Summary
Keskkonnakomisjon algatas atmosfääriõhu kaitse seaduse (AÕKS) muutmise seaduse eelnõu kiireloomulise vajaduse tõttu täiendada lubatud heitkoguse ühikutega kauplemise enampakkumistulu kasutamise korda ning lisada seadusesse säte, et kliimamuutuste leevendamiseks loodud kauplemisskeemide alusel antud toetuse tagasinõudmise otsus on täitedokument. Eelnõu täpsustab enampakkumisel saadud tulu kasutamise korda ning lisab sätte, mille kohaselt võib vahendite kasutaja lubatud heitkoguse ühikutega kauplemisest saadavate vahendite kasutamiseks sõlmida halduslepingu. Eelnõuga lisatakse ka säte, mille kohaselt loetakse AÕKSi ja välisõhu kaitse seaduse (VÕKS) alusel erinevate kauplemissüsteemide alusel saadud vahenditest antud toetuse taotluse rahuldamise otsuse kehtetuks tunnistamisel tehtud toetuse tagasinõudmise otsus täitedokumendiks täitemenetluse seadustiku tähenduses. Eelnõuga täpsustatakse enampakkumisel saadud tulu kasutamise korda, sest alates 1. jaanuarist 2017. a jõustuv AÕKS ei võimalda hetkel kõiki riigi eelarvestrateegias ette nähtud meetmeid ellu viia ja seega enampakkumisel saadud tulu kasutada. Kavandatav täpsustus ning halduslepingute sõlmimise võimalus tagab enampakkumistulu kasutamise.
