Climate Change Financial Risk Act of 2019 This bill addresses climate change risk and its potential impact on the financial system. The Federal Reserve Board must develop financial risk analyses relating to climate change for specified large nonbank financial companies and bank holding companies. Specifically, these entities will be evaluated every two years on whether they have the capital necessary to absorb financial losses that would arise under several different climate change risk scenarios. The bill also establishes the Climate Risk Scenario Technical Development Group to provide recommendations to the board regarding such climate change risk scenarios, and determine the financial and economic risks of these scenarios. The Financial Stability Oversight Council of the Department of the Treasury must establish a subcommittee to assist it in identifying risks and responding to threats to the financial system as a result of climate change.

Birth Access Benefiting Improved Essential Facility Services Act or the BABIES Act This bill requires the Centers for Medicare & Medicaid Services (CMS) to establish a Medicaid demonstration program to improve freestanding birth center services for women with low-risk pregnancies. Among other things, the CMS must (1) publish criteria for freestanding birth centers to participate in the program, including specified accreditation, licensure, and service requirements; (2) publish guidance for states to establish prospective payment systems under Medicaid for program participants; and (3) award planning grants for states to develop program proposals. The CMS may choose up to six states to participate in the program.

Humane Cosmetics Act of 2019 This bill generally prohibits animal testing in the evaluation of cosmetic products, and it prohibits the sale or transport of cosmetics developed using animal testing. These prohibitions begin one year after enactment.

Open Skies Treaty Stability Act This bill prohibits the President from suspending, terminating, or withdrawing the United States from the Open Skies Treaty, unless the Department of Defense and the Department of State jointly certify to Congress that (1) Russia is in material breach of the treaty and is not taking steps to return to compliance, (2) withdrawal from the treaty is in the best interests of U.S. national security, (3) there is a comprehensive strategy to mitigate against reduced military transparency, and (4) other countries that are party to the treaty have been consulted as to Russia's breach and U.S. intentions to withdraw. (The treaty allows participating countries to fly unarmed observation aircraft over each other's territory and places various limits and requirements on such flights.)

Southern New England Regional Commission Act This bill establishes the Southern New England Regional Commission. (Federal regional commissions address perceived regional economic underdevelopment.) The commission is given the same structure and duties as the Southeast Crescent Regional Commission, Southwest Border Regional Commission, and Northern Border Regional Commission. The bill authorizes those commissions, in addition to their current authorities, to (1) support the maritime economy, (2) assist in developing defense manufacturing industries, and (3) promote the adoption of innovative materials in public transportation.

Ban Corporate PACs Act This bill prohibits for-profit corporations from establishing a separate segregated political fund. Existing funds must terminate and disburse their entire balance not later than one year after the enactment of this bill.

Put Patients First Act This bill prohibits the application of the rule issued by the Department of Health and Human Services on May 21, 2019, that strengthens the enforcement of conscience and anti-discrimination laws related to the rights of covered health care providers to refuse to participate in certain procedures, such as abortions, sterilization, or assisted suicide.

This joint resolution eliminates the deadline for the ratification of the Equal Rights Amendment, which prohibits discrimination based on sex. The amendment was proposed to the states in House Joint Resolution 208 of the 92nd Congress, as agreed to in the Senate on March 22, 1972. The amendment shall be part of the Constitution whenever ratified by the legislatures of three-fourths of the states.

Schedules That Work Act This bill provides employees with the right to request changes to their work schedules related to the number of hours they are required to work or be on call, the location of the work, the amount of notification about work schedule assignments, and fluctuations in work hours. Employers must negotiate in good faith with employees who make such requests and comply with certain work schedule notice and split shift pay requirements for retail, food service, cleaning, hospitality, or warehouse employees.

New Deal for New Americans Act of 2019 This bill provides assistance to immigrants and addresses issues related to naturalization. The bill establishes the National Office of New Americans to promote and support immigrant integration and encourage the pursuit of U.S. citizenship among immigrants. The bill also establishes grant programs for eligible entities that provide (1) legal services for immigrants, (2) English language education that focuses on integrating students into society, and (3) workforce development training that supports the economic integration of immigrants. The bill also reauthorizes the Citizenship and Integration Grant Program within U.S. Citizenship and Immigration Services (USCIS). USCIS may establish a nonprofit entity to spur innovation in the expansion of citizenship preparation programs and to support assistance for immigrants seeking permanent resident status or citizenship. The bill also requires the Department of Homeland Security to (1) report to Congress before increasing fees for immigration adjudication and naturalization services above the levels of such fees on January 1, 2019, and (2) waive or reduce certain immigration-related fees for low-income aliens. The bill also (1) waives the English proficiency requirement for the naturalization of certain permanent residents, (2) repeals the public charge ground for deportation, (3) requires states to provide for automatic voter registration to qualifying new citizens unless that individual declines, and (4) sets a floor of 110,000 to the maximum number of refugees who may be admitted into the United States each year.

Protecting Our Conserved Lands Act of 2019 This bill prohibits the use of eminent domain to acquire certain land or property to construct, operate, or maintain a natural gas pipeline, including land that is subject to a conservation easement or other conservation-related restriction by a local government or nonprofit entity.

Veteran Deportation Prevention and Reform Act This bill modifies immigration and naturalization procedures for noncitizens who are members or veterans of the Armed Forces. Specifically, the bill requires interagency coordination to (1) identify such individuals who are the subject of immigration removal proceedings or who have already been removed; and (2) naturalize them as citizens or otherwise change their status, as appropriate.

FEMA Climate Change Preparedness Act This bill requires the Federal Emergency Management Agency (FEMA) to (1) revise its 2018-2022 Strategic Plan to ensure that the plan explicitly mentions climate change and addresses the implications of climate change on homeland security and near- and long-term national disaster risk; and (2) ensure that future strategic plans do likewise. The Department of Homeland Security must establish, as a subcommittee of the National Advisory Council, the Climate Change Subcommittee, which shall advise FEMA on how to best incorporate climate change, including risk assessments and strategies for adaptation and mitigation, into and throughout FEMA's policies, plans, programs, and operations. FEMA must publish as a report, submit to specified congressional committees, and make available to Congress and the public, a comprehensive assessment of climate change risks and preparedness.

Alice Cogswell and Anne Sullivan Macy Act This bill expands special education and related services for students who are deaf or hard of hearing, for students with visual disabilities, and for children and youth who are deaf-blind. The individualized education program for each child who is visually and/or hearing impaired must include specified components and must provide the child with instruction that meets the child's unique learning needs. In addition, a state's closure of a special school serving deaf or blind children shall count as a reduction of its financial support for special education and related services. Among other provisions, the bill authorizes support, including grants for training special education personnel, to be used in preparing individuals to become qualified teachers and early intervention specialists for children with hearing disabilities. The bill establishes within the Department of Education the Anne Sullivan Macy Center on Visual Disability and Educational Excellence to better support students with visual disabilities.

Safe at Home Act This bill requires each executive agency and federal court to accept, for any purpose for which an individual is required to provide an address to the agency or court, an address designated to that individual pursuant to an address confidentiality program (e.g., a program to protect stalking or domestic violence victims).

Take Unsafe Limos Off the Road Act This bill directs the Department of Transportation to award grants to states that have enacted and are enforcing laws that require the impoundment or immobilization of stretch limousines if such limousines are found to have certain defects upon inspection.

Safety, Accountability, and Federal Enforcement of Limos Act of 2019 or the SAFE Limos Act This bill establishes safety standards for stretch limousines. Among other requirements, the bill requires safety belts to be installed in stretch limousines with a gross vehicle weight rating greater than 8,500 pounds at each designated seating position, including on side-facing seats; the Department of Transportation (DOT) to develop and issue guidelines, best practices, and recommendations to assist stretch limousine alterers develop and administer a vehicle modifier plan; DOT to complete research into side impact protection, roof crush resistance, and air bag systems for the protection of occupants in stretch limousines given alternative seating positions or interior configurations, including perimeter seating arrangements; stretch limousine operators to disclose (1) the date of the most recent inspection of the limousine required under state or federal law, (2) the results of the inspection, and (3) any corrective actions taken to ensure the limousine passes inspection; and the use of event data recorders in stretch limousines.

Protect Against Conflict by Turkey Act or the PACT Act This bill imposes sanctions and various restrictions related to Turkey's military invasion of northern Syria. The President shall impose visa- and asset-blocking sanctions on specific Turkish officials connected to the invasion, including Turkey's Minister of National Defense. The Department of State shall report to the President and Congress as to (1) other Turkish officials involved with the invasion; and (2) foreign persons that knowingly provided defense articles, services, or technology to Turkey that could be used in the invasion of northern Syria. Such foreign persons shall also be subject to visa- and asset-blocking sanctions. The President shall impose financial sanctions on the large Turkish state-owned bank known as Halk Bankasi or Halkbank and on any financial institutions that the State Department determines to have knowingly facilitated significant transactions for the Turkish Armed Forces or Turkey's defense industry related to the invasion. The President shall impose sanctions on Turkey's government pursuant to the Countering America's Adversaries Through Sanctions Act. A U.S. defense article, service, or technology may not be transferred to Turkey's government if it (1) is covered under the Arms Export Control Act, and (2) may be used by Turkey in military operations in northern Syria. The President may not exercise certain emergency waiver authority related to the Arms Export Control Act in relation to this prohibition. The bill calls for reports on (1) the national security impact of the invasion and, (2) the net worth of Turkish President Tayyip Erdogan and his family.

Health Equity and Access under the Law for Immigrant Women and Families Act of 2019 or the HEAL Immigrant Women and Families Act of 2019 This bill extends Medicaid and Children's Health Insurance Program coverage to individuals lawfully present in the United States who otherwise meet eligibility requirements. Individuals granted federally authorized presence also are required to maintain minimum essential health insurance coverage and are eligible for health insurance exchanges, reduced cost sharing, premium subsidies, and premium tax credits.

End the Limo Loophole Act This bill revises the definition of commercial motor vehicle to include vehicles that are designed to transport 9 or more passengers including the driver (currently, at least 16 passengers including the driver) and requires the Federal Motor Carrier Safety Administration to finalize a rulemaking to require states to implement an annual inspection program for commercial passenger-carrying vehicles.

Safe Gun Storage Act of 2019 This bill requires safety standards for firearm locks and safes. Under such standards, firearm locks must be reasonably designed to (1) prevent the firearm from discharging while the lock is activated, and (2) prevent unauthorized access to the firearm. Further, firearm safes must be reasonably designed to (1) secure firearms, and (2) prevent unauthorized access to the safe through physical manipulation or damage.

College Affordability Act This bill reauthorizes and revises the Higher Education Act of 1965, including to revise federal student financial aid programs, consolidate federal student loans and expand loan forgiveness , increase college access and success for certain students, and revise accountability measures. Specifically, the bill revises financial aid programs, including to (1) increase the maximum federal Pell Grant award, (2) provide incentives for states to fund public institutions of higher education (IHEs), and (3) increase and make permanent funding for minority-serving IHEs. The bill also revises federal student loan programs, including to (1) replace existing student loan repayment plans with one income-based repayment plan and one fixed repayment plan, (2) allow existing borrowers to lower their payments by switching to the new plans, and (3) expand public service loan forgiveness programs (e.g., TEACH grants) and create appeal processes for denied applications. In addition, the bill increases college access and success for certain students (e.g., students with low-income, children, or the disabled) through investments and practices, such as student support services and accelerated learning opportunities. Finally, the bill revises accountability measures for IHEs (including for-profit IHEs), job training programs, college accrediting agencies, and lenders. In particular, the bill updates the performance goals of the Office of Federal Student Aid and requires the Department of Education to be responsible for the oversight of the office.

Equitable Student Aid Access Act This bill revises certain income requirements for calculating federal student financial aid amounts, and it requires the Department of Education (ED) to publish certain requirements for financial aid offers. Specifically, the bill eliminates the simplified needs test in financial aid applications for families with income below a specified threshold, and it increases the income threshold that automatically qualifies a student for certain financial aid. When determining the total income of an applicant or an applicant's household, ED shall provide for the use of data from the second preceding tax year to simplify applications used for the estimation and determination of financial aid eligibility. ED must also conduct consumer testing to serve as the basis for determining requirements for financial aid offers. A financial aid offer must contain information such as cost of attendance and sources of available financial aid, as well as a standardized quick reference box to enable comparison of information on college costs and financial aid.

Keep STEM Talent Act of 2019 This bill exempts certain aliens with advanced degrees in a science, technology, engineering, or mathematics (STEM) field from direct limitations on the number of immigrant visas granted per year. Specifically, the alien must (1) have earned a master's level or higher degree in certain STEM fields while in the United States attending an accredited higher education institution, (2) be employed (or have a job offer) in a field related to the degree and earn at least the median wage for that occupation, and (3) meet certain labor certification requirements. The bill also allows an alien seeking a nonimmigrant F-1 (student) visa to obtain an advanced STEM degree to have dual intent. Specifically, such an alien may obtain the nonimmigrant visa or change nonimmigrant status even if the alien intends to seek lawful permanent resident status. (Generally, an alien may be denied a nonimmigrant visa if the alien actually intends to seek immigrant status, unless dual intent is allowed for that type of visa.)

Stopping Harmful Interference in Elections for a Lasting Democracy Act or the SHIELD Act This bill establishes a duty to report election interference from foreign entities, applies existing campaign advertising requirements to online advertisements, and generally limits political spending and election interference by foreign entities. Specifically, a political committee must report certain foreign contacts involving an offer of unlawful election assistance to the Federal Bureau of Investigation and the Federal Election Commission. The bill establishes criminal penalties for violations of these requirements. Existing requirements for political advertisements and electioneering communications apply to internet and digital advertisements, including requirements related to disclosures and contributions. Additionally, large online platforms must maintain a public database of certain political advertisements. The bill places limitations on political spending by foreign entities. Specifically, foreign entities may not (1) contribute to campaigns related to ballot initiatives and referenda, or (2) make disbursements for certain internet activity referring to a candidate or a political issue. A candidate is prohibited from offering to share nonpublic campaign information with certain foreign entities. The bill also prohibits (1) the dissemination of false statements regarding federal elections or public endorsement, or (2) the intentional hindering of voting or registering to vote. The bill establishes criminal penalties and a private right of action with respect to these prohibitions.

Stop College Closures Act of 2019 This bill revises provisions related to the recognition of an accrediting agency or association as a reliable authority on the quality of education or training offered by an institution of higher education (IHE). Specifically, an accreditor must (1) monitor the growth of programs at IHEs that are experiencing significant enrollment decline; (2) require, review, and approve the mandatory teach-out plan submitted by an IHE upon the occurrence of certain events indicating a potential school closure; and (3) respond to student complaints and monitor, assess, and submit such complaints to the Department of Education and the relevant state agencies.

Financial Aid Fairness for Students Act or the FAFSA Act This bill repeals a provision that makes students convicted of drug-related offenses ineligible for federal student aid, and it prohibits the Department of Education from asking about drug-related convictions on the Free Application for Federal Student Aid.

Public Servants Protection and Fairness Act This bill establishes an alternative formula to calculate Old-Age, Survivors, and Disability Insurance benefits for those who receive pensions for certain non-covered employment. (The existing formula is known as the windfall elimination provision.) The alternative formula adjusts an individual's total lifetime earnings based on the proportion of covered earnings (i.e., earnings subject to Social Security payroll taxes). It applies to individuals who (1) first become eligible for benefits after 2021, (2) have earnings from non-covered service performed after 1977 and (3) have less than 30 years of coverage (i.e., years in which a beneficiary is considered to have contributed a substantial amount into the Social Security trust funds). Beneficiaries receive the higher benefit amount as calculated under the alternative method or the existing formula. In addition, the bill provides rebates for certain beneficiaries currently impacted by the existing formula. The Social Security Administration must include non-covered earnings in Social Security account statements, and the Government Accountability Office must study the availability of certain information related to retirement plans maintained by state and local governments.

This joint resolution nullifies a rule issued by the Department of Education (ED) on September 23, 2019. The rule revised the process for a student loan borrower to obtain a discharge from a student loan if an institution of higher education misrepresented a material fact. Among other requirements, the 2019 rule requires each borrower to apply to ED for a defense to repayment. However, under the previous 2016 rule, an application could be submitted on behalf of an entire group (e.g., veterans).

Fiscal State of the Nation Resolution This concurrent resolution requires the congressional budget committees to conduct an annual joint hearing to receive a presentation from the Comptroller General regarding (1) the Government Accountability Office's audit of the financial statement of the executive branch, and (2) the financial position and condition of the federal government.

This resolution urges the United Kingdom (UK) and the European Union (EU) to support continued peace on the island of Ireland and the commitments of the Good Friday Agreement in the event that the UK leaves the EU. The resolution also expresses opposition to the reintroduction of a hard border between the Republic of Ireland and Northern Ireland. (The island of Ireland is divided between Northern Ireland, which is part of the UK, and the Republic of Ireland, an EU member state. There is currently an open border between them, but there is discussion that the UK's exit from the EU may require the reintroduction of a hard border.)

Ranked Choice Voting Act This bill requires each state to carry out elections for Senators and Representatives in Congress, including primary, special, and general elections, using a system of ranked choice voting. Under this system, each voter must rank the candidates for the office in order of the voter's preference.

Bankruptcy Venue Reform Act of 2019 This bill limits where a non-individual debtor (e.g., a corporate debtor) may file for chapter 11 bankruptcy. Specifically, these debtors must file in the district court for the district in which the principal place of business or principal assets of the debtor are located. Under current law, these debtors may also file where they are domiciled (i.e., incorporated) or where there is a chapter 11 case pending concerning an affiliate, general partner, or partnership. For certain debtors who are issuers of securities, their principal place of business is defined in the bill as the address of the entity's principal executive office as provided in specified Securities and Exchange Commission filings.

Fair Calculations in Civil Damages Act of 2019 This bill prohibits courts from awarding damages to plaintiffs in civil actions using a calculation for projected future earning potential that takes into account a plaintiff's race, ethnicity, gender, religion, or actual or perceived sexual orientation. The bill requires the Department of Labor to develop guidance for economists to develop future earnings tables that do not rely on race, ethnicity, gender, religion, or actual or perceived sexual orientation. Additionally, Labor and the Department of Justice must develop guidance for states on how to calculate future earnings in state tort proceedings in a manner that is free of such biases. The Judicial Conference of the United States must report on damages awarded under federal law for personal injury, employment discrimination, tort damages, and cases involving protected classes of individuals sharing a common characteristic or identity who are legally protected against discrimination. The Administrative Office of the United States Courts must submit recommendations to ensure that future earnings calculations that take into account age and disability do not conflict with federal equal protection laws. The bill requires the Federal Judicial Center to train federal judges on how to implement this bill.

Eric Garner Excessive Use of Force Prevention Act of 2019 This bill modifies the criminal civil rights statute that prohibits the deprivation of rights under color of law. Currently, the second prong of the prohibition bars the application of different punishments, pains, or penalties based on an individual's alien status, color, or race. This bill specifies that the application of any pressure to a person's throat or windpipe which may prevent or hinder breathing or reduce intake of air (e.g., a chokehold) constitutes a punishment, pain, or penalty.

This concurrent resolution supports existing regulations with the goals of (1) reducing greenhouse gas emissions and oil usage, and (2) protecting national security and human health and welfare. The concurrent resolution also supports policies that will help meet these goals, such as policies that achieve maximum feasible reductions in oil use.

Worker Dividend Act of 2019 This bill imposes a tax on certain publicly traded companies that have at least $250 million in U.S. earnings for the year, buy back securities during the year, and fail to pay employees a worker dividend. An employer covered by the bill must pay to U.S. employees a worker dividend that totals at least the lesser of: (1) the amount paid by the employer to repurchase securities of the employer on the open market during the taxable year; or (2) 50% of the amount by which the employer's U.S. earnings before interest, taxes, depreciation, and amortization exceed $250 million. Employers who fail to pay a required worker dividend are subject to a tax that is equal to the required dividend. The bill also specifies that the dividend must be distributed equally to employees and be paid in addition to compensation that the employer would ordinarily pay to employees.

Protect America’s Wildlife and Fish In Need of Conservation Act of 2019 or the PAW and FIN Conservation Act of 2019 This bill nullifies the 2019 rules relating to the listing of endangered or threatened species and the designation of critical habitats. Among other things, the restored rules automatically give threatened species the same protections as endangered species; revise requirements governing when an agency must consult with the U.S. Fish and Wildlife Service or the National Marine Fisheries Service about endangered species, threatened species, or their habitats; prohibit economic assessments from being considered in listing decisions; and revise the criteria used for designating critical habitats for the species.

Police Exercising Absolute Care With Everyone Act of 2019 This bill establishes a framework to reduce the unnecessary use of force by law enforcement at the federal, state, and local levels. At the federal level, the bill limits the use of force by federal law enforcement officers. It prohibits the use of deadly force, except as a last resort to prevent imminent and serious bodily injury or death. It also prohibits the use of less lethal force, unless it is necessary and proportionate to effectuate an arrest. Finally, it limits the use of a justification defense for a federal law enforcement officer who is charged with murder or manslaughter. At the state and local level, the bill conditions eligibility for funds under the Edward Byrne Memorial Justice Assistance Grant Program on the enactment of consistent limitations.

Taxpayer Fairness for Resource Development Act of 2019 This bill addresses royalties related to the development of federal energy resources. Among other things, the bill increases the onshore royalty rates for new oil, gas, and coal leases; increases onshore rental rates for oil and gas leasing; modifies the current onshore oil and gas minimum bid from $2 to $5 and requires it to be adjusted every four years for inflation; and makes revisions to the charter of the Royalty Policy Committee, including to increase to six the number of members who are representatives of academia or the public.

Bonding Reform and Taxpayer Protection Act of 2019 This bill revises bonding requirements for oil and gas development. Specifically, the bill increases the amount of bond that oil and gas developers must provide prior to conducting surface-disturbing activities and requires such amounts to adjust every three years for inflation. The bill also requires the Department of the Interior and the Department of Agriculture to establish uniform standards for all interim and final reclamation plans and not release any bond amounts until the standards have been met by oil and gas developers.

End Racial Profiling Act of 2019 This bill establishes a framework to eliminate racial profiling at the federal, state, and local levels. Specifically, it requires federal law enforcement agencies to maintain policies and procedures to eliminate racial profiling, including training, data collection, and complaint procedures. State, local, and tribal law enforcement agencies must maintain similar policies and procedures as a condition of receiving funds under the Edward Byrne Memorial Justice Assistance Grant program and the Community Oriented Policing Services program. To enforce violations, the bill authorizes civil suits by the Department of Justice and affected individuals.

Puppies Assisting Wounded Servicemembers for Veterans Therapy Act or the PAWS for Veterans Therapy Act This bill requires the Department of Veterans Affairs to implement a pilot program to assess the effectiveness of addressing post-deployment mental health and post-traumatic stress disorder through a method where veterans train service dogs for veterans with disabilities.

Immigrant Witness and Victim Protection Act of 2019 This bill provides protections for certain aliens who are victims of crimes and violence. The bill removes the annual cap on the number of visas issued to aliens who are victims of certain serious crimes and are likely to be helpful to law enforcement in prosecuting such crimes (U visas). Work authorization shall be granted to an alien with a pending application for (1) a U visa, (2) a T visa (for victims of severe human trafficking), or (3) cancellation of removal on the basis of the alien being subjected to extreme cruelty by a spouse, parent, or fiancé. Removal shall be stayed and detention shall be prohibited for an alien with a pending application for (1) a T or U visa; (2) employment authorization for a battered spouse of certain types of nonimmigrants; (3) cancellation of removal or adjustment of status on the basis of the alien being subjected to extreme cruelty by a spouse, parent, or fiancé; (4) temporary protected status; or (5) relief under the Violence Against Women Act.

This resolution expresses support for the designation of National Voting Rights Month, encourages people to uphold the right to vote, encourages Congress to pass certain voting rights legislation, recommends the development of a curriculum in public schools and universities regarding voting, encourages the U.S. Postal Service to issue a special Fannie Lou Hamer stamp during the month of September, and invites Congress to allocate funds for public service announcements regarding elections.
