Breast Cancer Patient Protection Act of 2011

Breast Cancer Patient Protect Act of 2011 - Amends the Employee Retirement Income Security Act of 1974 (ERISA), the Public Health Service Act, and the Internal Revenue Code to require a group or individual health plan that provides medical and surgical benefits to ensure that inpatient (and in the case of a lumpectomy, outpatient) coverage and radiation therapy are provided for breast cancer treatment. Prohibits such a plan from: (1) restricting benefits for any hospital length of stay to less than 48 hours in connection with a mastectomy or breast conserving surgery or 24 hours in connection with a lymph node dissection, insofar as the attending physician, in consultation with the patient, determines such stay to be medically necessary; or (2) requiring that a provider obtain authorization from the plan for prescribing any such length of stay. Requires such a plan to: (1) provide notice to each participant and beneficiary regarding the coverage required under this Act; and (2) ensure that coverage is provided for secondary consultations. Prohibits a health plan from taking specified actions to avoid the requirements of this Act. Allows a health insurance issuer that provides individual health insurance coverage to nonrenew or discontinue an individual's coverage based on the intentional concealment of material facts regarding a health condition related to the condition for which coverage is being claimed.

Belated Thank You to the Merchant Mariners of World War II Act of 2011 - Establishes in the Treasury the Merchant Mariner Equity Compensation Fund for payments by the Secretary of Veterans Affairs (VA) of a monthly benefit of $1,000 to each individual who, between December 7, 1941, and December 31, 1946, was a documented member of the U.S. merchant marine (including the Army Transport Service and the Naval Transport Service) serving as a crewmember of a vessel that was operated in U.S. waters by the War Shipping Administration or the Office of Defense Transportation and under contract to, or the property of, the United States. Requires such individuals to: (1) apply for such benefit within one year after the enactment of this Act; and (2) not have received benefits under the Servicemen's Readjustment Act of 1944. Requires the Secretary to include, in annual budget documents submitted to Congress, detailed information on the Fund's operation.

Urges the President, in the interests of protecting and advancing human, national, and global security, to: (1) declare that the United States will not use nuclear weapons first, and that pending their elimination, such weapons serve only to deter a nuclear attack by a hostile state or other entity; (2) initiate and conclude multilateral negotiations on verifiable steps nuclear states shall take to reduce and eventually eliminate nuclear weapons; (3) cooperate with the Russian Federation to remove from deployment nuclear weapons that are operational; (4) reaffirm the moratorium on nuclear testing and work for ratification of the Comprehensive Test Ban Treaty; (5) terminate all efforts to enhance U.S. military capabilities of the U.S. nuclear arsenal and to develop ballistic missile defenses; and (6) support initiatives to ban weapons in outer space.

Preventing Affinity Scams for Seniors Act of 2010 or PASS Act of 2010 - Defines "affinity scam" as a transaction in which a person trusted by a senior, such as a caregiver, relative, guardian, "new friend," or service provider, claims to share similar interests or values and establishes a relationship with the senior, then uses the relationship to defraud the senior. Requires each financial institution to: (1) educate its staff about affinity scams and how to identify transactions that may be part of an affinity scam; (2) train staff members on educating seniors about affinity scams; (3) provide senior depositors with educational materials on how to identify affinity scams; and (4) offer seniors a "senior protection (checking) account." Directs the Bureau of Consumer Financial Protection to: (1) issue implementing regulations; and (2) audit financial institutions periodically to ensure compliance with them. Sets forth senior protection account requirements, including protective measures to block and investigate transactions suspected of being an affinity scam. Instructs the Secretary of the Treasury to establish an income tax deduction of .77% of the average of the amount of deposits held by a financial institution in senior protection accounts. Subjects a noncompliant financial institution to a civil liability with respect to a senior who has sustained actual damage as a result of the institution's failure to comply with this Act. Directs the Secretary to require each financial institution, and each of its directors, officers, employees, or agents, to report any suspicious transaction relevant to a possible affinity scam.

Zimbabwe Renewal Act of 2010 - States that it is U.S. policy to support a transition to democratic and economic recovery in Zimbabwe that reflects the political conditions and opportunities created by the Global Political Agreement (GPA). Authorizes the Secretary of State to provide assistance to strengthen the rule of law and human rights in Zimbabwe. Authorizes the President, through the Administrator of the United States Agency for International Development (USAID), to provide assistance to Zimbabwe for: (1) sustainable development; (2) health care; (3) education; (4) agriculture; and (5) clean water. Direct the President to develop an emergency vocational youth work program for the construction and repair of public works of benefit to the entire population of Zimbabwe. Authorizes the President to provide economic assistance to Zimbabwe to support democracy and civil authority, human rights, economic self-sufficiency, education and health care, reconciliation, and GPA implementation. Authorizes the Secretary of the Treasury to provide technical assistance to the Zimbabwean Ministry of Finance and line ministries. Directs the Secretary of the Treasury to: (1) forgive the debt of Zimbabwe held by any U.S. government agency; and (2) direct the U.S. Executive Director at each international financial institution of which the United States is a member to vote in favor of programs for Zimbabwe. Expresses the sense of Congress that certain sanctions on financial institutions should be lifted to allow financial institutions to assist communal farmers, civil servants, pensioners, and the people of Zimbabwe, and that technical assistance should be provided to such institutions if: (1) the Finance Ministry of Zimbabwe does not politicize lending or extending credit; (2) no individual who is subject to U.S. or European Union (EU) sanctions serves as a board member, advisor, or employee of any financial institution in Zimbabwe; and (3) no funds are made available to Zimbabwe's Reserve Bank. Lifts targeted sanctions against a person upon a presidential certification to Congress that such person: (1) has taken significant steps to help strengthen democracy, respect human rights, and the rule of law in Zimbabwe; and (2) has played a constructive role in GPA implementation.

Post-9/11 Veterans Educational Assistance Improvements Act of 2010 - Revises provisions concerning the post-9/11 veterans' educational assistance program to, among other things: (1) revise definitions concerning eligibility, and include certain National Guard service as service qualifying for such assistance; (2) revise assistance amounts (including monthly stipends), and types of approved programs of education; (3) allow the pursuit of educational programs at institutions other than institutions of higher learning, including on-job training and apprenticeships, flight training, and correspondence courses; (4) provide an assistance amount for programs of education pursued while on active duty; (5) repeal the limit on the use of such assistance for the payment of only one licensing or certification test; (6) allow an individual entitled to supplemental educational assistance to transfer such entitlement to the post-9/11 program; (7) bar the duplication of benefits under other educational assistance programs; (8) increase the amount of the reporting fee paid by the Secretary of Veterans Affairs (VA) to an educational institution for providing information concerning an individual's enrollment in a program of education; (9) extend to certain National Guard and reserve personnel members eligibility to receive public-private contributions for additional educational assistance; (10) reauthorize through 2016 the Veterans' Advisory Committee on Education; and (11) revise cost-of-living adjustments under the Montgomery GI Bill educational assistance program. Provides an alternate subsistence allowance amount for veterans entitled to such allowance due to service-connected disabilities.

Requires an interim disability rating to remain in effect unless the Secretary later assigns an increased rating for such condition. Prohibits the continuation of such rating if the rating was based on fraud or the condition improves. Directs the Secretary to establish a process for the rapid identification of initial claims for disability compensation that should, in adjudication, receive priority in the order of review. Requires the Secretary to identify whether claims have the potential of being adjudicated quickly, the claims qualify for priority treatment, and a temporary disability rating could be assigned for such claims. Authorizes the Secretary to provide priority based on the effect such priority would have on a claimant.

Investing in American Jobs and Closing Tax Loopholes Act of 2010 - Amends the Internal Revenue Code to: (1) extend through 2012 the period for issuing Build America Bonds and for making payments to issuers of such bonds; (2) allow financing of levees and other flood control projects with such Bonds; (3) exempt private activity bonds for sewage and water supply facilities from otherwise applicable state volume caps and allow Indian tribal governments to issue tax-exempt private activity bonds to provide water or sewage facilities; (4) extend through 2011 the exemption of interest on tax-exempt bonds from the alternative minimum tax (AMT); (5) extend through 2011 the period for issuing recovery zone economic development bonds and recovery zone bonds; (6) allow a full offset against the AMT for new market tax credit amounts attributable to qualified equity investments initially made before January 1, 2012; and (7) extend through 2011 the tax exemption allowed for interest on bonds guaranteed by a federal home loan bank and small issuer rules for the allocation of tax-exempt interest expense by financial institutions. Amends title IV, part A (Block Grants to States for Temporary Assistance for Needy Families) of the Social Security Act to: (1) rename the Emergency Contingency Fund for State Temporary Assistance for Needy Family Programs as the Emergency Fund for Job Creation and Assistance; and (2) extend appropriations for such Fund through FY2011. Amends the Internal Revenue Code, with respect to the taxation of foreign income and the foreign tax credit, to: (1) suspend the recognition of foreign tax credits until the related foreign income is taken into account for U.S. tax purposes; (2) deny a foreign tax credit for foreign income not subject to U.S. taxation due to a covered asset acquisition (defined as an acquisition that results in an increase in tax basis for U.S. tax purposes but not for foreign tax purposes); (3) apply a separate foreign tax credit limitation for each item of income that would be treated as derived from sources within the United States and that would be treated as arising from sources outside the United States under a treaty obligation (if the taxpayer chooses the benefits of such treaty); (4) limit the amount of foreign tax credits that may be claimed by a U.S. domestic corporation with respect to a deemed dividend paid by a foreign subsidiary; (5) prevent a reduction in earnings in profits of a foreign corporation in an acquisition if more than 50% of the dividends arising from such acquisition would not be subject to U.S. taxation or would be includible in the earnings and profits of a controlled foreign corporation; (6) treat a foreign corporation as a member of an affiliated group for interest allocation and apportionment purposes if more than 50% of its gross income is effectively connected with a U.S. trade or business and at least 80% of either the vote or value of its outstanding stock is owned directly or indirectly by members of the affiliated group; (7) repeal tax rules exempting foreign source income attributable to the active conduct of a foreign trade or business from withholding of tax requirements; (8) treat as income received in the United States amounts received from noncorporate residents or domestic corporations with respect to guarantees and amounts paid by any foreign person if such amounts are connected with income that is effectively connected with the conduct of a trade or business in the United States; and (9) provide that the statute of limitations for assessing any tax on certain foreign transactions shall apply only to items related to a failure to provide information to the Internal Revenue Service (IRS) due to reasonable cause and not willful neglect. Provides for compliance of the budgetary effects of this Act with the Statutory Pay-As-You-Go Act of 2010. Increases by 3% the estimated tax payment of corporations with assets of not less than $1 billion in the third quarter of 2015.

Sets forth provisions related to the establishment and governance of the public health insurance option, including that such plan: (1) may be made available only through Exchanges; (2) must comply with requirements applicable to other health benefits plans offered through such Exchanges, including requirements related to benefits, benefit levels, provider networks, notices, consumer protections, and cost sharing; and (3) must offer bronze, silver, and gold plan levels. Requires the Secretary to: (1) establish an office of the ombudsman for the public health insurance option; (2) collect such data as may be required to establish premiums and payment rates; (3) establish geographically adjusted premiums at a level sufficient to fully finance the costs of the health benefits provided and administrative costs related to the operation of the plan; and (4) establish payment rates and provide for greater payment rates for the first three years. Requires repayment of start-up costs for the public health insurance option. Authorizes the Secretary to utilize innovative payment mechanisms and policies to determine payments for items and services under the public health insurance option.

Requires state or local governmental entities or state, local, or tribal law enforcement agencies that apply for grants under the Edward Byrne Memorial Justice Assistance Grant Program and the Cops on the Beat Program to certify that they maintain adequate policies and procedures for eliminating racial profiling and have eliminated any existing practices that permit or encourage racial profiling. Authorizes the Attorney General to award grants and contracts for the collection of data relating to racial profiling and for the development of best practices and systems to eliminate racial profiling. Requires the Attorney General to issue regulations for the collection and compilation of data on racial profiling and for the implementation of this Act.

PACE Assessment Protection Act of 2010 - Directs the Federal National Mortgage Association (Fannie Mae) and the Federal Home Loan Mortgage Corporation (Freddie Mac) to adopt underwriting standards that are consistent with the Guidelines for Pilot PACE Financing Programs issued on May 7, 2010, by the Department of Energy (DOE). Provides that liens or other property obligations that secure property taxes or assessments under a PACE program and that are consistent with such standards shall be considered to comply with the Uniform Instruments of Fannie Mae and Freddie Mac and shall not constitute a default on an existing mortgage or trigger the exercise of lender's remedies for a property with such a lien. Defines a "PACE program" as a property assessed clean energy program under which a state or political subdivision levies taxes or assessments on real property to finance the installation of renewable energy and energy efficiency improvements. Prohibits Fannie Mae and Freddie Mac from requiring repayment of a PACE program tax or assessment in order for a property owner to finance, refinance, or transfer property that meets their underwriting criteria without consideration of the PACE program lien. Requires the underwriting standards to provide that, in the event that a tax or assessment under a PACE program is delinquent, only the unpaid delinquent amount along with applicable penalties, interest, and costs will be subject to foreclosure and not the entire amount. Prohibits the Federal Housing Finance Agency, Fannie Mae, Freddie Mac, and all federal agencies and entities chartered under federal law from discriminating against communities implementing or participating in a PACE program.
