Save Our Savings Act of 1996

TABLE OF CONTENTS: Title I: Cap Entitlements and Other Mandatory Spending Title II: Enforcement Provisions Save Our Savings Act of 1996 - Title I: Cap Entitlements and Other Mandatory Spending - Sets forth a timetable for completion of certain budget actions by the President and by the Directors of the Office of Management and Budget (OMB) and of the Congressional Budget Office (CBO). (Sec. 103) Applies direct spending caps to all entitlement authority, except for undistributed offsetting receipts and net interest outlays. Sets forth a table of such caps for specified categories of entitlements and other mandatory spending. (Sec. 104) Requires determinations of such direct spending caps (as well as any breaches of such caps and actions necessary to remedy such breaches) to be based on certain economic assumptions for specified future fiscal years, subject to periodic reestimation based on changed economic conditions or changes in eligible population. (Sec. 105) Provides for automatic adjustments to the caps for entitlements and other mandatory spending. Allows the direct spending caps to be revised in a specified manner, only by recorded vote. Title II: Enforcement Provisions - Provides for enforcement of the direct spending caps on categories of spending established under title I of this Act. Applies specified enforcement rules and procedures for any fiscal year in which direct spending exceeds the applicable direct spending cap. (Sec. 202) Directs OMB to: (1) compile a statement of actual direct spending for a fiscal year, following the end of that year, identifying such spending by categories of entitlements and other mandatory spending; and (2) under specified conditions, issue a report to the President and the Congress, estimating necessary spending reductions. Sets forth a timetable for specified budget actions by the President and by OMB and CBO. (Sec. 203) Subjects all direct spending (except matters specifically exempted under this title) to caps on total direct spending outlays for each fiscal year. Establishes separate caps, consistent with the cap on total outlays, for: (1) any entitlement program named in the table in title I; (2) such other program or groups of programs for which additional caps are established in subsequent legislation; and (3) the remainder of direct spending programs. Prohibits the total of the separate caps from title I, plus any additional separate caps subsequently established, from exceeding the cap for total direct spending, as appropriately adjusted. Sets forth: (1) general rules triggering sequestration to reduce spending for programs subject to direct spending caps; (2) special rules for programs with certain characteristics; and (3) rules for insurance programs, loan programs, and State grant program formulas. Requires a within session sequester under certain conditions. (Sec. 204) Exempts from sequestration specified programs and activities, in terms of their budget accounts, activities within accounts, or income. Authorizes the President to exempt any military personnel account from sequestration or provide for a lower uniform percentage reduction than would otherwise apply, if the Congress is notified of the manner in which such authority will be exercised on or before the initial snapshot date for the budget year. (Sec. 205) Sets forth special rules for sequestration orders for: (1) the child support enforcement program under the Social Security Act; (2) the Commodity Credit Corporation; (3) the earned income tax credit; (4) regular and extended unemployment compensation; (5) the Federal Employees Health Benefits Fund; (6) the Federal Housing (Finance) Board; (7) Federal personnel pay; (8) the Medicare program under the Social Security Act; (9) the Postal Service Fund; (10) the Department of Energy power marketing administration funds or the Tennessee Valley Authority fund; and (11) programs which provide a businesslike service in exchange for a fee. (Sec. 206) Directs CBO and OMB to report to the President and the Congress the budget baselines for the budget year and at least the subsequent nine fiscal years. Requires submission of the CBO report on or before January 15. Requires the OMB report to accompany the President's budget. Specifies requirements for the budget baseline.

Highway Funding Fairness Act of 1996 - Requires the Secretary of Transportation, for FY 1997, to determine the Federal-aid highway apportionments and allocations to a State without regard to the approximately $1.596 billion credit to the Highway Trust Fund (other than the Mass Transit Account) of estimated taxes paid by States that was made by the Secretary of the Treasury for FY 1995 in correction of an accounting error made in FY 1994. Requires the Secretary, for each State, to: (1) determine whether the State would have been apportioned and allocated an increased or decreased amount for Federal-aid highways for FY 1996 if such error had not been made; and (2) adjust such amount for FY 1997 by the amount of the increase or decrease and to adjust accordingly the obligation limitation for Federal-aid highways distributed to the State under provisions of the Department of Transportation and Related Agencies Appropriations Act, 1997. States that nothing in this Act shall affect any apportionment, allocation, or distribution of obligation limitation, or reduction thereof, to a State for Federal-aid highways for FY 1996.

Indian Child Welfare Act Amendments of 1996 - Amends the Indian Child Welfare Act of 1978 to provide for retention by an Indian tribe of exclusive jurisdiction over child custody proceedings involving specified Indian children. Revises requirements, with respect to Indian children, regarding: (1) the voluntary termination of parental rights; and (2) the withdrawal of a consent to such voluntary termination or to adoption. Requires a party seeking the voluntary placement of an Indian child or the voluntary termination of parental rights to provide written notice to the Indian child's tribe. Sets forth the requirements for such a written notice. Permits an Indian tribe to intervene only if a child's tribe has filed a written objection, but permits the child's Indian tribe to intervene in any case in which the Indian tribe did not receive a written notice. Provides criminal sanctions for fraudulent representation with respect to any proceeding involving an Indian child.

(Sec. 202) Declares that the purpose of the National Human Genome Research Institute (NHGRI) is to characterize the structure and function of the human genome, including: (1) mapping and sequencing of genes; and (2) addressing related ethical, legal, and social issues. Transfers to NHGRI all functions of the National Center for Human Genome Research. Authorizes appropriations. (Sec. 203) Increases the dollar thresholds for requiring technical and scientific peer review and advisory council approval for contracts and cooperative agreements. (Sec. 204) Revises advisory council requirements. (Sec. 205) Eliminates (or reduces the frequency of) mandated reports by: (1) NIH; (2) various coordinating committees and advisory boards and a task force; and (3) the Secretary of Health and Human Services. Revises requirements regarding research on sudden infant death syndrome. Amends the International Health Research Act of 1960 to eliminate a mandated report by the President. Title III: Specific Institutes and Centers - Subtitle A: National Cancer Institute - Amends the Public Health Service Act to authorize appropriations for the National Cancer Institute and for activities related to breast, gynecological, prostate, and other cancers. Authorizes appropriations regarding conditions associated with diethylstilbestrol (DES). Subtitle B: National Heart Lung and Blood Institute - Authorizes appropriations for the National Heart, Lung, and Blood Institute. Subtitle C: National Institute of Allergy and Infectious Diseases - Authorizes appropriations for research and training regarding tuberculosis and for community-based clinical trials of treatments for infection with the etiologic agent for acquired immune deficiency syndrome (AIDS). Subtitle D: National Institute of Child Health and Human Development - Authorizes appropriations for activities regarding contraception and infertility. Subtitle E: National Institute on Aging - Authorizes appropriations for the National Institute on Aging. Modifies requirements regarding grants to National Alcohol Research Centers. Modifies requirements regarding grants to Drug Abuse Research Centers. Subtitle H: National Institute of Mental Health - Authorizes appropriations for the National Institute of Mental Health. Subtitle I: National Center for Research Resources - Authorizes appropriations for biomedical and behavioral research facilities. Authorizes (currently, requires) reservation of an unspecified amount (currently, $5 million) for regional centers for primate research. (Sec. 382) Mandates grants: (1) for the establishment of general clinical research centers; (2) to support individual careers in clinical research; and (3) to support individual clinical research projects. Authorizes appropriations for each of the grants. (Sec. 384) Modifies: (1) the composition of the Scientific and Technical Review Board on Biomedical and Behavioral Research Facilities; and (2) requirements regarding biomedical and behavioral research facilities grants. (Sec. 402) Increases the maximum annual educational loan repayment that may be made on behalf of health professionals (including, in some cases, those from disadvantaged backgrounds) conducting AIDS, contraception, infertility, or other research. Authorizes appropriations regarding the AIDS research loan repayments. (Sec. 403) Mandates a program of educational loan repayments for health professionals conducting research in areas identified by the NIH Director. Authorizes appropriations. (Sec. 404) Increases the aggregate limit on the number of undergraduate scholarships for professions needed by NIH and the number of loan repayment contracts regarding NIH clinical researchers. Replaces, in provisions authorizing those loan repayments, references to being from disadvantaged backgrounds with a requirement that a specified percentage of appropriated funds be used for such individuals. Authorizes appropriations for the loan repayments. Title V: Research with Respect to AIDS - Authorizes appropriations for: (1) carrying out a comprehensive plan for NIH AIDS activities; and (2) the AIDS emergency discretionary fund. Title VI: General Provisions - Subtitle A: Authority of the Director of NIH - Adds to the authorities of the NIH Director conducting and supporting research training and appointing health care professionals. Subtitle B: Office of Rare Disease Research - Establishes the Office for Rare Disease Research and a related advisory council. Subtitle C: Certain Reauthorizations - Authorizes appropriations for: (1) National Research Service Awards; and (2) the National Foundation for Biomedical Research. Subtitle D: Miscellaneous Provisions - Establishes the National Fund for Health Research. (Sec. 633) Requires, notwithstanding any other provision of law, that the Secretary of Health and Human Services be treated as a nonprofit entity for the purpose of making contributions to the retirement systems of Silvio O. Conte Senior Biomedical Research Service appointees in a manner that will permit the appointees to continue to be fully covered under the retirement systems they were members of immediately before their appointment. Subtitle E: Repeals and Conforming Amendments - Replaces, in provisions limiting administrative expenses, a reference to the National Center for Nursing Research with a reference to the National Institute of Nursing Research. Revises ex officio or other membership regarding various advisory councils and advisory boards. Repeals provisions establishing the National Diabetes Advisory Board, the National Digestive Diseases Advisory Board, the National Kidney and Urologic Diseases Advisory Board, the National Arthritis and Musculoskeletal and Skin Diseases Advisory Board, and the National Deafness and Other Communication Disorders Advisory Board. Removes provisions requiring that the National Academy of Sciences be requested to conduct certain studies on biomedical and behavioral research personnel. Amends the Comprehensive Alcohol Abuse and Alcoholism Prevention, Treatment, and Rehabilitation Act Amendments of 1979 to repeal provisions establishing the National Commission on Alcoholism and Other Alcohol-Related Problems. National Environmental Education Amendments Act of 1996 - Amends the National Environmental Education Act to require development of curricula, materials, and training programs supported by the Environmental Protection Agency's (EPA) Office of Environmental Education to be balanced and scientifically sound. Requires that implementation of the Act be through EPA. Eliminates requirements for a Director and a minimum number of staff. Allows activities to be carried out through grants, cooperative agreements, or contracts. Reduces the percentage of funds to be obligated for environmental education grants of not more than $5,000. Prohibits use of grants for certain lobbying activities. Eliminates provisions for environmental internships and fellowships. Eliminates environmental education awards provided for under such Act, except the President's Environmental Youth Awards. Revises requirements for membership on the National Environmental Education Advisory Council. Revises requirements for membership on the Federal Task Force on Environmental Education to require that it be open to representatives of any Federal agency actively engaged in environmental education. (Under current law, membership must include specified agency representatives.) Eliminates specific requirements for contents of Advisory Council reports. Changes the name of the National Environmental Education and Training Foundation to the Foundation for Environmental Education. Increases the size of the Board of the Directors. Removes the prohibition on the transmission of logos or other means of identification on materials donated to the Foundation for environmental education and training use. Authorizes appropriations. Revises funding limitations. Limits amounts available for administrative costs.
