Summary

Ms Émilie Guerel questions the Minister of the Economy and Finance on the announced abolition (PLF 2019) of the reduced rate of the internal consumption tax on energy products (TICPE) from which non-road diesel (GNR) currently benefits. Experienced as brutal and sudden by construction professionals, this decision would have serious consequences on the sector's activity. Indeed, according to estimates, its impact direct would be 500 million euros for public works activity alone (i.e. around 60% of companies' margin): road works as well as earthworks would be particularly affected. The consequences of this increase in taxation, with regard to current contracts and the level of public works activity, would therefore benefit from being studied exhaustively. As a reminder, two thirds of the activity of Public works in France depend on public procurement, which leads to an unequal relationship between the public contractor and the company. Also, this measure, if it is not “neutralized” in its economic effects, would further reduce the already very low margin rate in the sector (around 2%) and would strongly penalize public works SMEs. On the other hand, despite the evolution of production costs, not all contracts do not provide for price revision formulas in the context of a long-term project; such an increase in taxation would therefore create an economic imbalance that is very detrimental to businesses. Questioned by the Var construction federation, she would like to know if the Government would be in favor of “neutralizing” all of the effects of economic destabilization of the public works sector in France. To do this, it could be considered, when a contract does not include a price revision clause, the establishment of a mandatory amendment integrating the increase in production costs induced for the works concerned. Furthermore, taking into account the substitution of the price of GNR by that of diesel, the structure of the INSEE indexes could be redefined quickly in order to avoid any cost gap with regard to the real situation.
