2005 130 percent of the amount obligated during FY 2003. Adjusts the amount provided for fiscal years after FY 2005 based on the number of enrolled veterans and the number of other persons eligible but not enrolled who are provided care, multiplied by the per capital baseline amount for FY 2003, as increased by the percentage increase in the Consumer Price Index. Prohibits the availability of such funds for: (1) construction, acquisition, or alteration of veterans' medical facilities (other than for repairs provided for before the date of enactment of this Act); or (2) grants for the construction of State home facilities for the furnishing of veterans' domiciliary, nursing home, and hospital care.

Social Security Earnings Limit Repeal Act of 2003 - Amends title II (Old Age, Survivors and Disability Insurance) (OASDI) of the Social Security Act to repeal the limitation on the amount of outside income which beneficiaries who have attained age 62 may earn (earnings test) without incurring a reduction in benefits.

Amends the United Nations Participation Act of 1945 to bar the use of Department of State funds to pay the U.S. share of assessed contributions for the United Nations regular budget in an amount greater than the largest assessed contribution of any other permanent member country of the United Nations Security Council (currently, an amount greater than 22 percent of the total of all assessed contributions).

Government Labor Neutrality Act of 2003 - Amends the National Labor Relations Act to prohibit Federal, State, and local governments from either requiring or prohibiting an agreement with a labor organization by an employer in the construction industry in connection with any construction, alteration, painting, or repair work. Applies such prohibition to Federal agencies or departments, agents acting on the Federal Government's behalf, recipients of Federal grants or financial assistance, persons who have entered into cooperative agreements with the Federal Government, and State or local governments.

Highway Funding Equity Act of 2003 - Revises Federal highway funding minimum guarantee provisions. Requires the Secretary of Transportation, for each of FY 2004 through 2009, to allocate among the States amounts sufficient to ensure that: (1) the percentage for each State of the total apportionments for the fiscal year for the National Highway System (NHS), the high priority projects program, the Interstate maintenance program, the surface transportation program, metropolitan planning, the highway bridge replacement and rehabilitation program, the congestion mitigation and air quality improvement program, the recreational trails program, the Appalachian development highway system, and the basic minimum guarantee equals or exceeds 95 percent of the ratio that the estimated tax payments to the Highway Trust Fund (HTF) (other than the Mass Transit Account) attributable to highway users in the State bears to such payments attributable to highway users in all States (with a specified exception for any State having a population density of less than 50 individuals per square mile); and (2) when HTF allocations (other than from the Mass Transit Account, for such programs, emergency relief, and the discretionary minimum guarantee) for the fiscal year have been identified, the percentage for each State of all of those allocations for the fiscal year equals or exceeds the percentage that is equal to 95 percent of such tax payments ratio. Sets forth provisions regarding: (1) the programmatic distribution of NHS funds exceeding $2.8 billion; (2) the apportionment of the remainder of funds to the States; and (3) required adjustments where the sum of State percentages exceeds 100.

Constitutional Amendment - Declares that marriage in the United States shall consist only of the union of a man and a woman. Prohibits the Constitution or any State constitution, or State or Federal law from being construed to require that marital status or its legal incidents be conferred upon unmarried couples or groups.

Amends the Immigration and Nationality Act prohibit the admission of an intracompany transferee (L visa) nonimmigrant alien unless the employer has filed with the Secretary of Labor an application stating that the employer will not place such alien with another employer where: (1) such alien performs duties in whole or in part at one or more worksites owned, operated, or controlled by such other employer; and (2) there are indicia of an employment relationship between such alien and such other employer. Sets forth related requirements of the Secretary respecting such aliens.

Cosmetology Tax Fairness and Compliance Act of 2003 - Amends the Internal Revenue Code to extend the tax credit for social security taxes paid for employee cash tips to employers of cosmetologists. Requires employers of cosmetologists to report income and tips of their cosmetologist employees and to provide income and tip information to self-employed cosmetologists to whom they pay more than $600 in the taxable year. Imposes similar reporting requirements upon individuals who rent chairs to cosmetologists. Requires such employers to provide their cosmetologist employees and self-employed cosmetologists with information on the tax and tip reporting obligations of employees and self-employed individuals.

Law Enforcement Officers Due Process Act of 2003 - Authorizes the Attorney General to provide grants to law enforcement agencies (agencies) that: (1) have in effect an administrative process or an existing procedure that complies with officer rights requirements; or (2) certify that they will establish, within two years, an administrative process that complies with such requirements. Requires the administrative process to require that an agency that investigates an officer for matters which could reasonably lead to disciplinary action provide recourse for the officer that includes: (1) access to any existing administrative process established by the employing agency prior to disciplinary action; and (2) the right to a hearing before a fair and impartial board or hearing officer, to be represented by an attorney or other officer at such officer's expense, to confront any witness testifying against such officer, and to record all meetings. Permits the immediate suspension with pay of an officer: (1) whose continued presence on the job is considered to be a substantial and immediate threat; (2) who refuses to obey a direct order issued in conformance with the agency's written and disseminated rules and regulations; or (3) who is accused of committing an illegal act. Makes this Act inapplicable to an agency if the Attorney General determines that such agency has in effect an established civil service system, agency review board, grievance procedure, or personnel board which meets or exceeds the minimum standards set forth in this Act.

Long-Term Care and Retirement Security Act of 2003 - Amends the Internal Revenue Code to allow: (1) a deduction (increasing percentages with full deductibility as of 2008) for eligible long-term care insurance premiums for a taxpayer, spouse, and dependents and (2) long-term care insurance to be offered under cafeteria plans and flexible spending arrangements. Allows an income-adjusted (limited) credit for eligible individuals with long-term care needs. Sets forth specified requirements for qualifying long-term care insurance contracts. Treats an exchange of qualified long-term care insurance contracts as a disposition of property for which no gain or loss is recognized.

Preservation of Localism, Program Diversity, and Competition in Television Broadcast Service Act of 2003 - Amends the Communications Act of 1934 to prohibit the Federal Communications Commission from permitting any license for a commercial television broadcast station to be granted, transferred, or assigned to any party if such action would result in that party owning, operating, controlling, or having a cognizable interest in stations which have an aggregate national audience reach exceeding 35 percent. Requires any party currently having licenses in excess of such limit to divest as necessary to comply with such limit within one year.

Amends Federal law to increase from 100 to a minimum of 110 the number of free roaming horses the Secretary of the Interior is required to permit in Cape Lookout National Seashore, North Carolina, with a target population of between 120 and 130.

Ten Commandments Defense Act of 2003 - Declares the following : (1) that the power to display the Ten Commandments on or within property owned or administered by the several States or their political subdivisions is among the powers reserved to the States respectively (under the Tenth Amendment of the U.S. Constitution); (2) that the expression of religious faith by individual persons on or within property owned or administered by the several States or their political subdivisions is among the rights secured (under the First Amendment) against laws respecting an establishment of religion or prohibiting the free exercise of religion made or enforced by the Federal Government; and (3) that the expression of religious faith by individual persons on or within property owned or administered by the several States or their political subdivisions is among the liberties of which no State shall deprive any person without due process of law made in pursuance of powers reserved to the States respectively.

Pledge Protection Act of 2003 - Amends the Federal judicial code to deny jurisdiction to any court established by Act of Congress to hear or determine any claim that the recitation of the Pledge of Allegiance violates the first amendment of the Constitution.

Identity Theft and Financial Privacy Protection Act of 2003 - Amends the Truth in Lending Act to prescribe duties imposed upon: (1) a card issuer with respect to confirmation of a consumer's changes of address; and (2) a consumer reporting agency with respect to notice of potential fraud. Amends the Fair Credit Reporting Act to prescribe duties imposed upon a consumer reporting agency with respect to notice of potential fraud. Exempts from such requirements: (1) certain consumer reporting agencies acting as resellers of information; (2) certain check services companies; and (3) certain demand deposit account information service companies. Mandates truncation of credit card and debit card account numbers. Requires a consumer reporting agency to furnish, upon consumer request, a free annual disclosure of the information in the consumer's file.
