Summary

The municipal police is an important player in the security continuum, and recent reforms show the particular attention that successive Governments pay to it. Regarding the reform of the municipal police compensation system, following numerous consultation meetings held with trade union organizations and municipal employers at the end of 2023 and beginning of 2024, the Government developed a draft decree reforming the architecture of the compensation system and substantially increasing its ceilings. This text was submitted for opinion to the Superior Council of the Territorial Civil Service (CSFPT), on March 27, 2024, and to the National Council for the Evaluation of Standards (CNEN), on April 4, 2024, both of which issued a favorable opinion. This proactive approach undertaken within the framework of a dialogue carried out with trade union organizations and territorial employers allowed the publication on June 28, 2024 of decree no. 2024-614 of June 26, 2024 relating to the compensation system for civil servants falling within the employment framework of the municipal police and civil servants falling within the employment framework of rural guards. This decree established a special function and commitment allowance (ISFE) which can be granted to all of these civil servants. The ISFE is made up of two parts : a “function” part calculated by applying to the amount of salary subject to pension deduction, a percentage set by the deliberative body, and a variable part linked to professional commitment and the manner of service. The ceilings applicable to each employment framework have also benefited from a substantial increase in their amount. The aforementioned decree also provides for a “safeguard clause” in order to guarantee all beneficiary agents maintain at least the amount of the previous monthly compensation scheme. This reform was welcomed in particular by representatives of Force Ouvrière (FO) as constituting real progress for municipal police officers during the Congress of Mayors of 2024. This reform was the subject of social dialogue within each community, since the latter had until December 31, 2024 to organize new deliberations establishing, no later than January 1, 2025, the new compensation regime. Concerning the retirement aspect of the municipal police, it should be remembered that category C agents of the municipal police already benefit from classification in the active category allowing them an early retirement of five years compared to agents in the sedentary category. Dialogue within the CNRACL, in where the representative unions and territorial employers are based, should make it possible to better understand the specificities of the retirement systems dedicated to these territorial agents. Furthermore, as part of the “Beauvau of municipal police forces” initiated during the first half of 2024, a global reflection was undertaken, in consultation with all security stakeholders, employers and trade union organizations. represented within the Municipal Police Advisory Commission (CCPM), with a view to adapting the scope of competence and means of action of municipal police officers to the new challenges represented by the increase in violence in the territory.
