Elizabeth Dole Home- and Community-Based Services for Veterans and Caregivers Act of 2023 or the Elizabeth Dole Home Care Act of 2023 This bill addresses home care and caregiver programs provided by the Department of Veterans Affairs (VA). Under the bill, the cost of providing noninstitutional alternatives to nursing home care may not exceed 100% of the cost that would have been incurred if a veteran had been furnished VA nursing home care, unless the VA determines that a higher cost is in the best interest of the veteran. (Under current law, these expenditures are limited to 65% of the cost.) Among other requirements, the VA must seek to enter into an agreement with the Program of All-Inclusive Care for the Elderly in certain areas to furnish noninstitutional alternatives to nursing home care; implement various programs (e.g., the Veteran Directed Care program) to expand access to home- and community-based services; provide specified support and benefits to caregivers of certain disabled veterans; implement a pilot program to provide homemaker and home health aide services to veterans who reside in communities with a shortage of home health aides; and ensure the availability of home and community-based services for Native American veterans. For veterans or family caregivers who are discharged from the Program of Comprehensive Assistance for Family Caregivers, a caregiver support coordinator must provide for a personalized transition to an appropriate program. The Veterans Health Administration must review programs administered through the Office of Geriatric and Extended Care to ensure consistency in program management, eliminate service gaps at the medical center level, and ensure the availability of and access to home and community-based services.

Saving Taxpayers' Money and Paying America's Debt Act This bill rescinds unobligated funds that were provided by the American Rescue Plan Act of 2021 and requires the funds to be used for the sole purpose of deficit reduction. (The American Rescue Plan Act of 2021 provided funding to address the impact of COVID-19 on the economy, public health, state and local governments, individuals, and businesses.)

Educational Choice for Children Act This bill allows individuals and corporations a new tax credit after 2023 for charitable contributions to tax-exempt organizations that provide scholarships to elementary and secondary school students. Such students must be members of a household with incomes not greater 300% of the area median gross income and be eligible to enroll in a public elementary or secondary school. The bill excludes from the gross income of taxpayer dependents any scholarship amount for the elementary or secondary education expenses of eligible students. It also prohibits governmental control over scholarship granting organizations.

Amplifying Processing of Livestock in the United States Act or the A-PLUS Act This bill directs the Department of Agriculture to revise its regulations to allow livestock market agencies (e.g., auction market owners) to hold an ownership interest in, finance, or participate in the management or operation of a meat packer with a cumulative slaughter capacity of (1) less than 2,000 animals per day or 700,000 animals per year for cattle and sheep, and (2) less than 10,000 animals per day or 3 million animals per year for hogs.

Foreign Adversary Risk Management Act or the FARM Act This bill places the Secretary of Agriculture on the Committee on Foreign Investment in the United States. It also requires the committee to review any investment that could result in foreign control of any U.S. agricultural business. Further, the bill includes agricultural systems and supply chains in the definitions of critical infrastructure and critical technologies for the purposes of reviewing such investments. The Department of Agriculture and the Government Accountability Office must each analyze and report on foreign influence in the U.S. agricultural industry.

Safer Highways and Increased Performance for Interstate Trucking Act or the SHIP IT Act This bill expands programs and special permits for trucks and truck drivers. Specifically, a state may issue a special permit for certain overweight vehicles based on a Presidential major disaster declaration or a Department of Transportation (DOT) declaration (1) of an emergency (including non-natural or financial), or (2) that the United States supply chain is having issues. Currently, a state may issue a special permit only based on a Presidential major disaster declaration. DOT must also, subject to the availability of funds, award competitive grants to construct or improve commercial vehicle parking facilities. Under the bill, the Department of Labor must provide Workforce Innovation and Opportunity Act grants for entry level commercial motor vehicle driver training. The bill also establishes a limited tax credit, adjusted annually based on inflation, for eligible commercial driver's license holders. Further, the Federal Motor Carrier Safety Administration must revise certain regulations related to commercial driver's license testing and permits, including to allow a third-party examiner to administer commercial driver's license tests. DOT must also establish a pilot program allowing states to issue permits for qualifying vehicles with six axles or more operating at greater than 80,000 pounds gross vehicle weight on a state's Interstate System. (Generally, the federal commercial vehicle weight limit is 80,000 pounds, with some exceptions.) The bill also exempts the battery weight from the gross vehicle weight for certain commercial motor vehicles powered primarily by electric battery power. Finally, existing driving time exemptions are expanded for truck drivers transporting agricultural commodities and farm supplies within a 150-mile radius.

Protecting Individuals with Down Syndrome Act This bill creates new federal crimes related to the performance of an abortion on an unborn child who has Down syndrome. It subjects a violator to criminal penalties—a fine, a prison term of up to five years, or both. It also authorizes civil remedies, including damages and injunctive relief. A woman who undergoes such an abortion may not be prosecuted or held civilly liable.

Putting Investors First Act of 2023 This bill requires a proxy advisory firm to register with the Securities and Exchange Commission and prohibits an unregistered proxy advisory firm from using interstate commerce to provide proxy-voting advice, research, analysis, or recommendations to any client. With respect to these firms, the bill (1) establishes procedures for both registration and termination of registration; (2) requires each firm to employ an ombudsman, designate a compliance officer, and publicly disclose conflicts of interest; (3) allows issuers to assess and comment on proxy voting recommendations; and (4) prohibits unfair, coercive, or abusive practices. The bill establishes a private right of action against a proxy advisory firm that endorses an approved proposal that is not supported by the issuer and is found to be illegal.

Protect the UNBORN (Undo the Negligent Biden Orders Right Now) Act or the Protect the UNBORN Act This bill prohibits federal implementation of and funding for specified executive orders that address access to reproductive health care services, including services related to pregnancy or the termination of a pregnancy.

Protecting Life and Integrity in Research Act of 2023 This bill restricts research that uses human fetal tissue from an induced abortion. Specifically, it prohibits the Department of Health and Human Services from conducting or supporting such research. Additionally, the bill applies requirements on the research of transplantation of fetal tissue for therapeutic purposes to research on fetal tissue in general. The bill also prohibits soliciting or acquiring a donation of human fetal tissue from an induced abortion, other than for purposes of an autopsy or burial.

Support And Value Expectant Moms and Babies Act of 2023 or the SAVE Moms and Babies Act of 2023 This bill prohibits the Food and Drug Administration (FDA) from approving any new drug (either as a brand-name drug or a generic) intended to terminate a pregnancy and imposes additional restrictions on such drugs that are already approved. Under the bill, an already-approved drug intended to terminate a pregnancy may be dispensed to a patient only with a prescription. Furthermore, the FDA may not approve any labeling change that would authorize (1) using the drug after 70 days of gestation, or (2) dispensing the drug by any means other than in-person administration by the prescribing health care practitioner. The FDA must also impose additional restrictions on such already-approved drugs, including by (1) requiring the prescribing health care practitioner to receive a special certification, (2) prohibiting the practitioner from also acting as the dispensing pharmacist, and (3) requiring the practitioner to have the ability to provide surgical intervention to the patient. The bill also rescinds any investigational use exemption already granted to such a drug if the bill would have prohibited the FDA from granting the exemption. (Currently, the FDA may grant an exemption to certain market approval requirements if a drug is intended solely for use in safety and effectiveness investigations.)

Life at Conception Act This bill declares that the right to life guaranteed by the Constitution is vested in each human being at all stages of life, including the moment of fertilization, cloning, or other moment at which an individual comes into being. Nothing in this bill shall be construed to authorize the prosecution of any woman for the death of her unborn child.

No User Fees for Gun Owners Act This bill prohibits a state or local government from imposing any insurance requirement, tax, user fee, or similar charge as a condition of the manufacture importation, acquisition, transfer, or continued ownership of a firearm or ammunition, with the exception of a proportionate sales tax. The bill imposes the same prohibition under the Internal Revenue Code for firearms, pistols, or revolvers, but allows for the assessment of a proportionate sales tax.

Standardizing Thresholds Of Penalties for Fentanyl Act or the STOP Fentanyl Act This bill reduces the drug quantity thresholds that trigger a mandatory minimum prison term for a defendant who manufactures, distributes, imports, exports, or possesses with intent to distribute fentanyl. The bill also creates enhanced criminal penalties for certain violations involving fentanyl that was imported along the U.S.-Mexico border. Specifically, the bill reduces from 400 to 5 grams the fentanyl quantity and from 100 to 0.05 grams the fentanyl analogue quantity that trigger a mandatory minimum prison term for high-level first-time or repeat offenders. It also reduces from 40 to 0.5 grams the fentanyl quantity and from 10 to 0.005 grams the fentanyl analogue quantity that trigger a mandatory minimum prison term for low-level first-time or repeat offenders. Additionally, the bill creates enhanced mandatory minimum prison terms for importing or exporting fentanyl that was imported along the U.S.-Mexico border.

No Subsidies for Government Purchases of Electric Vehicles Act This bill disallows a tax credit for qualified plug-in electric drive motor vehicles that are sold to the federal government or a state government.

Close the Double Subsidy Loophole for Electric Vehicles Act This bill reduces the allowable amount of the tax credit for a new qualified plug-in electric drive motor vehicle by any subsidy made available by the state in which the vehicle is registered and was placed in service.

Transparency in COVID-19 Expenditures Act This bill requires the Government Accountability Office (GAO) to audit certain funding that was provided to address COVID-19. Specifically, the GAO must audit and report on the use of funding provided by the Coronavirus Preparedness and Response Supplemental Appropriations Act, 2020; the Families First Coronavirus Response Act; the Coronavirus Aid, Relief, and Economic Security Act (CARES Act); the Paycheck Protection Program and Health Care Enhancement Act; Divisions M and N of the Consolidated Appropriations Act, 2021; and the American Rescue Plan Act of 2021.

Bipartisan Social Security Commission Act of 2023 This bill establishes a temporary commission within the legislative branch to provide Congress with recommendations and proposed legislation to ensure the solvency of the Federal Old-Age and Survivors Insurance Trust Fund and the Federal Disability Insurance Trust Fund (commonly referred to as the Social Security trust funds) for at least 75 years. The bill also sets out expedited procedures for the consideration of legislation proposed by the commission. The commission terminates within 60 days of providing its recommendations and proposed legislation.

Regulations from the Executive in Need of Scrutiny Act of 20 23 This bill revises provisions relating to congressional review of agency rulemaking. Specifically, the bill establishes a congressional approval process for a major rule. A major rule may only take effect if Congress approves of the rule. A major rule is a rule that has resulted in or is likely to result in (1) an annual effect on the economy of $100 million or more; (2) a major increase in costs or prices for consumers, individual industries, government agencies, or geographic regions; or (3) significant adverse effects on competition, employment, investment, productivity, innovation, or the ability of U.S.-based enterprises to compete with foreign-based enterprises. The bill generally preserves the current congressional review process for a nonmajor rule.

Chisholm National Historic Trail and Western National Historic Trail Designation Act This bill designates (1) the Chisholm National Historic Trail, and (2) the Western National Historic Trail. The Department of the Interior shall administer any portion of these trails that is located on nonfederal land only (1) with the voluntary consent of the owner of the nonfederal land, and (2) if the portion qualifies for certification as a component of the applicable trail. The approval by an owner of applicable nonfederal land of a certification agreement shall satisfy the voluntary consent requirement. A certification agreement may be terminated at any time. The establishment of these trails does not authorize any person to enter private property without the consent of the private property's owner. Interior may accept a donation of land or an interest in land for these trails, with specified exceptions. Land or an interest in land may not be acquired for these trails by eminent domain or condemnation.

Marginal Well Protection Act This bill amends the Clean Air Act to exclude certain facilities from reporting and payment requirements related to methane waste emissions. Under the bill, the requirements do not apply to facilities that produce less than 15 barrels of oil per day and less than 90 thousand cubic feet of natural gas per day.

Faithful Execution of the Law Act of 2023 This bill expands the circumstances under which the Department of Justice (DOJ) is required to report to Congress on a policy to refrain from enforcing federal law. Currently, DOJ is required to report to Congress when the Attorney General or other DOJ officer establishes or implements a non-enforcement policy on the grounds that the relevant provision of law is unconstitutional. This bill requires DOJ to report to Congress when any federal officer establishes or implements a non-enforcement policy on any grounds. Further, the bill requires the report to state the grounds for the non-enforcement policy.

Inflation Prevention Act of 2023 This bill establishes a point of order that, when the annualized rate of inflation exceeds 4.5%, prohibits the House and Senate from considering legislation that provides new budget authority and is estimated to increase the Consumer Price Index for All Urban Consumers. The prohibition may be waived in the Senate by an affirmative vote of three-fifths of the Senate.

Social Security Fairness Act of 2023 This bill repeals provisions that reduce Social Security benefits for individuals who receive other benefits, such as a pension from a state or local government. The bill eliminates the government pension offset , which in various instances reduces Social Security benefits for spouses, widows, and widowers who also receive government pensions of their own. The bill also eliminates the windfall elimination provision , which in some instances reduces Social Security benefits for individuals who also receive a pension or disability benefit from an employer that did not withhold Social Security taxes. These changes are effective for benefits payable after December 2023.

No Taxpayer Funding for Abortion and Abortion Insurance Full Disclosure Act of 2023 This bill modifies provisions relating to federal funding for, and health insurance coverage of, abortions. Specifically, the bill prohibits the use of federal funds for abortions or for health coverage that includes abortions. Such restrictions extend to the use of funds in the budget of the District of Columbia. Additionally, abortions may not be provided in a federal health care facility or by a federal employee. Historically, language has been included in annual appropriations bills for the Department of Health and Human Services (HHS) that prohibits the use of federal funds for abortions—such language is commonly referred to as the Hyde Amendment. Similar language is also frequently included in appropriations bills for other federal agencies and the District of Columbia. The bill makes these restrictions permanent and extends the restrictions to all federal funds (rather than specific agencies). The bill's restrictions regarding the use of federal funds do not apply in cases of rape, incest, or where a physical disorder, injury, or illness endangers a woman's life unless an abortion is performed. The Hyde Amendment provides the same exceptions. The bill also prohibits qualified health plans from including coverage for abortions. Currently, qualified health plans may cover abortion, but the portion of the premium attributable to abortion coverage is not eligible for subsidies.

Hearing Protection Act This bill removes silencers from the definition of firearms for purposes of the National Firearms Act. It also treats persons acquiring or possessing a firearm silencer as meeting any registration and licensing requirements of such Act. The Department of Justice must destroy certain records relating to the registration, transfer, or making of a silencer. The bill also revises the definitions of firearm silencer and firearm muffler under the federal criminal code and includes such items in the 10% excise tax category.

Protecting Speech from Government Interference Act This bill generally prohibits federal employees from censoring the speech of others while acting in an official capacity. Specifically, the bill prohibits employees of executive agencies or who are otherwise in the competitive service from (1) using their official authority to influence or advocate for a third party, including a private entity, to censor speech; (2) censoring the speech of any person who has a pending regulatory application with, or is the subject of or a participant in an active enforcement action by, the employee's office; or (3) engaging in censorship while on duty, wearing a uniform, or using official government property. Certain presidential appointees may not censor speech at any time, including outside normal duty hours. Employees are subject to disciplinary action, civil penalties, or both for violations. The bill defines censor or censorship to include ordering or advocating for the removal of lawful speech, the addition of disclaimers, or the restriction of access with respect to any platform (e.g., social media).

Stopping Home Office Work's Unproductive Problems Act of 2023 or the SHOW UP Act of 2023 This bill requires each executive agency to reinstate the telework policies that were in place on December 31, 2019. Agencies may not implement expanded telework policies unless the Office of Personnel Management certifies that such policies, among other requirements, will have a positive effect on the agency's mission and operational costs.

Born-Alive Abortion Survivors Protection Act This bill establishes requirements for the degree of care a health care practitioner must provide in the case of a child born alive following an abortion or attempted abortion. Specifically, a health care practitioner who is present must (1) exercise the same degree of care as would reasonably be provided to any other child born alive at the same gestational age, and (2) ensure the child is immediately admitted to a hospital. Additionally, a health care practitioner or other employee who has knowledge of a failure to comply with the degree-of-care requirements must immediately report such failure to law enforcement. A health care practitioner who fails to provide the required degree of care, or a health care practitioner or other employee who fails to report such failure, is subject to criminal penalties—a fine, up to five years in prison, or both. An individual who intentionally kills or attempts to kill a child born alive is subject to prosecution for murder. The bill bars the criminal prosecution of a mother of a child born alive under this bill and allows her to bring a civil action against a health care practitioner or other employee for violations.

Family and Small Business Taxpayer Protection Act This bill rescinds certain unobligated amounts made available to the Internal Revenue Service by the Inflation Reduction Act of 2022 for its enforcement activities and for funding certain Department of the Treasury tax agencies.

Defund Planned Parenthood Act of 2023 This bill restricts federal funding for Planned Parenthood Federation of America Inc. or any of its affiliates or clinics for one year. Specifically, it prohibits funding those entities unless they certify that the affiliates and clinics will not perform, and will not provide funds to entities that perform, abortions during that year. If the certification requirement is not met, the Department of Health and Human Services and the Department of Agriculture must recoup any federal assistance received by those entities. However, the bill's funding restriction does not apply to abortions performed in cases of rape or incest or when necessary to resolve a physical condition that endangers a woman's life. The bill also provides additional funding for community health centers for the one-year period. These funds are subject to the same abortion-related restrictions and exceptions.

COI Elimination Act This bill limits U.S. contributions to the United Nations pertaining to the U.N. Independent International Commission of Inquiry on the Occupied Palestinian Territory, including East Jerusalem, and Israel. Current law imposes a cap on the annual U.S. contribution to the U.N. budget. The bill lowers that cap by 25% of the amount budgeted for the commission. The bill also states that it shall be U.S. policy to seek the abolition of the commission and combat systemic anti-Israel bias in international bodies.

Save America’s Valuable Energy Act or the SAVE Act This bill directs the Department of Energy (DOE) to prohibit the sale of petroleum products (e.g., crude oil) from the Strategic Petroleum Reserve (SPR) to certain entities. Specifically, DOE must prohibit the sale of petroleum products from the SPR to entities headquartered in Russia. Further, DOE must prohibit the sale of petroleum products from the SPR to entities headquartered in countries (Belarus, Burma, China, Cuba, Iran, North Korea, Syria, and Venezuela) that are subject to certain prohibitions concerning exports of defense articles and services under the Department of State's International Traffic in Arms Regulations.

No Frivolous Application for Short-Barreled Shotguns Act or the NFA SBS Act This bill removes certain short-barreled shotguns from the definition of firearms for purposes of the National Firearms Act. It also eliminates the prohibition on the sale or transportation of such shotguns in interstate commerce and treats persons who acquire or possess a short-barreled shotgun as meeting the registration or licensing requirements for such shotguns where such requirements are determined by reference to the National Firearms Act. The bill preempts state or local laws that impose a tax or recordkeeping requirements on short-barreled shotguns. The Department of Justice must destroy records relating to the registration of shotguns described by this bill within one year after the enactment of this bill.

Concealed Carry Reciprocity Act This bill establishes a federal statutory framework to regulate the carry or possession of concealed firearms across state lines. Specifically, an individual who is eligible to carry a concealed firearm in one state may carry or possess a concealed handgun (other than a machine gun or destructive device) in another state that allows its residents to carry concealed firearms. It sets forth requirements for the lawful concealed carry across state lines. The bill preempts most state and local laws related to concealed carry and establishes a private right of action for a person adversely affected by interference with a concealed-carry right established by this bill.

Firearm Industry Non-Discrimination Act or the FIND Act This bill prohibits the federal government from entering into contracts with an entity that discriminates against firearm trade associations or businesses that deal in firearms, ammunition, or related products. Specifically, the bill requires a federal agency to include in each contract for the procurement of goods or services awarded by the agency a clause requiring the prime contractor to certify that it (1) has no policy, practice, guidance, or directive that discriminates against a firearm entity or firearm trade association; and (2) will not adopt a policy, practice, guidance, or directive that discriminates against a firearm entity or firearm trade association during the term of the contract. The bill establishes (1) a similar requirement with respect to subcontracts, and (2) penalties for violations. The bill makes such prohibition inapplicable to a contract for the procurement of goods or services that is a sole-source contract.

Kansas Indian Country Law Enforcement Improvement Act of 2022 This bill revises Kansas's criminal jurisdiction over offenses committed on the reservation of a covered Indian tribe. Covered Indian tribe means the Iowa Tribe of Kansas and Nebraska, the Kickapoo Tribe of Indians of the Kickapoo Reservation in Kansas, the Prairie Band Potawatomi Nation, and the Sac & Fox Nation of Missouri in Kansas and Nebraska. Specifically, the bill requires affirmative consent from the governing body of a covered tribe for Kansas to have criminal jurisdiction over offenses committed on the tribe's reservation. The bill authorizes federal agencies and state and local governments in Kansas to enter into cooperative agreements or compacts with the governing bodies of covered Indian tribes for specified purposes, such as reducing crime in Indian country and nearby communities. Each cooperative agreement or compact entered into under the bill must (1) authorize law enforcement officers to be deputized, (2) include requirements for reporting crimes, and (3) describe the geographic limits within the reservation and categories of criminal offenses over which Kansas may exercise its jurisdiction. The Department of Justice must, upon request from the governing body of a covered Indian tribe, provide technical assistance in developing cooperative agreements or compacts.

This joint resolution nullifies the final rule issued by the U.S. Fish and Wildlife Service titled Endangered and Threatened Wildlife and Plants; Lesser Prairie-Chicken; Threatened Status With Section 4(d) Rule for the Northern Distinct Population Segment and Endangered Status for the Southern Distinct Population Segmen t and published on November 25, 2022. The rule adds the Northern Distinct Population Segment of lesser prairie-chicken to the list of threatened species and the Southern District Population Segment of lesser prairie-chicken to the list of endangered species.

This joint resolution nullifies the interim final rule issued by the Department of Veterans Affairs (VA) titled Reproductive Health Services and published on September 9, 2022. The rule authorizes the VA to provide certain abortion-related care to veterans. The rule also applies to such care provided to beneficiaries covered under the Civilian Health and Medical Program of the Department of Veterans Affairs (CHAMPVA).

Consumer and Fuel Retailer Choice Act This bill amends the Clean Air Act to address the limitations on Reid Vapor Pressure (a measure of gasoline's volatility) that are placed on gasoline during the summer ozone season, including by applying the Reid Vapor Pressure requirements that are applicable to gasoline blended with 10% ethanol (E10) to gasoline blended with more than 10% ethanol.

U.S. Customs and Border Protection Behavioral Health Act This bill addresses various issues related to behavioral health care for U.S. Customs and Border Protection (CBP) employees. For example, the bill (1) establishes a behavioral health readiness office within CBP, and (2) requires all CBP initial entry training sites to include basic behavioral health awareness training.
