Transportation Security Screening Modernization Act of 2024

Transportation Security Screening Modernization Act This bill directs the Transportation Security Administration (TSA) to streamline the process for individuals applying for or renewing enrollment in multiple security threat assessment (STA) programs, in particular the Transportation Worker Identification Credential (TWIC) and the Hazardous Materials Endorsement (HME) programs. Among other things, the TSA must permit an individual to enroll at a TSA-authorized enrollment center once and use the application, as well as information generated by TSA’s vetting, to enroll in any other programs; permit an individual to enroll in more than one STA program at the same time for a single fee that is less than the combined fee for applying to the same programs separately; provide for a streamlined and expeditious renewal process; and provide states the expiration dates for each individual’s STA to ensure commercial driver's licenses include an individual's current HME status. Additionally, the TSA must publish on its website information relating to the streamlining of the enrollment system. If the TSA determines it is necessary to implement these changes through rulemaking, the bill provides for an expedited rulemaking process.

Laken Riley Act This bill requires the Department of Homeland Security (DHS) to detain certain non-U. S. nationals ( aliens under federal law) who have been arrested for burglary, theft, larceny, or shoplifting. The bill also authorizes states to sue the federal government for decisions or alleged failures related to immigration enforcement. Under this bill, DHS must detain an individual who (1) is unlawfully present in the United States or did not possess the necessary documents when applying for admission; and (2) has been charged with, arrested for, convicted for, or admits to having committed acts that constitute the essential elements of burglary, theft, larceny, or shoplifting. The bill also authorizes state governments to sue for injunctive relief over certain immigration-related decisions or alleged failures by the federal government if the decision or failure caused the state or its residents harm, including financial harm of more than $100. Specifically, the state government may sue the federal government over a decision to release a non-U. S. national from custody; failure to fulfill requirements relating to inspecting individuals seeking admission into the United States, including requirements related to asylum interviews; failure to fulfill a requirement to stop issuing visas to nationals of a country that unreasonably denies or delays acceptance of nationals of that country; violation of limitations on immigration parole, such as the requirement that parole be granted only on a case-by-case basis; or failure to detain an individual who has been ordered removed from the United States.

America's Conservation Enhancement Reauthorization Act of 2024 This bill reauthorizes through FY2030 and modifies several wildlife and conservation programs, including the Chronic Wasting Disease Task Force, the management of invasive species under the Fish and Wildlife Coordination Act, the North American Wetlands Conservation Act, the National Fish and Wildlife Foundation Establishment Act, the Chesapeake Bay Program, the Chesapeake Bay Initiative Act of 1998, and fish habitat conservation projects under the America's Conservation Enhancement Act. In addition, the bill modifies the America's Conservation Enhancement Act, including to provide statutory authority for the U.S. Fish and Wildlife Service (FWS) to carry out a black vulture livestock protection program that allows one public entity per state to hold a statewide depredation permit to protect commercial agriculture livestock from black vulture predation. It also authorizes appropriations for the FWS to complete the National Fish Habitat Assessment and the associated database. Finally, the bill extends through FY2030 a prohibition on the Environmental Protection Agency taking any action to regulate the lead content of sport fishing equipment or components under the Toxic Substances Control Act.

Disrupt Explicit Forged Images and Non-Consensual Edits Act of 2024 or the DEFIANCE Act of 2024 This bill establishes a civil cause of action for individuals who are the subject of nonconsensual digital forgeries (commonly known as deepfakes) depicting intimate activity or nudity. Under the bill, digital forgery is any intimate visual depiction of an identifiable individual created through the use of software, machine learning, artificial intelligence, or any other computer-generated or technological means that is indistinguishable from an authentic visual depiction of the individual. Specifically, an identifiable individual who is the subject of a digital forgery may bring a civil action against any person who knowingly produces, distributes, solicits, or possesses with the intent to distribute a digital forgery without the individual's consent. Current law provides civil remedies, including damages and injunctive relief, for the nonconsensual disclosure of intimate images. This bill makes all relief available for the new cause of action for nonconsensual digital forgeries and expands the relief available for both causes of action. For example, an identifiable individual may recover profits of the defendant that are attributable to the conduct at issue in the claim as part of actual damages. The bill also establishes a 10-year statute of limitations, but tolls the running of the statute of limitations until the individual learns about the violation or the individual turns 18, whichever occurs later. This applies to both current law related to nonconsensual disclosure of intimate images and the new cause of action for nonconsensual digital forgeries.

Overtime Pay for Protective Services Act of 2023 This bill extends through 2028 and modifies the authority to provide premium pay for protective services employees of the U.S. Secret Service that exceeds certain statutory limits on premium pay. The bill also requires the Secret Service to provide related information to Congress. The bill provides that, if the bill is enacted after December 31, 2023, the extension applies as if it were enacted on December 31, 2023. The bill also specifies that employees who perform routine administrative or technical work are not eligible for this premium pay. Next, within 180 days of the bill's enactment, the Secret Service must report to Congress on how it is addressing the demand for Secret Service protection personnel and recommend strategies for reducing the use of overtime. The bill also requires the Secret Service to report to Congress: (1) the number of employees receiving premium pay above the statutory cap; (2) the number of employees who were not fully compensated due to the statutory cap and the total amount that employees would have been paid without the cap; (3) the total, median, mean, and greatest amounts of premium pay above the cap; and (4) a list of personnel who received premium pay above the cap and separated from the agency. This information must be provided for each calendar year and updated quarterly. Further, the Secret Service must report to Congress on the effect that the bill has had on this data.

Black Vulture Relief Act of 2023

Black Vulture Relief Act of 2023 This bill allows livestock producers and their employees to take certain actions against black vultures to protect livestock. (Black vultures are protected under the Migratory Bird Treaty Act.) Specifically, livestock producers and their employees may (1) take (i.e., capture, kill, or disperse, or transport the carcass of) a black vulture that they reasonably believe will cause death, injury, or destruction to livestock; or (2) in the course of taking or attempting to take the black vulture, cause injury to the bird. However, they may not take or attempt to take a black vulture through the use of poison. Livestock producers and their employees must submit an annual report to the U.S. Fish and Wildlife Service (FWS) on black vultures taken under this bill. The FWS must make this reporting form available on its website. Currently, the FWS has a permit process under the Migratory Bird Treaty Act for the taking of black vultures.

Southern Border Transparency Act of 2023 This bill requires various reports on immigration, particularly regarding individuals paroled into the United States. The U.S. Customs and Border Protection must monthly publish details on non-U.S. nationals ( aliens under federal law) paroled into the United States at ports of entry or individuals encountered between land ports of entry and subsequently granted parole. The report must include details regarding citizenship, nationality, and demographic information. U.S. Citizenship and Immigration Services must quarterly publish the number of humanitarian parole petitions received and the number of those granted, disaggregated by nationality. Quarterly, the Department of Homeland Security (DHS) must report on individuals encountered or apprehended at the southern U.S. border and within nearby patrol sectors. The report must contain information including citizenship, nationality, demographics, the number receiving fear of persecution screenings, and immigration outcomes. DHS must also annually report on individuals paroled into the United States on humanitarian grounds, including demographics, employment authorizations, and current immigration status.
