Bilingual Education Amendments of 1981 - Amends title VII of the Elementary and Secondary Education Act of 1965 (Bilingual Education Programs, also known as the Bilingual Education Act) to revise bilingual education policy to no longer require that children of limited English proficiency use their native language while receiving instruction to achieve competence in English. Revises an element of the definition of "limited English proficiency" to refer to "individuals who have difficulty speaking and understanding instruction in the English language." Redefines "program of bilingual instruction" to require inclusion of "an intensive course of study in English." Revises grant provisions to require that bilingual education programs limit participation by any child to one year. Permits an additional year of participation only if an individual evaluation establishes the need for continued services and is approved by the appropriate local education agency official. Prohibits enrollment of any non-handicapped child for more than three years. Sets forth requirements for such individual evaluations. Directs the Secretary of Education to withhold application approval or grant payments whenever a bilingual education program is unable or unwilling to comply with such limitations on individual participation and with such individual evaluation requirements.

Establishes for five years a special Engineering and Science Manpower Fund administered by the chairman of the Council to develop manpower resources. Requires an annual audit of the Center. Directs the Secretary of Education to ensure that: (1) Center service and training programs are monitored regularly; and (2) Center operation is evaluated annually, with written reports to the President and the Congress submitted by specified deadlines. Authorizes appropriations for Center operation and maintenance for use in accordance with guidelines or regulations prescribed by the Secretary. Defines "Helen Keller National Center for Deaf-Blind Youths and Adults" to mean that facility and its affiliated network established pursuant to an agreement approved in 1969 by the Department of Health, Education, and Welfare, and continued pursuant to specified provisions of the Rehabilitation Act of 1973. Repeals such provisions of such Act.

Establishes an Interagency Committee on Smoking and Health to coordinate Federal and private activities. Requires the Committee to meet at least four times a year. Directs the Secretary to report annually to the Congress. Amends the Federal Cigarette Labeling and Advertising Act to change existing label warning provisions to require cigarette packages and advertisements to carry specified warnings on a rotating basis. Makes it unlawful to manufacture, import, or package for sale cigarettes without: (1) disclosing tar, nicotine, and carbon dioxide levels on the package; and (2) providing the Federal Trade Commission and the Department of Health and Human Services with a list of the types and quantities of chemical additives.

Directs the Secretary to exclude from applications unjustified increases requested in anticipation of such reductions. Allows institutions of higher education to provide information concerning student borrowers who have defaulted on direct loans to the Secretary and to collection agencies, in accordance with regulations. Revises provisions relating to student default under the Federal loan insurance program to replace authority to contract with "private business concerns" with authority to contract with "nonprofit private organizations and agencies" for loan recovery purposes.

Comprehensive Smoking Prevention Education Act of 1981 - Amends title XVII (Health Information and Health Promotion) of the Public Health Service Act to establish in the Department of Health and Human Services an Office of Smoking and Health to inform the public of the health hazards of cigarettes. Sets forth the Office's authority and duties, including conducting research and assisting educational programs directly or through grants. Establishes an Interagency Committee on Smoking and Health to be composed of representatives from the Departments of Labor and Education, the Federal Trade Commission, and any other Federal agency designated by the Secretary of Health and Human Services. Directs such Committee to meet at least four times a year and names the Director of the Office of Smoking and Health as it chairman. Directs the Secretary of Health and Human Services to report annually to the Congress. Amends the Federal Cigarette Labeling and Advertising Act to make it unlawful to advertise or export (repeals the existing export exemption) cigarettes without the required labeling. Changes labeling requirements. Directs the Federal Trade Commission (FTC) to establish cigarette labeling regulations as set forth by this Act. Eliminates certain congressional notification and reporting requirements. Increases the fine for violation of such Act from $10,000 to $100,000. Permits an individual civil action to be brought in U.S. district courts for violations of such Act. Requires such plaintiff to give 60-day notice to the FTC and the defendant. Permits intervention and consolidation. Allows the court to award attorneys fees and other costs.

Education Assistance Agency Act - Title I: General Provisions - Declares that the purpose of this Act is to: (1) terminate the Department of Education; (2) define Federal responsibility in education as assistance and support through the establishment of the Education Assistance Agency; and (3) recognize the primary responsibility of parents, States, localities, and educational institutions in determining educational policy. Prohibits, except to the extent specifically authorized by law, construing provisions for Agency programs to authorize any Federal control over educational curricula, administration, personnel, or instructional materials. Title II: Establishment of the Agency - Establishes the Education Assistance Agency in the executive branch, to be administered by a Director. Limits the Agency to two Divisions. Establishes a Federal Interagency Committee on Education to assist the Director in coordinating policies, procedures, and programs of the Agency and other Federal departments and agencies administering educational programs. Title III: Transfers of Agencies and Functions - Transfers specified functions of the Department of Education to the: (1) Department of Health and Human Services; (2) Department of Commerce; (3) Department of Defense; (4) Department of the Treasury; (5) Department of State; (6) National Science Foundation; (7) National Foundation on the Arts and the Humanities; (8) Veterans Administration; (9) Department of Housing and Urban Development; (10) General Services Administration; (11) Office of Management and the Budget; and (12) Education Assistance Agency. Title IV: Administrative Provisions - Sets forth provisions relating to the Agency's officers and employees, experts and consultants, and personnel reductions. Sets forth provisions relating to the Agency's general authority, delegation, reallocation of functions, regulations, and contracts. Provides that the General Education Provisions Act shall apply, except where inconsistent with the provisions of this Act, to functions transferred by this Act to the extent applicable on the day preceding the effective date of this Act. Title V: Transitional, Savings, and Conforming Provisions - Repeals the Department of Education Organization Act.

Sets forth grant application requirements for State educational agencies, including provisions for periodic student proficiency evaluation and for teacher training. Directs the Secretary to make grants to State agencies to fund model foreign language programs designed and operated at community and junior colleges. Bases the amount of such grants on State population. Sets forth grant application requirements, including periodic student proficiency evaluation and teacher training. Requires ratable reduction of such grants when appropriations are insufficient. Directs the Secretary to make grants to institutions of higher education to cover part of the costs of foreign language instruction for their students. Sets forth formulas to determine whether an institution is eligible for such grants, based on the percentage of its student body enrolled in qualified postsecondary language courses. Authorizes the Secretary to establish standards, including reporting requirements, for programs assisted by such grants. Sets formulas for determining the amounts of such grants, based on number of students enrolled in such courses. Requires ratable reduction of such grants when appropriations are insufficient. Directs the Secretary to make grants to each institution of higher education which requires at least two years of postsecondary credits in foreign language (or a competency equivalent thereof) for each graduating student. Sets forth formulas for determining the amounts of such grants, based on the number of students enrolled in the institution. Requires ratable reduction of such grants when appropriations are insufficient. Prohibits any grant or contract under this Act except to such extent, or in such amounts, as may be provided in appropriation Acts. Authorizes appropriations for fiscal years 1983 through 1985 to carry out grant programs under this Act.

Title I: Department of Labor - Department of Labor Appropriation Act, 1982 - Makes appropriations for FY 1982 to the Department of Labor for the following agencies and purposes: (1) the Employment and Training Administration for program administration, employment and training assistance, community service employment for older Americans, Federal unemployment benefits and allowances, grants to States for unemployment insurance and employment services, and advances to the Unemployment Trust Funds and other funds; (2) the Labor-Management Services Administration for salaries and expenses and the Pension Benefit Guaranty Corporation; (3) the Employment Standards Administration for salaries and expenses, special benefits, and the Black Lung Disability Trust Fund; (4) the Occupational Safety and Health Administration for salaries and expenses; (5) the Mine Safety and Health Administration for salaries and expenses; (6) the Bureau of Labor Statistics for salaries and expenses; (7) departmental management, salaries and expenses; and (8) the special foreign currency program. Makes such appropriations which are available for salaries and expenses available for supplies, services, and rental of conference space within the District of Columbia, as deemed necessary for the settlement of labor- management disputes. Prohibits the use of any of the funds appropriated under this title to: (1) pay any prisoner for work performed prior to 12 months before the presumptive release date of such prisoner; (2) carry out any activities for or on behalf of any individual who is an illegal alien; or (3) pay compensation of experts or consultants or organizations thereof, or to procure by contract, the services of experts or consultants, or organizations thereof, in excess of a specified amount. Title II: Department of Health and Human Services - Department of Health and Human Services Appropriation Act, 1982 - Makes appropriations for fiscal year 1982 to the Department of Health and Human Services for the following agencies: (1) the Health Services Administration for health services; (2) the Centers for Disease Control for preventive health services; (3) the National Institutes of Health for the National Cancer Institute, the National Heart, Lung, and Blood Institute, the National Institute of Dental Research, the National Institute of Arthritis, Diabetes, and Digestive and Kidney Diseases, the National Institute of Neurological and Communicative Disorders and Stroke, the National Institute of Allergy and Infectious Diseases, the National Institute of General Medical Sciences, the National Institute of Child Health and Human Development, the National Eye Institute, the National Institute of Environmental Health Sciences, the National Institute of Aging, and Research Resources, the John E. Fogarty International Center for Advanced Study in the Health Sciences, the National Library of Medicine, buildings and facilities, and the Office of the Director; (4) the Alcohol, Drug Abuse, and Mental Health Administration for alcohol, drug abuse, and mental health and Saint Elizabeths Hospital; (5) the Health Resources Administration for health resources and the Medical Facilities Guarantee and Loan Fund; (6) the Assistant Secretary for Health for salaries and expenses; (7) Health Maintenance Organization Loan and Loan Guarantee Fund; (8) retirement pay and medical benefits for commissioned officers; (9) the Health Care Financing Administration for grants to States for Medicaid, payments to health care trust funds, and program management; (10) the Social Security Administration for payments to Social Security trust funds, special benefits for disabled coal miners, supplemental security income program assistance payments program low-income home energy assistance program and special assistance to refugees, asylees, and Cuban and Haitian entrants; (11) the Assistant Secretary for Human Development Services for community services block grants, block grants to States for social services, work incentives, and general departmental management; (12) the Office of the Inspector General; (13) the Office for Civil Rights; and (14) research studies under the Social Security Act. Prohibits any of the funds appropriated by this title for grants-in-aid of State agencies from being withheld from the said agencies of any State which have established by legislative enactment and have in operation a merit system and classification and compensation plan covering their employees because of their selection or the rates of pay of such employees. Prohibits the reimbursement of State or local expenditures made prior to October 1, 1978, under specified titles of the Social Security Act unless a request for reimbursement had been officially transmitted to the Federal government within one year after the fiscal year in which the expenditure occurred. Prohibits the use of any of the funds appropriated in this title to move the headquarters of the National Institute for Occupational Safety and Health or any staff from its present headquarters to Atlanta, Georgia. Title III: Department of Education - Department of Education Appropriation Act, 1982 - Makes appropriations for fiscal year 1982 to the Department of Education for the following purposes: (1) compensatory education for the disadvantaged; (2) special programs; (3) bilingual education: (4) school assistance in federally affected areas; (5) education for the handicapped; (6) rehabilitation services and handicapped research; (7) vocational and adult education; (8) student financial assistance; (9) student loan insurance; (10) higher and continuing education; (11) higher education facilities loan and insurance; (12) college housing loans; (13) educational research and statistics; (14) educational, research, and training activities overseas (special foreign currency program); (15) libraries; (16) Special Institutions for the American Printing House for the Blind, National Technical Institute for the Deaf, Gallaudet College, and Howard University; (17) the Office for Civil Rights for salaries and expenses; (18) Departmental Management for salaries and expenses; and (19) the Office of the Inspector General for salaries and expenses. Prohibits withholding of funds appropriated by this title for grants- in-aid to cover State agency operating expenses because of any disapproval of their personnel or manner of personnel selection if a merit system and classification and compensation plan is in operation. Subjects the funds appropriated in this Act to the American Printing House for the Blind, Howard University, the National Technical Institute for the Deaf, and Gallaudet College to an audit by the Secretary of Education. Prohibits the use of funds appropriated under this Act to: (1) force any school or school district which is desegregated to take any action to force the busing of students; to force on account of race, creed, or color the abolishment of any such school; or to force the transfer or assignment of any student attending such a school to or from a particular school over the protest of the student's parents; (2) transport students or teachers in order to overcome racial imbalance or to carry out a plan of racial desegregation of any school or school system; (3) transport any student to a school other than the school which is nearest the student's home; (4) compensation of, or contracts to procure the services of, experts or consultants or organizations thereof, in excess of specified amounts. Limits the total full-time equivalent employment of the Department of Education during fiscal year 1982. Prohibits the use of any of the funds appropriated in this Act to prevent the implementation of programs of voluntary prayer and meditation in the public schools. Title IV: Related Agencies - Makes appropriations for fiscal year 1982 to: (1) ACTION for operating expenses, domestic programs; (2) the Corporation for Public Broadcasting for the public broadcasting fund; (3) the Federal Mediation and Conciliation Service for salaries and expenses; (4) the Federal Mine Safety and Health Review Commission for salaries and expenses; (5) the National Commission on Libraries and Information Science for salaries and expenses; (6) the National Commission on Student Financial Assistance; (7) the National Labor Relations Board for salaries and expenses; (8) the National Mediation Board for salaries and expenses; (9) the Occupational Safety and Health Review Commission for salaries and expenses; (10) the President's Commission for the Study of Ethical Problems in Medicine for salaries and expenses; (11) the Railroad Retirement Board for the dual benefits payments account; (12) the Milwaukee Railroad Restructuring, administration; and (13) the Soldiers' and Airmen's Home for operation and maintenance. Title V: General Provisions - Limits the expenditure of any appropriation under this Act for any consulting service through procurement contract to those contracts where such expenditures are a matter of public record, except where otherwise provided under existing law, or under existing Executive Order issued pursuant to existing law. Sets forth limitation on the use of funds appropriated for salaries and expenses under this Act. Prohibits the use of funds appropriated under this Act for any loan, loan guarantee, grant, salary, or other remuneration for any individual applying for admission, attending, employed by, teaching at, or doing research at an institution of higher education who has engaged in conduct on or after August 1, 1969, which involves the use of (or the assistance to others in the use of) force or the threat of force or the seizure of property under the control of an institution of higher education, to require or prevent the availability of certain curricula, or to prevent the faculty, administrative officials, or students in such institution from engaging in their duties or pursuing their studies at such institution. Authorizes the Secretaries of Labor, Education, and Health and Human Services to transfer unexpended balances of prior appropriations to accounts corresponding to current appropriations provided in this Act, provided that such transferred balances are used for the same purposes, and for the same periods of time, for which they were originally appropriated. Prohibits any part of any appropriation contained in this Act from: (1) remaining available for obligation beyond the current fiscal year, unless expressly provided; (2) being used for publicity or propaganda to support or defeat legislation pending before Congress, except in presentation to the Congress itself or for normal and recognized executive-legislative relationships; (3) being used to pay for activities by grant or contract recipients or their agents designed to influence legislation or appropriations pending before the Congress; or (4) being used for research, experimental, or other activities presenting a danger to participants or subjects, without their written, informed consent (or that of parents or legal guardians, in the case of minors). Authorizes the Secretaries to make available a specified amount, respectively, from funds available for salaries and expenses under titles I, II, and III, for official reception and representation expenses. Authorizes the Director of the Federal Mediation and Conciliation Service and the Chairman of the National Mediation Board to make available specified amounts for such expenses. Prohibits the expenditure of any of the funds appropriated by this Act pursuant to any order or injunction of any court which would compel the expenditure of such funds for a purpose for which such expenditure is specifically prohibited by this Act.

Overseas Teachers Act of 1981 - Amends the Defense Department Overseas Teachers Pay and Personnel Practices Act regarding Department of Defense overseas dependents schools to limit the term of teaching positions and the travel and quarters allowance benefits for teachers who are recruited outside the United States. Provides exemptions from such limitations in specified teaching situations. Eliminates the limitation on the amount of leave an overseas teacher may accumulate. Permits the use of leave for paternity purposes. Allows any Federal or District of Columbia employee who becomes an overseas teacher to transfer any sick leave accumulated. Requires that any annual leave accumulated by such a Federal or District of Columbia employee shall be liquidated as a lump-sum payment. Transfers the leave accumulated by an overseas teacher as sick leave if the teacher becomes a Federal or District of Columbia government employee. Allows any teacher who is separated from the service to elect to have any leave remaining: (A) liquidated as a lump-sum payment; (B) considered as creditable service for purposes of retirement benefits; or (C) credited to the individual's account in the event the individual is reappointed to a position in an Executive agency. Authorizes the Director of the Office of Dependents' Education to grant a sabbatical to a teacher under certain conditions including the condition that the teacher agrees to serve in the civil service for three years after completing the sabbatical. Requires the Secretary of Defense to set the basic rates of compensation for teachers at rates equal to the average of the range of rates for similar positions in the public school system of the District of Columbia or urban school jurisdictions having an average daily attendance of at least 100,000, whichever average range of rates is higher. (Current law requires rates equal to the average range of rates in urban school jurisdictions of 100,000 or more population). Allows a teacher with at least one school year of service to acquire competitive civil service status upon passing a non-competitive examination. Requires the Secretary to issue regulations concerning certain specified terms and conditions of employment of overseas teachers.

Higher Education Funding Act of 1977 - Amends the Internal Revenue Code to allow an income tax deduction for contributions to a qualified higher education fund established by the taxpayer to fund the higher education of his dependents. Limits the amount of the deduction to the least of: (1) $750 times the number of qualified beneficiaries; (2) 15 percent of the taxpayer's adjusted gross income; or (3) $7,500. Provides that a qualified education fund must be established by the taxpayer pursuant to a written plan: (1) which is designed to defray the cost of room, board, and tuition of one or more eligible beneficiaries at an institution of higher education; (2) which provides that no distribution shall be made by the fund (except upon termination) other than to, or on behalf of, eligible beneficiaries; (3) which provides that upon termination of the fund all assets of the fund shall be distributed to the taxpayer or to his estate; (4) which prohibits contributions to the fund in excess of amounts deductible; and (5) under which the taxpayer includes in gross income certain amounts attributable to the fund upon termination of such fund.

Education Savings Account Act - Amends the Internal Revenue Code to allow an income tax deduction from gross income for contributions of cash, stocks, bonds, or other securities to a savings account for the purpose of paying the educational expenses of the taxpayer or his dependent. Limits such deduction to $2,500 per calendar year adjusted for inflation. Prohibits the establishment of an account for the benefit of more than one individual. Prohibits an individual from being a beneficiary of more than one account. Excludes distributions from such accounts from the gross income of the contributors so long as they are used exclusively for the payment of tuition, fees and other expenses required for enrollment or attendance at an institution of higher education, a vocational school, a secondary school, or an elementary school. Specifies sanctions for the use of account funds for other than educational expenses. Treats qualified distributions as income to the beneficiary for the taxable year in which the amounts were paid. Allows the beneficiary to elect to include such amounts in gross income in the taxable year in which the beneficiary attains age 25 and for each of the following nine years, in successive apportionments equal to ten percent of the total amount of such distributions.
