Interstate Transport Act of 2019 This bill authorizes a person to transport a knife between two states where it is legal to possess, carry, or transport such knife. It sets forth conditions and limitations with respect to the lawful interstate transport of knives, including secure storage requirements.

Never Forget the Heroes: Permanent Authorization of the September 11th Victim Compensation Fund Act This bill funds through FY2090 the September 11th Victim Compensation Fund of 2001. Additionally, the bill modifies the Victim Compensation Fund (VCF): to allow claims to be filed until October 2089, to require VCF policies and procedures to be reassessed at least once every five years (currently, at least once annually), to require claimants to be paid for the amount by which a claim was reduced on the basis of insufficient funding, to remove the cap on noneconomic damages in certain circumstances, and to adjust the annual limit on economic loss compensation for inflation.

Restore Our Parks Act This bill (1) establishes the National Park Service Legacy Restoration Fund, and (2) requires 50% of all energy development revenues for FY2019-FY2023 to be deposited into such fund. Amounts deposited in the fund must not exceed $1.3 billion for any fiscal year and must be used for meeting the priority deferred maintenance needs of the National Park Service.

Let Everyone Get Involved in Opportunities for National Service Act or the LEGION Act This bill authorizes The American Legion to expand membership eligibility to include veterans and servicemembers who served during times that were not designated periods of war. Currently, only veterans and servicemembers who served during periods of time specified by Congress are eligible to join The American Legion.

Prescription Drug Monitoring Act of 2019 This bill expands the notification and reporting requirements with respect to potentially addictive prescription drugs for states receiving funds for a Prescription Drug Monitoring Program (PDMP). Dispensers of these drugs, which includes substances listed in schedule II, III, or IV of the Controlled Substances Act, must consult with the PDMP before starting treatment involving such drugs and report each prescription of such drugs to the PDMP within 24 hours. The state agency administering a PDMP must analyze reported data for patterns of controlled substance misuse or abuse and provide certain information to law enforcement, the public, and other states.

Home Health Payment Innovation Act of 2019 This bill makes a series of changes relating to payment and coverage of home health services under Medicare and Medicare Advantage (MA). Specifically, the bill allows the home-confinement requirement (also known as the homebound requirement) for home health services to be waived under Medicare and MA. Currently, as a condition of eligibility for such services, a physician must certify that an individual has difficulty leaving home without assistance (e.g., a wheelchair, special transportation, or help from another person) due to an illness or injury. The bill also alters the payment methodology under the Medicare prospective payment system for home health services, including by eliminating the requirement that such methodology include certain behavioral assumptions regarding the implementation of specified changes to units of payment and case-mix adjustment factors.

Utilizing Significant Emissions with Innovative Technologies Act or the USE IT Act This bill addresses the capture, utilization, and sequestration of carbon dioxide. The Environmental Protection Agency must (1) establish a competitive prize program for certain technology projects that capture carbon dioxide directly from the air, (2) research and develop technologies or approaches that transform carbon dioxide generated by industrial processes into a product of commercial value, and (3) support research and infrastructure activities relating to carbon dioxide utilization by providing technical and financial assistance. The bill includes the construction of infrastructure for carbon capture (e.g., carbon dioxide pipelines) among those projects subject to performance schedules designed to reduce permitting and project delivery time. The Government Accountability Office must issue a report that identifies grant programs that research carbon capture and utilization technologies and examines whether the programs overlap. The Council on Environmental Quality (CEQ) must publish guidance to (1) facilitate reviews associated with the deployment of carbon capture, utilization, and sequestration projects and carbon dioxide pipelines; and (2) support the development of such projects and pipelines. The CEQ must also establish at least two task forces to (1) identify challenges and successes that permitting authorities and project developers and operators face, and (2) improve the performance of the permitting process and regional coordination.

Budgeting for Opioid Addiction Treatment Act This bill imposes a one cent per milligram fee on the sale of active opioids by the manufacturer, producer, or importer. The fee excludes prescription drugs used exclusively for the treatment of opioid addiction as part of a medically assisted treatment effort. The Department of Health and Human Services (HHS) must establish a program to provide rebates or discounts to cancer and hospice patients to ensure that they do not pay the fee. Any increase in federal revenues from the fee after rebates and discounts are subtracted must be distributed to states under the Substance Abuse Prevention and Treatment Block Grant program. The states must use the funds exclusively for substance abuse (including opioid abuse) efforts in the states, including (1) specified treatment programs, and (2) the recruitment and training of substance use disorder professionals to work in rural and medically underserved communities. HHS must report to Congress on the impact of this bill on the retail cost of opioids and patient access to opioid medication, the effectiveness of the discount or rebate for cancer and hospice patients, how the funds are being used to improve substance abuse treatment efforts, and suggestions for improving access to opioids for cancer and hospice patients and substance abuse treatment efforts.

DEA Enforcement and Authority Act of 2019 This bill modifies enforcement authorities of the Drug Enforcement Administration (DEA). It modifies the required elements of an order to show cause issued by the DEA before it denies, revokes, or suspends a registration for a CSA violation. Specifically, the bill eliminates the requirement for an order to show cause to notify the registrant of the opportunity to submit a corrective action plan. Additionally, the bill modifies the standard of review for an immediate suspension order. Currently, the DEA may immediately suspend the registration of a controlled substances manufacturer, distributor, or dispenser to prevent imminent danger to the public health and safety. This bill lowers the standard for determining imminent danger to the public health and safety—from substantial likelihood of an immediate threat of harm to probable cause that harm will occur.

Clean Start Act This bill establishes a process to seal records related to a nonviolent criminal offense committed by an individual whose substance use disorder is a substantial contributing factor in the commission of the offense. A nonviolent criminal offense is a federal criminal offense that is not a violent offense, a sex offense, a serious drug offense, or an offense with a victim under the age of 18. To be eligible for sealing, an individual who is convicted of a nonviolent criminal offense must, among other things, complete a substance use disorder treatment program or recovery program and complete service in a substance use disorder peer mentorship program. This bill also allows the Department of Justice to give preference to a Community Oriented Policing Services program grant applicant from a state that has in effect (1) a substantially similar law related to sealing adult records, or (2) a law that allows an individual who successfully seals a criminal record to be free from civil and criminal perjury laws.

Protecting Americans from Dangerous Opioids Act This bill requires the Food and Drug Administration (FDA) to revoke approval for an opioid drug for every new opioid drug approved. (Opioids are drugs with effects similar to opium, such as certain pain medications.) In determining the drug for which to revoke approval, the FDA must prioritize revoking approval for drugs that are not abuse deterrent and consider the public health impact of drugs on the market.

FDA Accountability for Public Safety Act This bill establishes additional procedures related to the market approval process for opioids. Under the bill, a Food and Drug Administration (FDA) advisory committee must make recommendations regarding supplemental applications for opioids. Current law requires only that an FDA committee make recommendations on new drug applications. The bill specifies that only the Commissioner of Food and Drugs may approve an opioid-related application against the recommendation of the committee. If the Commissioner approves such an application against a committee recommendation, the Commissioner must submit a report to Congress that includes (1) the evidence regarding patient safety that supports the Commissioner's decision, and (2) a disclosure of any potential conflicts of interest of FDA officials involved in the decision. The Commissioner must also testify before Congress regarding the decision, upon request. The drug in question may not be sold until the Commissioner has submitted the required report.

Changing the Culture of the FDA Act This bill requires the Food and Drug Administration to amend its mission statement to take responsibility for protecting the public health by considering the danger of addiction and overdose death when approving and regulating prescription opioid medications. (Opioid medications are drugs with effects similar to opium, such as certain pain medications.)

Aretha Franklin Congressional Gold Medal Act This bill instructs the Speaker of the House of Representatives and the President pro tempore of the Senate to arrange for the posthumous presentation of a Congressional Gold Medal in commemoration of Aretha Franklin. After the award of the medal, it shall be given to the Smithsonian Institution, where it shall be displayed as appropriate and made available for research.

Chronic Wasting Disease Transmission in Cervidae Study Act This bill requires the Animal and Plant Health Inspection Service and the U.S. Geological Survey to contract the National Academy of Sciences to study the predominant pathways and mechanisms of the transmission of chronic wasting disease in wild, captive, and farmed populations of deer, elk, reindeer, and moose populations in the United States.

This bill allows tax-exempt distributions from qualified tuition programs (known as 529 plans) to be used for expenses required for programs to obtain a recognized postsecondary credential or occupational license. A "recognized postsecondary credential" is a credential consisting of an industry-recognized certificate or certification, a certificate of completion of an apprenticeship, a license recognized by the state involved or federal government, or an associate or baccalaureate degree.

Training the Next Generation of Primary Care Doctors Act of 2019 This bill alters funding provisions, and establishes additional reporting requirements, relating to the Teaching Health Center Graduate Medical Education Program, which is administered by the Health Resources and Services Administration (HRSA). The program supports training for primary-care-physician and dental residents at community-based clinics. The bill (1) establishes certain parameters for payments to approved and newly approved graduate medical-residency training programs, and (2) requires HRSA to publish a report regarding new and expanded programs.

GEAR UP for Success Act of 2019 This bill reauthorizes through FY2025 and revises the Gaining Early Awareness and Readiness for Undergraduate Programs (GEAR UP). The bill adds metrics for program evaluations and makes other revisions to GEAR UP, including with respect to authorized uses of funds.

Home Health Care Planning Improvement Act of 2019 This bill allows Medicare payment for home health services ordered by a nurse practitioner, a clinical nurse specialist, a certified nurse-midwife, or a physician assistant. Currently, coverage is provided only for services ordered by a physician.

Biennial Budgeting and Appropriations Act This bill requires biennial budget resolutions, appropriations bills, and government strategic and performance plans, instead of the annual budget process required under current law. The bill specifies that budget biennium is the two consecutive fiscal years beginning on October 1 of any odd-numbered year. The Office of Management and Budget must report to Congress on the impact and feasibility of changing the definition of a fiscal year and the budget process based on that definition to a two-year fiscal period.

Paycheck Fairness Act This bill addresses wage discrimination on the basis of sex. It amends equal pay provisions of the Fair Labor Standards Act of 1938 to (1) restrict the use of the bona fide factor defense to wage discrimination claims, (2) enhance nonretaliation prohibitions, (3) make it unlawful to require an employee to sign a contract or waiver prohibiting the employee from disclosing information about the employee's wages, and (4) increase civil penalties for violations of equal pay provisions. The Equal Employment Opportunity Commission (EEOC) and the Office of Federal Contract Compliance Programs shall train EEOC employees and other affected parties on wage discrimination. The bill directs the Department of Labor to: (1) establish and carry out a grant program for negotiation skills training for girls and women, (2) conduct studies to eliminate pay disparities between men and women, and (3) make available information on wage discrimination to assist the public in understanding and addressing such discrimination. The Secretary of Labor's National Award for Pay Equity in the Workplace is established for an employer who has made a substantial effort to eliminate pay disparities between men and women. The bill requires the EEOC to issue regulations for collecting from employers compensation and other employment data according to the sex, race, and national origin of employees for use in enforcing laws prohibiting pay discrimination.

This bill directs the Department of State to include additional information in its annual reports concerning Taiwan's participation at the World Health Organization's World Health Assembly (WHA) as an observer. The report shall describe changes and improvements to the State Department's plan to support Taiwan's observer status at the WHA, following any meetings at which Taiwan did not participate under such status. (China has opposed Taiwan's participation, based on its position that Taiwan is part of China and not a separate country.)

Christa McAuliffe Commemorative Coin Act of 2019 This bill directs the Department of the Treasury to mint and issue not more than 350,000 $1 silver coins in commemoration of Christa McAuliffe, a teacher tragically killed in the Space Shuttle Challenger Disaster. The design of the coins shall bear an image and the name of Christa McAuliffe on the obverse side and a design on the reverse side that depicts the legacy of McAuliffe as a teacher. Treasury may issue the coins from January 1-December 31, 2020. All surcharges received by Treasury from the sale of the coins shall be paid to the FIRST robotics program for the purpose of engaging and inspiring young people, through mentor-based programs, to become leaders in the fields of science, technology, engineering, and mathematics.

This joint resolution eliminates the deadline for the ratification of the Equal Rights Amendment, which prohibits discrimination based on sex. The amendment was proposed to the states in House Joint Resolution 208 of the 92nd Congress, as agreed to in the Senate on March 22, 1972. The amendment shall be part of the Constitution whenever ratified by the legislatures of three-fourths of the states.

Department of Veterans Affairs Provider Accountability Act The bill requires the Department of Veterans Affairs (VA) to transmit specified information to the National Practitioner Data Bank and the applicable state licensing board when the VA brings a major adverse action against certain appointed VA medical employees. Specifically, the VA must transmit the employee's name and the description of and reason for the major adverse action. The VA may not enter into a settlement agreement regarding a claim by a VA employee under which it would be required to conceal a serious medical error or purge a negative record from an employee's personnel file. Such provision shall not apply to a negative record if the VA Office of Accountability and Whistleblower Protection and the Office of Special Counsel jointly certify that the negative record is not legitimate.

This resolution urges the President to work with allies to lead a multinational freedom of navigation operation in the Black Sea to push back against excessive Russian claims of sovereignty. It also calls for the North Atlantic Treaty Organization to enhance allied maritime presence and capabilities in the Black Sea and for European governments to cancel the Nord Stream 2 pipeline due to its threat to European energy security. The resolution also urges the President to provide additional security assistance to Ukraine and states that the President is required by statute to impose mandatory sanctions on Russia.

Emergency Relief for Federal Workers Act of 2019 This bill allows federal employees who are affected by a government shutdown to make certain penalty-free withdrawals from their Thrift Savings Plan (TSP) accounts. The bill waives various penalties and requirements that would otherwise apply to TSP distributions and loans during a government shutdown.

Building Rail Access for Customers and the Economy Act of 2019 or the BRACE Act of 2019 This bill permanently extends the tax credit for railroad track maintenance. The extension applies to expenditures paid or incurred during tax years beginning after 2017. Assignments of miles of railroad track, including related expenditures, for tax years beginning on or after January 1, 2018, and before January 1, 2019, must be treated as effective as of the close of such taxable year if they are made pursuant to a written agreement entered into within 90 days of the enactment of this bill.

Social Media Privacy Protection and Consumer Rights Act of 2019 This bill requires online platform operators to inform a user, prior to a user creating an account or otherwise using the platform, that the user's personal data produced during online behavior will be collected and used by the operator and third parties. The operator must provide a user the option to specify privacy preferences, and an operator may deny certain services or complete access to a user if the user's privacy elections create inoperability in the platform. The operator must (1) offer a user a copy of the personal data of the user that the operator has processed, free of charge, and in an electronic format; and (2) notify a user within 72 hours of becoming aware that the user's data has been transmitted in violation of the security platform. A violation of the bill's privacy requirements shall be considered an unfair or deceptive act or practice under the Federal Trade Commission Act. The Federal Trade Commission (FTC) may enforce this bill against common carriers regulated by the Federal Communications Commission under the Communications Act of 1934 and nonprofit organizations. Currently, common carriers regulated under that Act are exempt from the FTC's enforcement authority, and nonprofit organizations are subject to FTC enforcement only if they provide substantial economic benefit to their for-profit members. A state may bring a civil action in federal court regarding such violations.

Telephone Robocall Abuse Criminal Enforcement and Deterrence Act or the TRACED Act This bill implements a forfeiture penalty for violations (with or without intent) of the prohibition on certain robocalls. The bill also removes an annual reporting requirement for enforcement relating to unsolicited facsimile advertisements. The bill requires voice service providers to develop call authentication technologies. The Federal Communications Commission (FCC) shall promulgate rules establishing when a provider may block a voice call based on information provided by the call authentication framework, but also must establish a process to permit a calling party adversely affected by the framework to verify the authenticity of their calls. The FCC shall also initiate a rulemaking to help protect a subscriber from receiving unwanted calls or texts from a caller using an unauthenticated number. This bill requires the Department of Justice and the FCC to assemble an interagency working group to study and report to Congress on the enforcement of the prohibition of certain robocalls. Specifically, the working group will look into how to better enforce against robocalls by examining issues like the types of laws, policies, or constraints that could be inhibiting enforcement. The bill requires the FCC to initiate a proceeding to determine whether its policies regarding access to number resources could be modified to help reduce access to numbers by potential robocall violators.

Federal Unemployment Compensation Equality Act of 2019 This bill creates statutory authority for certain federal employees to be eligible for unemployment compensation during a lapse in appropriations. With respect to any lapse in appropriations beginning on or around December 22, 2018, a federal employee who is excepted from furlough (i.e., who continues to work during a lapse in appropriations) is deemed eligible for unemployment compensation benefits for the duration of the lapse in appropriations.

Fair Compensation for Low-Wage Contractor Employees Act of 2019 This bill appropriates funding to provide compensation to certain employees of contractors who lost pay or leave due to the lapse in appropriations that began on December 22, 2018. Each agency subject to such lapse shall adjust the price of any contract for which the contractor was ordered to suspend, delay, or stop work as a result of the lapse. The agency shall compensate the contractor for reasonable costs incurred to (1) provide compensation, at an employee's standard rate of compensation, to any employee who was furloughed or laid off, or who was not working, who experienced a reduction of hours, or who experienced a reduction in compensation, as a result of the lapse, for the period of the lapse; or (2) restore paid leave taken by any employee during the lapse, if the contractor required employees to use paid leave as a result of the lapse. The maximum amount of weekly compensation of an employee for which an adjustment may be made may not exceed the lesser of the employee's actual weekly compensation or $965.

Merchant Mariners of World War II Congressional Gold Medal Act of 2019 This bill provides for a Congressional Gold Medal to be awarded to the U.S. Merchant Mariners of World War II, in recognition of their service during World War II. Following the award of the medal, it shall be given to the American Merchant Marine Museum, where it shall be available for display and research.

Disability Integration Act of 2019 This bill prohibits government entities and insurance providers from denying community-based services to individuals with disabilities that require long-term service or support that would enable such individuals to live in the community and lead an independent life. Specifically, these entities may not discriminate against such individuals in the provision of community-based services by such actions as imposing prohibited eligibility criteria, cost caps, or waiting lists or failing to provide a specific community-based service. Additionally, community-based services must be offered to individuals with such disabilities prior to institutionalization. Institutionalized individuals must be notified regularly of community-based alternatives. The bill requires the Department of Justice and the Department of Health and Human Services (HHS) to issue regulations requiring government entities and insurance providers to offer community-based long-term services to individuals with such disabilities who would otherwise qualify for institutional placement. Government entities must ensure sufficient availability of affordable, accessible, and integrated housing that is not a disability-specific residential setting or a setting where services are tied to tenancy. Regulations shall also (1) require government entities and insurance providers to perform self-evaluation on current services, policies, and practices and concerning compliance with requirements of this bill; and (2) require government entities to submit a transition plan. HHS must determine annually whether each government entity is complying with the transition plan and must increase funding for those in compliance. The bill allows civil actions by individuals subjected to, or about to be subjected to, a violation of its requirements.

Target Practice and Marksmanship Training Support Act This bill allows a state to use federal funds to cover a higher percentage of the costs for the construction and expansion of public target ranges. Specifically, a state may use specified federal grant funds to pay up to 90% of such costs (rather than 75%, as under current law). Additionally, amounts provided for these purposes shall remain available for five fiscal years (rather than two, as under current law).

Community Health Investment, Modernization, and Excellence Act of 2019 This bill reauthorizes for FY2020-FY2024 and makes appropriations for the Community Health Center Fund, which provides enhanced funding for the community health center program and the National Health Service Corps.
