Summary

Faced with the scourge of the misuse of nitrous oxide, particularly among young people, the law aimed at providing immediate responses to phenomena disturbing public order, security and the tranquility of our fellow citizens ("RIPOST") of August 18, 206 provides for a general ban on the possession, transport and transfer of this substance. From February 2027, individuals will no longer be able to obtain nitrous oxide. Moreover, the law creates an offense of inhalation punishable by one year of imprisonment and a fine of €3,750 and an offense of driving after clearly consuming psychoactive substances punishable by three years of imprisonment and a fine of €9,000. In order to facilitate proof of the misuse of nitrous oxide, particularly when driving a vehicle, the road safety delegation is helping to finance a study aimed at validating scientifically the detection of nitrous oxide in exhaled air using a detection device close to a breathalyzer.
