Après l’article 227‑8 du code pénal, il est inséré un article 227‑8‑1 ainsi rédigé : «  Art. 227‑8‑1 . – Le fait de refuser de présenter un enfant mineur est justifié lorsque le père ou la mère qui le réclame est poursuivi ou condamné du chef de viol, d’agressions sexuelles ou d’atteintes sexuelles définis aux articles 222‑1 et suivants et ne constitue pas un délit au sens des articles 227‑5 et suivants. »
