<b>Bezug:</b> Energiewirtschaftsgesetz von 1935 Siehe auch E008, E018, E021, E023 und E025 <br><br><b>Europäische Impulse:</b> Stromrichtlinie der EU vom 20.6.1996 Siehe auch XE020 <br><br><b>Inhalt:</b> Liberalisierung und Deregulierung der nationalen Strom- und Gasmärkte durch Ablösung des aus dem Jahre 1935 stammenden Energiewirtschaftsgesetzes durch ein neues Gesetz über die Elektrizitäts- und Gasversorgung unter Beibehaltung der traditionellen Kurzfassung der Gesetzesbezeichnung sowie durch Abschaffung der kartellrechtlichen Freistellung für Energieversorgungsunternehmen: generelles Kartellverbot für Strom- und Gasunternehmen, d.h. Aufhebung des Grundsatzes des geschlossenen Versorgungsgebietes sowie Abschaffung der kartellrechtlichen Zulässigkeit von Gebietsabsprachen und ausschließlichen Wegerechten in Konzessionsverträgen mit den Gemeinden, Belieferung durch Dritte mittels Durchleitung über vorhandene Netze sowie durch zusätzliche Leitungen, Rückführung der Staatsaufsicht auf das notwendige Maß, Fortführung der Strompreisaufsicht zugunsten der Tarifabnehmer sowie der kartellrechtlichen Mißbrauchsaufsicht bei marktbeherrschender Stellung; Gesetz über die Elektrizitäts- und Gasversorgung (Energiewirtschaftsgesetz - EnWG) als Art. 1 der Vorlage, Einfügung eines § 103b in das Gesetz über Wettbewerbsbeschränkungen, Änderung des § 38 Baugesetzbuch und Streichung des § 18 Gerätesicherheitsgesetz, Übergangsvorschrift für laufende Konzessionsverträge; Außerkrafttreten des Energiewirtschaftsgesetzes von 1935, der Zweiten und Dritten Durchführungsverordnung sowie der Bundestarifordnung Gas. Das Gesetz führt zu Kostenentlastungen für die öffentlichen Haushalte. Das Aufkommen der Gemeinden aus Konzessionsabgaben für Strom und Gas soll durch das fortbestehende Wegemonopol für die Leitungsverlegung sowie durch gesetzliche Klarstellungen und Übergangsregelungen gesichert werden. <br><br><b>Änderungen aufgrund der Ausschußempfehlung:</b> Begrenzung der Abnahme- und Vergütungspflichten für die Einspeisung von Elektrizität aus erneuerbaren Energien, Einbeziehung von Strom aus Biomasse, Betriebs- und Durchleitungspflichten für Versorgungsnetze, getrennter, diskriminierungsfreier Betrieb der Übertragungsnetze und Rechnungslegung gem. Handelsgesetzbuch, Unzulässigkeit unterschiedlicher allgemeiner Tarife für verschiedene Gemeindegebiete, Zulässigkeit von Konzessionsabgaben, Diskriminierungsverbot für Stromlieferungen aus dem Ausland, Sicherung der Verstromung der ostdeutschen Braunkohle bis 2003, Berichte der Bundesregierung zu Erfahrungen mit einzelnen Regelungen; Ersetzung der §§ 1 bis 4 Stromeinspeisungsgesetz durch die neuen §§ 1 bis 4a. <br><br><b>Änderungen durch das Vermittlungsverfahren:</b> Festsetzung von Netzzugangstarifen unabhängig von der Entfernung, Stärkung der Rolle der Gemeinden bei der Energieversorgung, u.a. Beauftragung mit der örtlichen Energieversorgung und Regelung der Vertragsgestaltung, Vorrang für erneuerbare Energien und Kraft-Wärme- Koppelung beim Netzzugang. <br><br><b>Nebenschlagwörter:</b> Energiewirtschaftsgesetz/Ablösung des Energiewirtschaftsgesetzes von 1935 durch Gesetz über die Elektrizitäts- und Gasversorgung (Energiewirtschaftsgesetz) * Elektrizitätsversorgung/Gesetz über die Elektrizitäts- und Gasversorgung (Energiewirtschaftsgesetz) * Gasversorgung/Gesetz über die Elektrizitäts- und Gasversorgung (Energiewirtschaftsgesetz) * Energieversorgung/Gesetz über die Elektrizitäts- und Gasversorgung (Energiewirtschaftsgesetz) * Kartellgesetz/Einfügung § 103b GWB betr.
