Summary
Maßnahmen zur Beschleunigung von Planungs- und Genehmigungsverfahren von Infrastrukturvorhaben insbes. in den Bereichen Verkehr und Energie: Festlegung des überragenden öffentlichen Interesses und der öffentlichen Sicherheit für den Neu-, Aus- und Ersatzbau von Schienenwegen, Bundesfernstraßen und Wasserstraßen, Einräumung eines Schutzgütervorrangs für verteidigungsrelevante Infrastruktur, Einbeziehung aller aus dem Sondervermögen Infrastruktur und Klimaneutralität (SVIK) finanzierten Verkehrsinfrastrukturmaßnahmen, Abschaffung von Verfahrensdoppelungen im Verkehrsbereich durch Raumordnungsverfahren und Linienbestimmungen, Zusammenführung gleichartiger Verfahrensvorschriften aus den Fachgesetzen im Verwaltungsverfahrensgesetz, ausschließlich digitale Durchführung von Planfeststellungsverfahren, Vereinfachung von Genehmigungsverfahren für die Modernisierung der Schieneninfrastruktur sowie Kreuzungsmaßnahmen, Gleichrangigkeit der Ersatzgeldzahlung für naturschutzrechtliche Ausgleichs- und Ersatzmaßnahmen für alle Bundesvorhaben im überragenden öffentlichen Interesse, Vereinfachung der Pflichten zur Umweltverträglichkeitsprüfung (UVP) für Schienenmaßnahmen, raumordnungsrechtliche Erleichterungen für Pumpspeicherkraftwerke; redaktionelle Änderungen, Anpassungen und Korrekturen, Folgeänderungen;<br /> Einfügung, Aufhebung und Änderung zahlreicher §§ und Anlagen in 17 Gesetzen und 1 Rechtsverordnung<br /> <br /> <strong>Beschlussempfehlung des Ausschusses:</strong> weitere vereinfachende und beschleunigende Änderungen verfahrensrechtlicher Vorgaben für Planungs- und Genehmigungsverfahren, u.a. Stärkung des Instruments der Planrechtsfreiheit, Klarstellung der Zuständigkeiten des Eisenbahn-Bundesamtes im Bereich des Umweltrechts, zusätzliche Festlegung des überragenden öffentlichen Interesses betr. Instandsetzung, Erweiterung, Ersatz, Bau oder Ausbau von Tunnelbauwerken, Brücken, Rastanlagen an Bundesautobahnen, See- und Binnenhäfen sowie Flughäfen als auch betr. Maßnahmen des Hochwasser- und Küstenschutzes, Berücksichtigung zahlreicher Empfehlungen des Bundesrates, u.a. zum besonderen Geheimhaltungsbedürfnis von Daten betr. kritische Infrastrukturen, Ermöglichung des umfassenden Einsatzes von SVIK-Mitteln durch die Länder, Normierung der Voraussetzungen für den Einsatz vollautomatisierter Fahrfunktionen beim Betrieb eines Triebfahrzeugs, Klarstellungen, redaktionelle Anpassungen, Folgeänderungen;<br /> Erneute und zusätzliche Änderung sowie zusätzliche Einfügung und Aufhebung zahlreicher §§ und Anlagen in 19 Gesetzen und 2 Rechtsverordnungen
