Summary
Gesetzliche Konkretisierung des Schutzes gegen Störmaßnahmen oder sonstige Einwirkungen Dritter auf dem Gebiet der Sicherung kerntechnischer Anlagen und Tätigkeiten, erstmalige formellgesetzliche Normierung des atomrechtlichen Funktionsvorbehalts der Exekutive zur Ermöglichung einer abschließenden gerichtlichen Bewertung trotz eingeschränkter Aktenvorlage sowie zur Vermeidung verfassungsrechtlicher Risiken; Klarstellungen zur Verantwortlichkeit für die Gewährleistung des erforderlichen Schutzes und zu behördlichen Verantwortlichkeiten bei der Festlegung der zu unterstellenden Einwirkungen und der hiergegen zu ergreifenden Maßnahmen des Genehmigungsinhabers sowie zu Grundsätzen für die Festlegung der Maßnahmen des Genehmigungsinhabers;<br /> Änderung §§ 9b und 24 sowie Einfügung §§ 41 bis 44 Atomgesetz<br /> <br /> <strong>Beschlussempfehlung des Ausschusses:</strong> Klarstellung zu den Schutzzielen kerntechnischer Anlagen und Tätigkeiten sowie zum Funktionsvorbehalt;<br /> Änderung §§ 42 und 44 Atomgesetz
