Constitutional Amendment - Prohibits outlays for a fiscal year (except those for repayment of debt principal) from exceeding total receipts for that fiscal year (except those derived from borrowing) unless Congress, by a two-thirds roll call vote of each chamber, authorizes a specific excess of outlays over receipts. Prohibits total outlays for any fiscal year from exceeding 18% of the gross domestic product (GDP) for the preceding calendar year unless Congress, by a two-thirds roll call vote of each chamber, authorizes a specific excess over such 18%. Directs the President to submit a balanced budget to Congress annually. Prohibits any bill from becoming law that imposes a new tax or increases the statutory rate of any tax or the aggregate amount of revenue, unless approved by a two-thirds roll call vote of each chamber. Requires a three-fifths roll call vote of each chamber to increase the federal debt limit. Authorizes waivers of these requirements: (1) when a declaration of war is in effect against a nation-state and Congress, by a majority roll call vote of each chamber, authorizes a specific excess; or (2) under other specified circumstances involving military conflict, if Congress, by a three-fifths roll call vote of each chamber, authorizes such waiver. Prohibits a federal or state court from ordering any increase in revenue to enforce this article.

Small Business Contracting Fraud Prevention Act of 2011 - Amends the Small Business Act to include under penalties for misrepresentation a business that misrepresents itself as a small business owned and controlled by service-disabled veterans. Includes under such penalties misrepresentation for purposes of the award of a grant or cooperative agreement through the Small Business Administration (SBA). (Current law addresses only awards of prime contracts or subcontracts.) Expands authorized remedies to include civil remedies available under the False Claims Act, as well as the amount actually received from the federal government under a contract, grant or cooperative agreement, or losses sustained. Provides additional events or instances under which a person shall be considered to have misrepresented its status. Requires an entity seeking status as a small business owned and controlled by service-disabled veterans to submit an annual certification of such status, and to register with specified databases that track veteran small businesses. Directs: (1) the Secretary of Veterans Affairs (VA) to verify such status; and (2) the head of a federal agency awarding a sole source contract to such business to use the appropriate database to verify such status. Provides for small business debarment and suspension for violations. Amends the 8(a) (SBA general small business loan) program to direct the Comptroller General, every three years, to evaluate the 8(a) program and report evaluation results to the congressional small business committees. Requires related 8(a) program oversight by the SBA Administrator. Directs the Administrator to: (1) ensure the accuracy and revision of HUBZone (heavily underutilized business zone) maps; (2) ensure that only small businesses determined to be qualified to participate in HUBZone programs are participating; and (3) develop measures and implement plans to assess the effectiveness of the HUBZone program. Requires an annual report from the Administrator on suspensions, debarments, and prosecutions related to unauthorized participation in, or misrepresentation under, SBA programs.

Comprehensive Assessment of Regulations on the Economy Act of 2011 - Establishes within the Department of Commerce the Cumulative Regulatory Assessment Committee to assess the cumulative energy and economic impacts of federal regulatory mandates that: (1) are promulgated or issued (or are expected to be initiated) by the Administrator of the Environmental Protection Agency (EPA) or a state or local government from January 1, 2010, to January 1, 2020; (2) apply to one or more impacted unit; and (3) implement any provision or requirement relating to interstate or international transport of air pollution with respect to any national ambient air quality standard, attainment of any such standard, new source performance standards, hazardous air pollutants, greenhouse gas emissions, cooling water intake structures, effluent guidelines for regulating the discharge of pollutants, the handling and disposal of coal combustion residuals, the regulation of fuels, or regional haze or reasonably attributable visibility impairment under the Clean Air Act or any other environmental regulations expected to have a significant impact on the electric power sector, the petroleum refining sector, the petrochemical production sector, pipeline facilities regulated by the Department of Transportation (DOT) or EPA, exploration, production, or transportation of oil and natural gas, or any other manufacturing sector. Defines "impacted unit" as any: (1) electric generating unit that sells electricity into the grid; (2) industrial, commercial, or institutional boiler or process heater; (3) petroleum refining facility that produces gasoline, heating oil, diesel fuel, jet fuel, kerosene, or petrochemical feedstocks; (4) petrochemical facility; (5) hydrocarbon exploration, extraction, manufacturing, production, or transportation facility; or (6) biofuel facility.

Child Care Protection Act of 2011 - Amends the Child Care and Development Block Grant Act of 1990 to require states that receive funds under such Act to: (1) require and conduct criminal background checks for staff members of child care providers; (2) prohibit the employment of a child care staff member who refuses to consent to a criminal background check, makes a false statement in connection with such background check, is registered as a sex offender, or is a convicted felon involving certain crimes; and (3) provide criminal background checks to child care providers upon request. Boutique Fuel Reduction Act of 2011 - Amends the Clean Air Act to authorize the Administrator of the Environmental Protection Agency (EPA) to temporarily waive a control or prohibition respecting the use of a fuel or fuel additive if: (1) it is in the public interest to grant such a waiver; and (2) the Administrator determines, and the Secretary of Energy (DOE) concurs, that extreme and unusual fuel or fuel additive supply circumstances exist that are the result of an unexpected problem with distribution or delivery equipment. Requires the Administrator, after providing notice and an opportunity for comment, to remove a fuel from the list of approved fuels under all state implementation plans (SIPs) if the Administrator determines that the fuel: (1) has ceased to be included in any SIP (current law), or (2) is identical to a federal fuel control or prohibition established and enforced by the Administrator (currently, identical to a federal fuel formulation implemented by the Administrator). Directs the Administrator, on removing a fuel from the list, to publish a revised list that reflects such removal. Repeals the limitation on the Administrator's authority to approve a control or prohibition respecting any new fuel in a SIP plan if such new fuel increases the total number of fuels on such list. Provides that nothing in such Act limits the authority of the Administrator to approve a control or prohibition relating to any new fuel in a SIP if: (1) the new fuel completely replaces a fuel on the list published; and (2) the Administrator publishes in the Federal Register, after providing notice and an opportunity for public comment, a determination that the control or prohibition will not cause any fuel supply or distribution interruption or have any significant adverse impact on fuel producibility in the affected area or any contiguous area.

Energy Tax Prevention Act of 2011 - Amends the Clean Air Act to prohibit the Administrator of the Environmental Protection Agency (EPA) from promulgating any regulation concerning, taking action relating to, or taking into consideration the emission of a greenhouse gas (GHG) to address climate change. Excludes GHGs from the definition of "air pollutant" for purposes of addressing climate change. Exempts from such prohibition: (1) implementation and enforcement of the rule, "Light-Duty Vehicle Greenhouse Gas Emission Standards and Corporate Average Fuel Economy Standards" and finalization, implementation, enforcement, and revision of the proposed rule, "Greenhouse Gas Emissions Standards and Fuel Efficiency Standards for Medium- and Heavy-Duty Engines and Vehicles"; (2) implementation of the renewable fuel program; (3) statutorily authorized federal research, development, and demonstration programs addressing climate change; (4) implementation and enforcement of stratospheric ozone protection to the extent that such implementation or enforcement only involves class I or II substances; and (5) implementation and enforcement of requirements for monitoring and reporting of carbon dioxide emissions. Provides that none of such exemptions shall cause a GHG to be subject to regulations relating to prevention of significant deterioration of air quality or considered an air pollutant for purposes of air pollution prevention and control permits. Repeals and makes ineffective specified rules and actions concerning permit requirements or emission standards for GHGs to address climate change. Prohibits the Administrator from waiving, and invalidates waivers given by the Administrator before the enactment of this Act, the ban on states from adopting or enforcing standards relating to the control of emissions from new motor vehicles or engines with respect to GHG emissions for model year 2017 or any subsequent model year.

Small Business Regulatory Freedom Act of 2011

Small Business Regulatory Freedom Act of 2011 - Amends the Regulatory Flexibility Act (RFA) to revise the regulatory process (rulemaking) with respect to small entities (i.e., small businesses, small organizations, and small governmental jurisdictions). Defines "economic impact" with respect to a proposed or final rule to mean: (1) any direct economic effect of a rule on small entities, and (2) any indirect economic effect on such entities, including potential job creation or job loss. Expands judicial review of agency rulemaking to permit small entities to seek judicial review of initial regulatory flexibility analyses and to obtain an injunction of a proposed rule that is noncompliant with RFA requirements. Requires each agency to establish a plan for the periodic review (every eight years) of: (1) its rules that have a significant adverse economic impact on small entities, and (2) any small entity compliance guide required to be published by an agency. Sets forth criteria for review of a rule, including the continued need for the rule, the complexity of the rule, and the impact of the rule on small entities. Terminates any rule if the issuing agency has failed to complete a required periodic review. Expands to all agencies the procedures for gathering comments on rules that will have a significant economic impact on small entities. Extends RFA requirements to informal agency guidance documents. Amends the Small Business Regulatory Enforcement Fairness Act of 1996 to require each agency to review on a periodic basis its policies or programs for imposing regulatory penalties on small entities. Imposes certain additional requirements on agencies prior to the issuance of a final rule, including requirements for: (1) publication of an initial regulatory flexibility analysis, (2) a determination of the average cost of a rule for affected small entities and the number of small entities affected or reasonably presumed to be affected, and (3) consultation with the Chief Counsel for Advocacy for the Small Business Administration (SBA). Requires the Chief Counsel for Advocacy of the SBA to be an attorney with business experience and expertise in or knowledge of the regulatory process.

Mining Jobs Protection Act - Amends the Federal Water Pollution Control Act (commonly known as the Clean Water Act) to repeal provisions that require the Administrator of the Environmental Protection Agency (EPA) to consult with the Secretary of the Army before denying or restricting the use of specified areas as disposal sites for discharges of dredged or fill material into waters of the United States. Requires the Administrator to provide, within specified timeframes, to: (1) the Secretary notice of any concerns with respect to a specification for a disposal site proposed to be issued under a permit to discharge into navigable waters; and (2) the Secretary and permit applicants the reasons for any disapproval of permits. Removes the Administrator's authority to prohibit the specification of any defined area as a disposal site: (1) 60 days after the Administrator receives the proposed specification from the Secretary for review; and (2) once the Secretary has issued a permit for dredged or fill material. Authorizes the Secretary to reevaluate and reissue, or to elect not to reissue, a specification in any case in which, before the enactment of this Act, the Administrator disproved of a specification after it was issued by the Secretary. Sets forth requirements that must be met before the Administrator or the head of another agency requests that a proposed permit for dredged or fill material receive a higher level of review by the Secretary.

Provides that EPCA shall be applied and administered as if such provisions had not been enacted.

Limits non-security discretionary spending limits: (1) for FY2011-FY2016 to the levels provided in FY2008; and (2) for FY2017-FY2021 to such amount adjusted annually for inflation. Defines "non-security discretionary spending" as discretionary spending other than spending for the Department of Defense (DOD), homeland security activities, intelligence-related activities within the Department of State, the Department of Veterans Affairs (VA), and national security related activities in the Department of Energy (DOE). Requires the President to issue a sequestration order, effective on issuance, if the Office of Management and Budget (OMB) in its Final Discretionary Sequestration Report estimates that any sequestration is required. Subjects to permanent cancellation any budgetary resources sequestered from any account, except those in special fund accounts or offsetting collections sequestered in appropriation accounts. Applies the same percentage sequestration to all programs, projects, and activities within a budget account. Requires Discretionary Sequestration Preview Reports by: (1) OMB to the President and Congress; and (2) the Congressional Budget Office (CBO) to Congress. Requires the OMB report to explain the difference between OMB and CBO estimates for each item. Requires the Final Discretionary Sequestration Reports to set forth estimates for: (1) the current year and each subsequent year through 2021; (2) the current year, if applicable, and, the budget year, the new budget authority and the breach, if any; (3) the sequestration percentages necessary to eliminate the breach; and (4) the level of enacted sequesterable budget authority, and resulting estimated outlays to be sequestered for each account. Sets forth sequestration enforcement mechanisms.

Regulatory Responsibility for our Economy Act of 2011 - Sets forth general requirements for the federal regulatory system, including the protection of public health, welfare, safety, and the environment, the promotion of predictability in the regulatory process, and the consideration of benefits and costs of regulations. Requires federal agencies to: (1) propose or adopt regulations only upon a reasoned determination that the benefits of such regulations justify their costs; (2) tailor regulations to impose the least burden on society and to maximize economic and other benefits; (3) involve the public and parties affected by regulations in the regulatory process; (4) develop regulatory actions that promote innovation, flexibility, and objectivity; and (5) consider methods to promote retrospective analysis of rules that may be outmoded, ineffective, insufficient, or excessively burdensome, and develop plans for reviewing on a periodic basis significant regulation actions (i.e., those having an annual effect on the economy of $100 million or more or otherwise adversely affecting the economy).

No Surface Occupancy Western Arctic Coastal Plain Domestic Energy Security Act - Authorizes exploration, leasing, development, and production of oil and gas from the Western Coastal Plain. Defines the Western Coastal Plain as the area of Coastal Plain: (1) that borders the land of Alaska to the west and Alaska offshore waters of the Beaufort Sea on the north, and (2) from which the Secretary of the Interior finds oil and gas can be produced through horizontal drilling or other subsurface technology from sites outside or underneath the Coastal Plain surface. Authorizes the Secretary to establish a competitive oil and gas leasing program that will result in an environmentally sound program for the exploration, development, and production of the oil and gas resources of the Western Coastal Plain. Considers such program to be compatible with the purposes for which the Arctic National Wildlife Refuge was established. Directs the Secretary to: (1) establish lease sale procedures, and (2) offer for lease those tracts the Secretary considers to have the greatest potential for the discovery of hydrocarbons. Authorizes the Secretary to grant a lease for land on the Western Coastal Plain to the highest responsible qualified bidder. Prescribes lease terms and conditions. Provides for expedited judicial review. Directs the Secretary to establish in the Treasury the Coastal Plain Local Government Impact Aid Assistance Fund to offset any planning, land use-related, or service-related impacts of offshore development caused by this Act. Prescribes a scheme for the allocation of revenues produced by bonus, rental, and royalty revenues from the federal oil and gas leasing and operations authorized under this Act.

Unborn Child Pain Awareness Act of 2011 - Amends the Public Health Service Act to require an abortion provider who knowingly performs an abortion of a pain-capable unborn child (defined as an unborn child who has reached a probable stage of development of 20 weeks or more after fertilization), to first: (1) inform the woman of the probable age of the child, (2) provide to the woman an Unborn Child Pain Awareness Brochure (unless she waives receipt), (3) provide information that pain medicine administered to the mother may not prevent pain in the child, but in some cases anesthesia or pain-reducing drugs can be administered directly to the child, (4) give the woman the provider's best medical judgment of the risks and costs of such anesthesia or analgesic, and (5) obtain the woman's signature on the Unborn Child Pain Awareness Decision Form and her explicit request for or refusal of the administration of drugs to the child. Requires the Secretary of Health and Human Services (HHS) to develop the Unborn Child Pain Awareness Brochure that includes a statement that there is substantial evidence that the process of being killed in an abortion will cause the unborn child pain and that the mother has the option of having pain-reducing drugs administered directly to the child. Creates an exception to save the life of the mother. Establishes civil penalties for willfully failing to comply with this Act. Authorizes: (1) the U.S. Attorney General (DOJ) to bring a civil action under this Act, and (2) private rights of action for violations of this Act.

Provides that if a joint resolution of approval of a major rule is not enacted by the end of 70 session days or legislative days after the agency proposing the rule submits its report on such rule to Congress, the rule shall be deemed not to be approved and shall not take effect. Permits a major rule to take effect for 90 calendar days without such approval if the President determines such rule is necessary because of an imminent threat to health or safety or other emergency, for the enforcement of criminal laws, for national security, or to implement an international trade agreement. Sets forth House and Senate procedures for joint resolutions approving major rules and disapproving non-major rules.

Prohibits any bill to levy a new tax or increase the rate of any tax from becoming law unless approved by a two-thirds roll call vote of each chamber. Requires a two-thirds roll call vote of each chamber to increase the public debt limit. Grants Members of Congress standing and a cause of action to seek judicial enforcement of this article when authorized to do so by a petition signed by one-third of the Members of either chamber. Prohibits a federal or state court from ordering any increase in revenue to enforce this article.

Defending America's Affordable Energy and Jobs Act - Prohibits the President or any federal agency head from promulgating regulations providing for the control of emissions of a greenhouse gas (GHG), enforcing or implementing any law enacted as of the date of enactment of this Act that provides for the control of GHG emissions, taking action relating to or taking into consideration the climate effects of GHG emissions, considering climate effects in implementing or enforcing laws, or conditioning or denying any approval based on climate effects, unless the law, action, or consideration is: (1) determined to be necessary to protect the public health from imminent and substantial harm caused by direct human exposure to the relevant GHG in a concentration that is substantially greater than current and projected future average concentrations of that GHG gas in the global atmosphere; and (2) based solely on effects other than effects relating to atmospheric concentrations of GHG, including climate change. Excepts: (1) regulation of, action with respect to, or consideration of a GHG under the Clean Air Act (CAA) with respect to stratospheric ozone protection other than for the potential or actual effect of the GHG on climate change; or (2) voluntary incentive programs to promote the development or deployment of technologies that reduce GHG emissions. Provides that: (1) the authority of the Secretary of Transportation (DOT) to prescribe average fuel economy standards for automobiles does not include any authority with respect to GHGs and is unaffected by this Act; and (2) the requirements set forth in the final rule entitled "Light-Duty Vehicle Greenhouse Gas Emission Standards and Corporate Average Fuel Economy Standards; Final Rule" remain in effect. Nullifies each other rule promulgated and action taken by the Administrator of the Environment Protection Agency (EPA) before the date of enactment of this Act to regulate GHGs for effects relating to atmospheric concentrations of GHGs. Prohibits any law, regulation, or action relating to GHGs from: (1) having any impact on the regulation of stationary sources under CAA; or (2) being considered to be the regulation of pollutants under CAA for any purpose (other than for the regulation of GHG emissions for light-duty motor vehicles from model years 2012 through 2016). Prohibits the Administrator from granting any waiver that allows any state to establish GHG emission standards for new motor vehicles and emission standards for motor vehicle engines of model year 2017 or later and invalidates any waiver granted before enactment of this Act. Provides that any provision of a state implementation plan designating GHGs as pollutants that are subject to regulation or otherwise authorizing or requiring limitations on the emission of GHGs under state law is not federally enforceable and is deemed to be stricken from such plan. Prohibits the President or agency heads from examining or making findings or conclusions for purposes of promulgating or issuing policy, guidance, or regulations to address the impacts of GHG emissions on climate change, except as authorized by this Act or another Act of Congress. Prohibits any cause of action from being brought or maintained, or any liability, money damages, or injunctive relief arising from such an action from being imposed, for any contribution of a GHG to climate change or any effect of atmospheric concentrations of a GHG. Prohibits a state from having the authority to: (1) require any entity to procure, hold, or surrender allowances for the emission of GHGs that takes place outside the state; (2) regulate or tax GHG emissions produced outside of the state; or (3) limit the importation of products or electricity into the state based on GHG emissions occurring outside the state.
