Summary

National Laboratory Competitiveness Act of 1988 - Amends the Federal Nonnuclear Energy Research and Development Act of 1974 to direct the Secretary of Energy to promulgate: (1) model cooperative research and development agreements not subject to the approval of managers of Department of Energy Operations Offices; (2) generic terms and conditions for inclusion in negotiated (nonmodel) cooperative research and development agreements; and (3) authority for any Director of a National Laboratory to enter into certain cooperative research and development agreements. Instructs the Secretary to delegate to each manager of a Department of Energy Operations Office authority to approve negotiated (nongeneric) terms and conditions of research and development contract agreements recommended by a Director of a National Laboratory. Authorizes Directors to enter into model agreements or to negotiate cooperative agreements with both Federal and non-Federal parties. Sets forth guidelines and requirements applicable to these agreements, including a requirement that the Director give preference to persons who agree to manufacture the relevant property substantially in the United States. Enumerates permitted provisions in connection with cooperative agreements. Describes the approval process, as well as procedures to apply when the manager of an Operations Office requires modification of an agreement. Limits amounts that may be spent by a laboratory manager or operator on cooperative research and development agreements entered into by the Director of a National Laboratory to 20 percent of funds received from the Department of Energy in any fiscal year, unless the appropriate Operations Office Manager approves the expenditure. Sets forth: (1) recordkeeping requirements, including public disclosure policy; (2) provisions to govern disposition of title to property developed by laboratory managers or operators and provisions to ensure the confidentiality of computer software or technical data they obtain or generate; and (3) provisions to ensure that all Department of Energy contracts to operate a National Laboratory conform to standards consistent with this Act, including language making technology transfer a mission of the National Laboratories. Directs the Secretary of Energy to explore innovative ways to cooperate with other Government agencies, including the National Bureau of Standards (now the National Institute of Standards and Technology).
