Ensuring Needed Help Arrives Near Callers Employing 911 Act of 2004 or ENHANCE 911 Act of 2004 - Amends the National Telecommunications and Information Administration (NTIA) Organization Act to direct the Assistant Secretary of Commerce for Communications and Information and the Administrator of the National Highway Traffic Safety Administration to: (1) coordinate the national implementation of E-911 (enhanced 911 emergency phone) services; and (2) create an E-911 Implementation Coordination Office. Requires: (1) such officials to provide grants to eligible entities for the implementation and operation of such services; and (2) grant recipients to certify that no E-911 charges imposed by the appropriate taxing jurisdiction are being obligated or expended for any purposes other than service implementation and maintenance. Requires the: (1) Comptroller General (CG) to study and report on State and local use of 911 service charges; and (2) Federal Communications Commission (FCC) to report on the deployment of E-911 phase II services by tier III service providers. Commercial Spectrum Enhancement Act - Requires any Federal entity that operates a Government station assigned within a specified band of frequencies and that incurs relocation costs due to reallocation to non-Federal use to receive reimbursement from the Spectrum Relocation Fund (Fund) established in this Act. Requires the NTIA to notify the FCC of estimated relocation costs at least six months prior to the commencement of any auction of eligible frequencies. Amends the Communications Act of 1934 to require the FCC, in designing competitive bidding under such auctions, to achieve specified cost recovery objectives. Prohibits the FCC from concluding any auction under which such objectives are not attained. Authorizes the FCC to grant a license for the advance use of eligible frequencies pending an auction, on the condition that the licensee cannot cause harmful interference to the Federal entity until the entity's authorization has been terminated. Establishes the Fund. Requires the CG to examine and report on national commercial spectrum license policy as implemented by the FCC. Universal Service Antideficiency Temporary Suspension Act - Makes certain Federal limitations on the obligation and expenditure of Federal funds and appropriation apportionment inapplicable to any amount collected as Federal universal service contributions or to the expenditure or obligation of amounts attributable to such contributions.

Harmful Algal Bloom and Hypoxia Amendments Act of 2004

Harmful Algal Bloom and Hypoxia Amendments Act of 2004 - Amends the Harmful Algal Bloom and Hypoxia Research and Control Act of 1998 to remove the President's authority to disestablish the Interagency Task Force on Harmful Algal Blooms and Hypoxia. Requires the Task Force to consult with specified entities with expertise in coastal zone science and management. Directs the President to submit to Congress a report describing and evaluating the effectiveness of measures to protect the environment and public health from the impacts of harmful algal blooms. Requires the Secretary of Commerce to provide for local and regional scientific assessments of hypoxia and harmful algal blooms, as requested by States, Indian tribes, and local governments, or for affected areas as identified by the Secretary. Directs the Task Force to submit to Congress: (1) various scientific assessments; and (2) a plan for a national research program to develop and demonstrate prevention, control, and mitigation methods to reduce the impacts of harmful algal blooms on coastal ecosystems (including the Great Lakes), public health, and the economy. Authorizes the Secretary to make available to the University of Miami real property under the administrative jurisdiction of the National Oceanic and Atmospheric Administration (NOAA) on Virginia Key, Florida, for development by the University of a Marine Life Science Center. Authorizes the Secretary to convey to the Government of Mexico the NOAA vessel WHITING.

Repeals provisions enacted by the American Jobs Creation Act of 2004 relating to the excise tax on arrows. Amends the Internal Revenue Code to revise the excise tax on arrows, effective after March 31, 2005, to: (1) impose a tax equal to 39 cents per arrow shaft on the first sale of such shaft (instead of a 12.4 percent tax on the sales price), with inflation adjustments on such 39-cent amount after 2005; and (2) include points suitable for use with arrows in the 11 percent excise tax on arrow parts and accessories.

Commercial Space Launch Amendments Act of 2004

Commercial Space Launch Amendments Act of 2004 - Amends Federal law concerning commercial space transportation to make such law applicable to space flight crews and space flight participants. Instructs the Secretary to ensure that only one license or permit is required from the Department of Transportation to conduct activities involving crew or space flight participants. Prohibits the Secretary from granting waivers that would permit launches without a license or permit if humans will be aboard. Allows the holder of a license or a permit to launch and reenter crews and space flight participants, but only as specified. Authorizes the Secretary to issue regulations requiring space flight participants to undergo physical examination prior to launch or reentry. Authorizes the Secretary to issue safety regulations governing launch vehicle design or operation. Provides for the issuance of experimental permits (including permits for reusable suborbital rockets) allowing for an unlimited number of launches. Permits suspension of licenses under which a previous launch or reentry resulted in serious or fatal injuries. Requires crew and space flight participants to execute reciprocal waivers of claims with licensees and permitees and the Federal government. Makes liability indemnification program requirements inapplicable to space flight participants. Requires the Secretary to arrange for a study of the liability risk sharing regime for commercial space transportation which assesses how the current system could be eliminated. Requires the Secretary to arrange for a report analyzing safety issues related to launching humans into space.

Exempts YMCA retirement plans from certain limitations applicable to church plans. Allows YMCA retirement plans to qualify for tax treatment as money purchase pension plans and church self-funded death benefit plans.

Directs the Secretary of Transportation to arrange with a nonprofit entity for a study: (1) regarding the liability risk sharing regime in the United States for commercial space transportation; (2) to assess methods by which the liability risk sharing regime could be eliminated and whether alternative steps would be needed to maintain a viable and competitive U.S. space transportation industry if it were eliminated; and (3) to examine liability risk sharing in other nations with commercial launch capability and evaluate the direct and indirect impact that eliminating the regime would have on the competitiveness of the U.S. commercial space launch industry in relation to foreign commercial launch providers and on U.S. assured access to space.

Amends the Communications Satellite Act of 1962 to extend, through June 30, 2005, the date for conducting an initial public offering of securities of any successor entity of Inmarsat (a Government-owned communications satellite). Allows a successor entity to be deemed a national corporation, and therefor forgo an initial public offering and public securities listing for the above purposes, if: (1) the successor entity makes certain certifications to the Federal Communications Commission (FCC) with respect to the financial interests of Inmarsat signatories and former signatories, and that no intergovernmental organization has any ownership interest in a successor entity of INTELSAT (another Government-owned satellite) or more than a minimal ownership interest in a successor entity of Inmarsat; (2) the successor entity provides such financial and other information as the FCC may require to verify such certification; and (3) the FCC determines that the successor entity is in compliance with such certification.

Research Review Act of 2004 - Requires the Secretary of Health and Human Services, in coordination with the Director of the National Institutes of Health, to report to specified congressional committees on the methods by which the Roadmap for Medical Research has advanced the use of multidisciplinary research teams and consortia of research institutions to advance treatments, develop new therapies, and collaborate on clinical trials, including with respect to spinal cord injury and paralysis research. Requires the Secretary, acting through the Director of the Centers for Disease Control and Prevention (CDC), to report to such committees on: (1) the epidemiological studies currently underway at such Centers, future planned studies, the criteria involved in determining what epidemiological studies to conduct, defer, or suspend, and the scope of those studies, including with respect to the inflammatory bowel disease epidemiological study; and (2) CDC activities to establish partnerships with research and patient advocacy communities to expand epidemiological studies. Requires the Comptroller General of the United States to study and report to Congress on: (1) Medicare and Medicaid coverage standards that apply to patients with inflammatory bowel disease for specified therapies, taking into account appropriate outpatient or home health care delivery settings; and (2) the problems patients encounter when applying for disability insurance benefits under title II of the Social Security Act and recommendations for improving the application process for patients with inflammatory bowel disease.

Prevention of Child Abduction Partnership Act - Amends the International Child Abduction Remedies Act (ICARA) to limit the tort liability of private entities or organizations that receive grants or enter into contracts or agreements to assist the U.S. Central Authority in carrying out its responsibilities and functions under the Hague Convention on the Civil Aspects of International Child Abduction and ICARA where the action is directly related to the performance of such responsibilities and functions. Creates exceptions to this limitation on liability for: (1) intentional misconduct, actual malice, reckless disregard to a substantial risk of injury without legal justification, or actions unrelated to the performance of responsibilities or functions under such Act; and (2) alleged acts or omissions related to an ordinary business activity.

Provides for a Deputy Administrator and an Assistant Administrator for Pipeline and Hazardous Materials Safety (who shall also be the Chief Safety Officer). Transfers the Bureau of Transportation Statistics (BTS) to the Research and Innovative Technology Administration (established by this Act). Replaces the Research and Special Programs Administration (RSPA) with the Research and Innovative Technology Administration (RITA), which shall be headed by an Administrator appointed by the President, by and with the advice and consent of the Senate. Establishes in RITA an Office of Intermodalism.

Surface Transportation Extension Act of 2004, Part V

Surface Transportation Extension Act of 2004, Part V - Extends Federal highway, highway safety, motor carrier safety, and transit programs for seven months, and authorizes appropriations, through May 31, 2005. Directs the Secretary of Transportation to: (1) apportion funds made available for Federal-aid highway programs under the Transportation Equity Act for the 21st Century (TEA-21) to each State according to the ratio of the State's FY 2004 obligation authority to the FY 2004 obligation authority for all States; and (2) ensure that each State is apportioned funds for the Interstate maintenance program, the National Highway System program, the bridge program, the surface transportation program, the congestion mitigation and air quality improvement program, the recreational trails program, the Appalachian development highway system program, and the minimum guarantee. Sets forth provisions: (1) for reducing future apportionments, and for recovering funds not apportioned, under a multi-year law reauthorizing the Federal-aid highway program that is enacted after enactment of this Act; (2) prohibiting after May 31, 2005, the obligation of any Federal-aid highway program funds until the date of enactment of a multi-year law reauthorizing such program that is enacted after enactment of this Act; and (3) prohibiting a State from transferring unobligated Federal-aid highway funds from amounts apportioned to it for the congestion mitigation and air quality improvement program and the surface transportation program. Authorizes appropriations through May 31, 2005, for specified Federal-aid highway programs, highway safety programs, the Motor Carrier Safety Administration program, Federal transit programs, and sport fishing and boating safety programs. Amends the Balanced Budget and Emergency Deficit Control Act of 1985 (Gramm-Rudman-Hollings Act) and TEA-21, respectively, to set related discretionary spending limits and obligation limitations for FY 2005. Amends the Surface Transportation Extension Act of 2003 to extend highway programs through the end of FY 2004. Amends the Internal Revenue Code to extend authorization for the use of the Highway Trust Fund (including the mass transit account) and the Aquatic Resources Trust Fund for obligations under TEA-21.

Makes necessary appropriations. Allows grants and payments made pursuant to this authority through the second quarter of FY 2005 to be at the level provided for such activities through the second quarter of FY 2004.

Intelligence Reform and Terrorism Prevention Act of 2004

National Intelligence Reform Act of 2004 - Establishes as an independent executive entity the National Intelligence Authority (Authority), headed by a National Intelligence Director (Director), to, among other things: (1) unify and strengthen efforts of the intelligence community (IC); (2) operate the National Counterterrorism Center and national intelligence centers; and (3) establish clear responsibility and accountability for counterterrorism and other intelligence matters relating to U.S. national security. Requires the Director to: (1) serve as the head of the IC; (2) advise the President on intelligence related to national security; and (3) direct and oversee the National Intelligence Program (formerly the National Foreign Intelligence Program). Authorizes the Director to establish and train a National Intelligence Reserve Corps for the temporary reemployment of former IC employees during periods of emergency. Establishes in the Treasury the Reserve for Contingencies of the National Intelligence Director. Establishes a National Intelligence Council (Council) to produce national intelligence estimates for the U.S. Government and evaluate the collection and production of intelligence by the IC. Establishes a National Counterterrorism Center to, among other things: (1) unify strategy for U.S. civilian and military counterterrorism efforts; and (2) integrate counterterrorism intelligence and operations across agency boundaries, both inside and outside the United States. Authorizes the Director to establish within the Authority one or more national intelligence centers to address intelligence priorities established by the Council. Requires the Director to establish the Intelligence Community Scholarship Program to award scholarships designed to recruit and prepare students for civilian careers in the IC. Requires the President to publicly disclose certain intelligence funding information for fiscal years after 2005. Merges the Homeland Security Council into the Council. Establishes a Joint Intelligence Community Council to assist the Director in developing and implementing a joint, unified national intelligence effort to protect national security. Requires the Director of the Federal Bureau of Investigation (FBI) to develop and maintain within the FBI a national security workforce of agents, analysts, linguists, and surveillance specialists. Federal Bureau of Investigation Intelligence Career Service Authorization Act of 2005 - Authorizes the FBI Director to establish an FBI Intelligence Career Service for FBI intelligence analysts. Directs the President to establish an information sharing network to promote the sharing of intelligence and homeland security information among all relevant Federal departments and agencies, State, tribal, and local authorities, and private sector entities. Establishes an Executive Council on Information Sharing. Establishes within the Executive Office of the President a Privacy and Civil Liberties Oversight Board. Requires the congressional intelligence committees to be provided all intelligence estimates and assessments other than those prepared exclusively for the President.

Justice for All Act of 2004 - Scott Campbell, Stephanie Roper, Wendy Preston, Louarna Gillis, and Nila Lynn Crime Victims' Rights Act - Amends the Federal criminal code to grant crime victims specified rights, including: (1) the right to be protected from the accused, to be heard at any public proceeding involving release, plea, or sentencing, and to be treated with fairness and respect; (2) the right to timely notice of any public proceeding involving the crime or any release or escape of the accused and to proceedings free from unreasonable delay; (3) the right to confer with the Government attorney; and (4) the right to full and timely restitution. Debbie Smith Act of 2004 - Amends the DNA Analysis Backlog Elimination Act of 2000 to name the program of grants to States for DNA analysis of samples from convicted individuals as the Debbie Smith DNA Backlog Grant Program, to expand the program to include grants to local governments, and to authorize appropriations through FY 2009. Amends: (1) the DNA Identification Act of 1994 (Identification Act) to expand the scope of DNA samples to be included in the Combined DNA Index System (CODIS); and (2) the Violence Against Women Act to authorize grants to increase the availability of legal assistance to victims of dating violence. DNA Sexual Assault Justice Act of 2004 - Amends the Identification Act to prescribe audit and certification standards for laboratories from which DNA identification records and analyses may be included in CODIS. Directs the Attorney General to: (1) make DNA analysis training grants, sexual assault forensic exam program grants, DNA research and development grants, grants to promote DNA identification of missing persons, and grants to tribal domestic violence and sexual assault coalitions; and (2) appoint a National Forensic Science Commission. Authorizes appropriations for DNA programs of the Federal Bureau of Investigation through FY 2009. Innocence Protection Act of 2004 - Sets forth conditions under which a Federal prisoner asserting innocence may obtain post-conviction DNA testing of specific evidence and, if test results would establish the applicant's innocence, a new trial or resentencing. Requires the preservation of biological evidence if a defendant is under a sentence of imprisonment. Directs the Attorney General to: (1) establish the Kirk Bloodsworth Post-Conviction DNA Testing Grant Program; and (2) award grants to improve the quality of legal representation of indigent defendants, and the ability of prosecutors to represent the public, in State capital cases.

Comprehensive Peace in Sudan Act of 2004 - Sets forth the sense of Congress regarding: (1) the Sudan Peace Act and its extension to the Darfur region of Sudan; and (2) actions to address the conflict in Sudan. Amends the Sudan Peace Act to authorize appropriations for assistance to address the humanitarian and human rights crisis in the Darfur region and its impact on eastern Chad. Authorizes additional FY 2005 appropriations for Sudan upon the conclusion of a North-South peace agreement if the President certifies to the appropriate congressional committees that the Government of Sudan has taken steps to stop attacking civilians, disarm militias, and allow humanitarian access to all areas of Sudan, including Darfur. Requires: (1) suspension of assistance and blocking of senior government officials' assets if such certification is not submitted within 120 days of enactment of this Act; and (2) continuation of existing restrictions until such certification.
