Authorizes the Secretary to exceed 10,000 upon the request of a state that shares a portion of the U.S.-Mexico border if, despite deployment of the additional 10,000, operational control of the border has not been achieved. Requires the Secretary to provide funding to a state that submits to the Secretary of State a state border control activities plan meeting certain requirements. Limits the number of National Guard that may be so deployed.

No Taxpayer Funding for Abortion Act - Prohibits: (1) the expenditure of funds authorized or appropriated by federal law or funds in any trust fund to which funds are authorized or appropriated by federal law for any abortion or for health benefits coverage that includes coverage of abortion; (2) any tax benefits for amounts paid or incurred for an abortion or for a health benefits plan (including premium assistance) that includes coverage of abortion; and (3) the inclusion of abortion in any health care service furnished by a federal health care facility or by any physician or other individual employed by the federal government. Exempts from such prohibitions an abortion if the pregnancy is the result of rape or incest with a minor, or if the woman suffers from a physical disorder, injury, or illness that would, as certified by a physician, place the women in danger of death unless an abortion is performed, including a life-endangering physical condition caused by or arising from the pregnancy itself. Makes such prohibitions applicable to federal funding within the budget of the District of Columbia. Prohibits federal agencies or programs and states and local governments that receive federal financial assistance from discriminating against any individual or institutional health care entity on the basis that such entity does not provide, pay for, provide coverage of, or refer for abortions. Designates the Office for Civil Rights of the Department of Health and Human Services (HHS) to receive, and coordinate the investigation of, discrimination complaints.

Smith-Mundt Modernization Act of 2010 - Amends the United States Information and Educational Exchange Act of 1948 to authorize the Secretary of State to provide for the preparation and dissemination of information intended primarily for foreign audiences abroad about the United States, including about its people, its history, and the federal government's policies, through press, publications, radio, motion pictures, the internet, and other information media, and through information centers and instructors. (Under current law such authority is restricted to information disseminated abroad, with a limited domestic exception.) Amends the Foreign Relations Authorization Act, Fiscal Years 1986 and 1987 to prohibit Department of State funds from being used to influence public opinion or propagandizing in the United States. (Under current law such provision applies to the United States Information Agency [USIA].) States that such provision shall: (1) not prohibit the Department from responding to inquiries about its operations, policies, programs, or program material, or making such information available to members of the media, public, or Congress; (2) not be construed to prohibit the Department from engaging in any medium of information on a presumption that a U.S. domestic audience may be exposed to program material; and (3) apply only to the Department and to no other federal department or agency.

Property Owners Access to Court Act of 2010 - Amends the federal judicial code to provide that, whenever a district court exercises jurisdiction in civil rights cases in which the operative facts concern the uses of real property, it shall not abstain from exercising such jurisdiction, or relinquish it to a state court, if the party seeking redress does not allege a violation of a state law, right, or privilege, and no parallel proceeding is pending in state court, at the time the action is filed in the district court, that arises out of the same operative facts as the district court proceeding. Declares that in an action in which operative facts concern the uses of real property, the district court shall exercise jurisdiction even if the party seeking redress does not pursue judicial remedies provided by a state or territory. Provides for referral of an unsettled question of state law to the state's highest appellate court. Prohibits the district court from certifying a question of state law unless it is necessary to resolve the merits of the injured party's federal claim, and such question is patently unclear. Declares that any claim or action to redress the deprivation of a property right or privilege secured by the Constitution shall be ripe for adjudication by the district courts upon a final decision rendered by any person acting under color of any law, regulation, custom, or usage of any state or U.S. territory that causes actual and concrete injury to the party seeking redress. Declares that any claim founded upon a property right or privilege secured by the Constitution, but allegedly infringed or taken by the United States, shall be ripe for adjudication upon a final decision rendered by the United States which causes actual and concrete injury to the party seeking redress. Amends the Revised Statutes of the United States and the federal judicial code with respect to certain constitutional property rights claims. Provides for the liability of the United States for certain claims, brought under U.S. district court jurisdiction or Court of Federal Claims jurisdiction, where the claim is founded upon a property right or privilege secured by the Constitution. Requires a federal agency, whenever it takes action limiting the use of private property that may be affected by the amendments made by this Act, to give notice to the owners of that property explaining their rights and the procedures for obtaining any compensation that may be due to them under such amendments.

H-1B and L-1 Visa Reform Act of 2010 - Amends the the Immigration and Nationality Act to revise employer and government provisions regarding H-1B (specialty occupation) and L-1 (intracompany transfer) nonimmigrant aliens. Amends H-1B employer application requirements to: (1) revise wage determination requirements; (2) require Internet posting and description of employment positions; (3) lengthen U.S. worker displacement protection: (4) apply certain requirements to all H-1B employers rather than only to H-1B dependent employers; (5) prohibit employer advertising that makes a position available only to, or gives priority to, H-1B nonimmigrants; and (6) limit the number of H-1B and L-1 employees that an employer of 50 or more workers in the United States may hire. Revises application review provisions. Authorizes the Department of Labor (DOL) to: (1) investigate applications for fraud; and (2) conduct H-1B compliance audits. Directs DOL to conduct annual audits of companies with large numbers of H-1B workers. Authorizes DOL to initiate H-1B employer application investigations. Increases employer penalties. Revises provisions regarding initiation of employer violation investigations by DOL. Provides for information sharing between DOL and United States Citizenship and Immigration Services regarding employer noncompliance. Authorizes DOL to hire 200 additional employees to administer H-1B programs. Prohibits, with a specified waiver by the Secretary of Homeland Security (DHS), an employer from hiring an L-1 nonimmigrant for more than one year who will: (1) serve in a capacity involving specialized knowledge; and (2) be stationed primarily at the worksite of an employer other than the petitioning employer. Specifies L-1: (1) employer petition requirements for employment at a new office; (2) wage rates and working conditions; and (3) employer penalties. Authorizes the Secretary to initiate an L-1 employer investigation. Requires a report to Congress regarding the L-1 blanket petition process.

Expresses the sense of Congress that the Secretary of State should redesignate North Korea as a state sponsor of terrorism. Finds that the United States did not grant diplomatic recognition to North Korea upon its establishment as a client regime of the former Soviet Union in 1948. Continues diplomatic nonrecognition of North Korea until such benchmarks have been met. Directs the President, in the case of a North Korean missile, rocket, or other airborne launch or the conducting of a nuclear test in violation of U.N. Security Council Resolutions 1695, 1718, and 1874, to instruct the U.S. Permanent Representative to the United Nations to use U.S. influence to secure adoption of a Security Council resolution condemning North Korea's action and requiring implementation of comprehensive sanctions against North Korea.

Expresses the sense of the House of Representatives that: (1) Democratic Members of the House should join its Republican Members in a total ban on earmarks for one year; (2) discretionary spending should be reduced in the concurrent budget resolution for FY2011 by the total amount that was spent on requests for earmarks in FY2010; (3) if spending in that resolution is not reduced by such amount, an amendment to that resolution to effectuate this change should be made in order; and (4) a complete review and overhaul of the congressional budgetary, spending, and earmark processes should be commenced by creating a bipartisan, bicameral committee to study the issue and report to the House and Senate with its recommendations.

Bars the Secretary of the Interior from implementing any restrictions on the public use of a national monument until the expiration of an appropriate review period providing for public output and congressional approval.
