Israel Security Supplemental Appropriations Act, 2024 This bill provides FY2024 supplemental appropriations to the Department of Defense (DOD) and the Department of State for activities to respond to the attacks in Israel. The bill designates the funding as emergency spending, which is exempt from discretionary spending limits. The bill provides appropriations to DOD for Operation and Maintenance; Procurement; and Research, Development, Test and Evaluation. The funding is provided for purposes such as replacing defense articles that were provided to Israel, reimbursing DOD for defense services and training provided to Israel, procuring Israel's Iron Dome and David's Sling defense systems, and developing Israel's Iron Beam defense system. The bill provides appropriations to the State Department for Diplomatic Programs, including Worldwide Security Protection; Emergencies in the Diplomatic and Consular Service; and the Foreign Military Financing Program. In addition, the bill includes provisions that expand the authorities of the President to transfer defense articles and services from DOD to Israel. Finally, the bill rescinds specified unobligated funds that were provided for activities of the Internal Revenue Service.

The resolution also calls on the Biden Administration to (1) impose sanctions on Chinese officials, entities, and individuals with ties to fentanyl precursor production or trafficking; (2) designate Chinese financial institutions involved in evading U.S. sanctions; and (3) develop a plan to counter the shipment of fentanyl precursors and add China to the list of Major Drug Producing Countries.

Antisemitism Awareness Act of 2023 This bill provides statutory authority for the requirement that the Department of Education’s Office for Civil Rights take into consideration the International Holocaust Remembrance Alliance's (IHRA's) working definition of antisemitism when reviewing or investigating complaints of discrimination based on race, color, or national origin in programs or activities that receive federal financial assistance. According to the IHRA's working definition, antisemitism is a certain perception of Jews, which may be expressed as hatred toward Jews.

This bill terminates the presidential waiver of certain sanctions on Iran and the licenses issued by the Department of the Treasury that allowed for the transfer of previously blocked Iranian funds (namely, the approximately $6 billion of Iranian funds that the Biden Administration permitted to be transferred from restricted accounts in South Korea to restricted accounts in Qatar to facilitate the release of five U.S. citizens detained in Iran). Furthermore, the President may not exercise waiver authority related to certain accounts belonging to Iran.

DETERRENT Act

Defending Education Transparency and Ending Rogue Regimes Engaging in Nefarious Transactions Act or the DETERRENT Act This bill expands oversight and disclosure requirements related to foreign sources and institutions of higher education (IHEs). Specifically, the bill requires an IHE to annually disclose to the Department of Education (ED) any year in which the IHE receives a gift from a foreign country of concern (e.g., China or Russia) or foreign entity of concern of any dollar amount; receives a gift or contract from a foreign source (other than a foreign country of concern or foreign entity of concern) that is valued at $50,000 or more, considered alone or in combination with all other gifts or contracts within a calendar year (current disclosure threshold is $250,000 or more), or which has an undetermined monetary value; enters into a contract with a foreign country of concern or foreign entity of concern after receiving a waiver for such contract; or is substantially controlled by a foreign source. Additionally, the bill prohibits IHEs from entering into contracts with a foreign country of concern or with a foreign entity of concern without obtaining a waiver, requires certain IHEs to disclose gifts or contracts between faculty members and foreign sources, and requires private IHEs with specified assets or investments to file annual investment disclosure reports. The bill authorizes ED to investigate possible violations of this bill and outlines the various penalties for each violation.

Technology for Energy Security Act of 2023 This bill extends the energy investment tax credit for qualified fuel cell property for eight years.  Under current law, an energy investment tax credit of up to 30% of the cost of qualified fuel cell property is available provided construction of the qualified fuel cell property begins on or before December 31, 2024. This bill extends the energy investment tax credit to include qualified fuel cell property where construction begins on or before December 31, 2032.

Alice Cogswell and Anne Sullivan Macy Act This bill expands special education and related services for children and youth who are deaf, hard of hearing, deafdisabled, blind, visually impaired, or deafblind. The bill establishes additional requirements for states to identify and evaluate children who are deaf, hard of hearing, deafdisabled, blind, visually impaired, or deafblind. A state's closure of a specialized school serving children who are blind or deaf shall count as a reduction of its financial support for special education and related services. The bill also authorizes support, including grants for training special education personnel, to be used in preparing individuals to become qualified teachers and early intervention specialists for children who are deaf, hard of hearing, deafdisabled, or deafblind. The bill establishes within the Department of Education the Anne Sullivan Macy Center on Visual Disability and Educational Excellence to better support students with visual disabilities. 

No Bailout for Sanctuary Cities Act

No Bailout for Sanctuary Cities Act This bill makes a state or political subdivision of a state ineligible for any federal funds the jurisdiction intends to use to benefit non-U.S. nationals (i.e., aliens under federal law) who are unlawfully present if the jurisdiction withholds information about citizenship or immigration status or does not cooperate with immigration detainers. Specifically, such funds are denied to any jurisdiction that has a law, policy, or practice that prohibits or restricts any government entity from maintaining, sending, or receiving information regarding the citizenship or immigration status of any individual; exchanging information regarding an individual's citizenship or immigration status with a federal, state, or local government entity;  complying with a valid immigration detainer from the Department of Homeland Security (DHS); or  notifying DHS about an individual's release from custody. The funding restriction does not apply to a law, policy, or practice that only applies to an individual who comes forward as a victim of or a witness to a criminal offense. The bill applies beginning in the fiscal year following its enactment.

Airport and Airway Extension Act of 2023

Airport and Airway Extension Act of 2023 This bill temporarily extends specific Federal Aviation Administration (FAA) programs and activities through December 31, 2023. For example, the bill extends the FAA Unmanned Aircraft Systems (UAS) pilot programs (e.g., the UAS Test Site Program and the UAS remote detection and identification pilot program), weather reporting programs, Remote Tower Pilot Program, and Essential Air Service Program. The bill also extends the authorization for the Airport Improvement Program (AIP). (This program provides grants for planning, development, and noise compatibility projects at or associated with certain public-use airports.) Further, the bill extends through December 31, 2023, the FAA's authority for expenditures from the Airport and Airway Trust Fund (AATF) and to collect various taxes and fees to fund the AATF, including taxes on aviation fuel and airline tickets. (The AATF is the primary funding source for all major FAA accounts that fund federal aviation programs, with the remainder coming from general fund appropriations.)

Pay Our Border Patrol and Customs Agents Act This bill provides FY2024 appropriations for the salaries and expenses of certain U.S. Customs and Border Protection (CBP) employees who are required to work during a lapse in appropriations (i.e., government shutdown) in FY2024. Specifically, the bill provides appropriations to CBP for the salaries and expenses of agents of the U.S. Border Patrol and officers of the Office of Field Operations who are excepted from furlough (i.e., required to work) during a lapse in discretionary appropriations in FY2024. 

Stop Campus Hazing Act

Stop Campus Hazing Act This bill requires institutions of higher education (IHEs) that participate in federal student aid programs to report hazing incidents. Specifically, the bill requires each IHE to disclose hazing incidents that were reported to campus security authorities or local police agencies in its annual security report. The bill defines the term hazing to mean any intentional, knowing, or reckless act committed by a person against a student (regardless of that student's willingness to participate), that (1) is connected with an initiation into, an affiliation with, or the maintenance of membership in, an organization (e.g., a club, athletic team, fraternity, or sorority); and (2) causes or is likely to contribute to a substantial risk, above the reasonable risk encountered in the course of participation in the IHE or the organization, of physical injury, mental harm, or degradation. In addition, each IHE must develop and distribute as part of its annual security report a statement of policy regarding the following: (1) a comprehensive program to prevent hazing, which must include information on hazing awareness and hazing prevention; and (2) the IHE's current campus policies on hazing, which must include procedures that comply with specified collection and reporting requirements.

Pay Our Troops Act

Pay Our Troops Act This bill provides continuing appropriations for military pay for any period during which interim or full-year appropriations for FY2024 are not in effect (i.e., a government shutdown). Specifically, the bill provides FY2024 continuing appropriations for the pay and allowances of (1) members of the Armed Forces, including reserve components, who perform active service during the period; and (2) civilian employees and contractors of the Department of Defense (and the Department of Homeland Security in the case of the Coast Guard when the Coast Guard is not operating as a service in the Department of the Navy) who are providing support to such members of the Armed Forces. If a government shutdown occurs, the bill provides the continuing appropriations until the earlier of (1) the enactment into law of specified appropriations legislation, or (2) January 1, 2025.

The bill also requires schools to disclose funding from or contracts with a foreign source to the Department of Education.

Seniors’ Access to Critical Medications Act of 2024

Seniors’ Access to Critical Medications Act of 2023 This bill allows physicians to dispense outpatient prescription drugs and related supplies to patients outside of their office buildings without violating certain prohibitions under the Stark law (i.e., the Physician Self-Referral Law) for Medicare and Medicaid. Current law requires physicians to dispense outpatient prescription drugs and related supplies to patients in their office buildings in order to qualify for an exception (the in-office ancillary services exception) under the Stark law. The bill specifies that, beginning on May 11, 2023, physicians may dispense outpatient prescription drugs and related supplies in locations other than their office buildings. The bill also requires the Centers for Medicare & Medicaid Services to withdraw specified guidance that contradicts the bill’s changes.

This bill specifies a legal standard for determining whether an individual is considered an independent contractor rather than an employee for the purposes of federal labor laws that address issues such as the federal minimum wage, overtime compensation, and collective bargaining. The rights and protections provided by these laws exclusively apply to employees. Under the bill, an individual is considered an independent contractor if (1) another individual or entity does not exercise significant control over the details of how the individual's work is performed, without regard to any control the other individual or entity may exercise over the final result of the work performed; and (2) while performing such work, the individual has opportunities and risks inherent with entrepreneurship (for example, the discretion to exercise professional judgment). The bill also sets forth factors that may not be used to determine whether an individual is an employee. Specifically, factors such as whether another individual or entity requires the individual to meet certain legal, health and safety, insurance, or performance requirements may not be used to make such a determination.

9/11 Memorial and Museum Act This bill directs the Department of Homeland Security to award to the nonprofit organization that operates the National September 11 Memorial & Museum in New York City a one-time grant to be used solely for the purposes of the operation, security, and maintenance of the memorial and museum. As a condition of receiving the grant, the organization must provide for free admission to all facilities and museums associated with the memorial and museum for active and retired members of the Armed Forces, individuals who were registered first responders to the terrorist attacks of September 11, 2001, and family members of victims of such attacks; provide for dedicated free admission hours for the general public at least once a week; and allow for annual federal audits of its financial statements.

SSI Savings Penalty Elimination Act

SSI Savings Penalty Elimination Act This bill increases resource limits used to determine eligibility for the Supplemental Security Income (SSI) program. SSI is a federal assistance program that provides monthly cash payments to aged, blind, or disabled individuals with limited income and resources. Specifically, the bill increases the resource limits from $2,000 to $10,000 for individuals and from $3,000 to $20,000 for married couples. The bill annually adjusts the limits for inflation.

Further, The Board of Governors of the Federal Reserve System and the Federal Open Market Committee are prohibited from using a central bank digital currency to implement monetary policy.

Humane Cosmetics Act of 2023

Humane Cosmetics Act of 2023 This bill generally prohibits animal testing in the evaluation of cosmetic products, and it prohibits the sale or transport of cosmetics developed using animal testing, subject to civil penalties. These prohibitions begin one year after enactment. The bill specifies exceptions to these prohibitions, including if such animal testing (1) is conducted outside the United States to comply with a foreign regulatory authority; (2) is pursuant to a specified finding that there are no nonanimal alternatives to test the safety of a potentially dangerous cosmetic product or ingredient; (3) is of a product or ingredient for a drug or device subject to regulation by the Food and Drug Administration (FDA); or (4) is required for a noncosmetic purpose pursuant to a state, federal, or foreign regulatory authority. Further, no animal-testing evidence may be used to establish the safety of a cosmetic product or ingredient that is regulated by the FDA after the effective date of this bill, subject to limited exceptions.

Dairy Nutrition Incentive Program Act of 2023

Dairy Nutrition Incentive Program Act of 2023 This bill directs the Department of Agriculture (USDA) to establish a dairy nutrition incentive program to develop and test methods to increase the purchase and consumption of dairy under the Supplemental Nutrition Assistance Program (SNAP). Specifically, the program must provide an incentive to SNAP benefit recipients for the purchase of naturally nutrient-rich dairy, which the bill defines to include fluid milk, yogurt, and cheese made from cow's milk. To carry out the program, USDA must enter into cooperative agreements with, or provide competitive grants to, state or local governments and nonprofit organizations for projects. The bill provides funding for the program for each fiscal year. USDA must provide for an independent evaluation of each project that measures, to the maximum extent practicable, the effect of incentives on purchases of naturally nutrient-rich dairy by SNAP recipients. Projects currently carried out by the USDA Healthy Fluid Milk Incentives (HFMI) program must be transitioned to the new dairy nutrition incentive program; the bill repeals the HFMI program one year after USDA certifies that the transition is complete.

Erie Canal Bicentennial Commemorative Coin Act

Erie Canal Bicentennial Commemorative Coin Act This bill directs the Department of the Treasury to mint and issue 50,000 $5 gold coins, 400,000 $1 silver coins, and 750,000 half-dollar clad coins in recognition of the bicentennial of the Erie Canal. The designs of the coins must be emblematic of the Erie Canal and its impact on the development of the United States and New York. All sales of coins issued under this bill must include a surcharge to be paid to the Erie Canalway Heritage Fund, Inc., to support the historic preservation and community development of the Erie Canalway National Heritage Corridor in New York and for educational and commemorative programs.
