Summary
Eelnõuga muudetakse jäätmeseaduse § 1 lõike 5 ülamärkes 1 toodut ja lisatakse piirang riigihangete seaduse § 12 rakendamisele ka korraldatud jäätmeveoga hõlmatud jäätmete taaskasutamise ja kõrvaldamise ning kohaliku omavalitsuse üksuse korraldusel kokku kogutud jäätmete taaskasutamise ja kõrvaldamise tellimisele. Muudatuse eesmärk on anda jäätmekäitluses erasektorile rohkem investeerimiskindlust, parandada konkurentsi ja teenuse kvaliteeti. Eelnõu kohaselt jõustub uus nõue 1. jaanuaril 2031, et kohaliku omavalitsuse üksusele jääks uue nõudega arvestamiseks piisavalt aega. Juhul kui avatud või piiratud hankemenetlus on pakkumuste puudumise tõttu lõppenud, näevad riigihangete seaduse sätted ette võimaluse sisetehinguks, ehk väljakuulutamiseta läbirääkimistega hankemenetluse kasutamist.
