The bill harmonizes the regulations of the Commercial Shipping Act with international regulations and practices and improves the wording and structure of the Act. The changes create greater certainty for the parties to cargo transport, passenger transport and cargo contracts when using Estonian law. The bill proposes three major changes. First, with the amendments to the chapter on the contract of carriage of cargo, the law will be brought into line with the Hague-Visby rules by harmonizing with the international practice of commercial maritime law regulation. Secondly, the regulation of charter contracts will be harmonized with the amendments to the law. Thirdly, the regulation of limitation of liability in case of maritime claims will be harmonized with international law and the use of terms will be adjusted so that they correspond to the terms used in international treaties. In the same way, the use of terms in other chapters such as rescue, shipowner, shipowner will be organized and harmonized responsibility, or the definitions are updated to correspond to the preferred terms used in maritime, for example, towing.

According to the bill, land transactions between the local government and the state will be made simpler and more transparent. The opportunities for determining and realizing mutual public interest in the transfer of lands of the state and local governments are harmonized, and the state is given the right to intervene in the acquisition of land in case of public interest. The local government has the obligation to find out the necessity of the immovable property for the state, if the local government starts to alienate or set building rights on the land it owns previously received free of charge from the state. When the land is returned to the state, the state compensates the local government for the useful expenses it has made on the immovable property, if the immovable property has been significantly improved with them. According to the bill, the compensation and fee paid by KOV to the state in the case of the transfer of real estate received for free, as well as in the case of transfer of real estate suitable for the development of the business environment and residential land, will be reduced from 65% to 50% (of the normal value of the land). At the same time useful expenses made by KOV on the immovable property can be deducted from the fee paid to the state. Also, the payment deadline for the transfer of immovable property suitable for the development of the business environment and residential land will be extended from five years to seven years.
